Background: • The Planning Commission held a public hearing on this
application at its November 1, 2011 meeting. The report prepared
by the City Planner is attached.
• The Commission recommended approval of the variance, with
findings and conditions as recommended by t]�e Planner which
have been have been incorporated into a draft resolution for the
City Council's use.
• The Planning Commission recommended approval with a
condition that the Park and Recreation Committee review the
application and recommend whether or not the cash-in-lieu of land
park dedication fee of$3,000 should be waived. The owner has
proposed to allow public use of 290 acres of land which will be
permanently protected with a conservation easement and
eventually transferred into ownership by the Minnesota
Department of Natural Resources.
• At their November 7 meeting the Park and Recreation Committee
recommended that the Council waive the park dedication fee.
Recommendation: I recommend that the Council adopt the resolution approving the

APPROVING MINOR SUBDIVISION AND VARIANCES
FOR 23620 OLINDA TRAIL NORTH
WHEREAS, Roger and Joyce Heinisch have made application for a minor subdivision
and variances from the minimum lot size requirement and accessory structure standards to create
a 10-acre parcel and to preserve the existing accessory structures on that parcel, located at 23620
Olinda Trail, City of Scandia; and
WHEREAS, the parcel that will be subdivided is legally described as follows:
See Exhibit A; and
WHEREAS, the 300-acre Heinisch property is legally described as follows:

WHEREAS, the Planning Commission reviewed the request at a duly noticed Public
Hearing on November l, 2011, and has recommended approval; and
WHEREAS, the Parks Committee reviewed the request at a duly noticed public meeting
on November 7, 20i 1, and has recommended that the City's Park Dedication Fee be waived for
this minor subdivision based on the proposed uses of the 290 acres of the applicant's property as
permanent agricultural use and open space and the applicant's willingness to allow public use of
the open space; and
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL
OF THE CITY OF SCANDIA, WASHINGTON COUNTY, MINNESOTA, that it should
and hereby does approve a minor subdivision and variances to allow a new parcel with a lot size
of 10 acres and to preserve the existing accessory structures on that parcel, and approves waiving
the platting requirement for this minor subdivision, and approves waiving the Park Dedication
Fee based on the following findings:

1. Granting the requested variance is in harmony with the Comprehensive Plan goals and
policies for the Agricultural Core (AG C) and Agricultural Preserves (AP) Zoning
Districts, and will help to further the Comprehensive Plan goals for those districts based
on the following:
a. The applicants are placing a permanent conservation easement on 290 of the 300
acres that they own that surround the 10-acre parcel. The easement prohibits
future development of the 290 acres; the allowed uses under the easement will
include continued agricultural use, open space and wildlife habitat. The intent of
the AG C District is to preserve these uses in Scandia for the long-term.
b. Establishment of the conservation easement will meet the same goals as use of an
Open Space Conservation Subdivision (OSCS), which is encouraged in the AG C
District. Variable lot sizes are allowed in an OSCS.
c. The variance will allow preservation of traditional agricultural buildings and the
agricultural character of the area, which are goals included in the Comprehensive
Plan.
d. The proposed use of the property meets the density requirements and dimensional
standards of the AG C District.
2. The property owner proposes to use the property for a single-family residence and
agriculture, which are reasonable uses in the AG C District.
3. The practical difficulties �re not caused by the landowner,but are related to the location
of the existing field and roadway configuration, and the location of the traditional barn
structures on the property.
4. Granting the variance would not alter the essential character of the area,but rather will
help to protect agricultural character and preserve and enhance natural resources in the
AG C District.
5. The request is related to the desire to provide for permanent agricultural, open space, and
wildlife habitat uses for the property, not solely for economic benefit.
6. Waiving the platting requirement is appropriate because the 290-acres that will be placed
in a permanent conservation easement will not be subdivided in the future.
7. Waiving the Park Dedication Fee is appropriate based on the long-term use of the 290-
acres surrounding the 10-acre parcel for agriculture, open space and wildlife habitat, and
the applicant's willingness to allow public use of the open space.
FURTHER BE IT RESOLVED, that the following conditions of approval shall be met:

1. The minor subdivision shall be in substantial compliance with Exhibit B attached to this
resolution.
2. All existing accessory structures shall be permitted to remain on the 10-acre parcel
provided that they remain in agricultural use or any other use as allowed by the city's
ordinances.
3. The Applicant shall pay all fees and escrows.

Arlen Johnson, 11080 189`" Street: Mr. Johnson stated that he has lived at his residence across
the street from the vacant lot for many years and is in favor of granting the variance. The lot is
being cleaned up and a new home will be an improvement to the neighborhood.
There were no further public comments and Chair Maefsky closed the hearing.
The Planning Commissioners noted that on their October 30 site visit it was obvious that trees
had been removed and clearing for the house site had begun. Administrator Hurlburt explained
that a landscape plan showing tree removal and replacement is a condition of granting the
variance and is necessary to meet the conditions of the ordinance.
Mr. Johnson addressed the Commissioners and stated that the lot contained many dead and
diseased trees. He estimated that of the 8 or 9 trees that were removed, about 5 or 6 were rotted,
dead or dying. Diameters may have varied from 10"to 15".
City Planner Buss offered that she has pictures of the lot prior to any tree removal and will work
with the applicant to establish a landscape plan.
Schwarz, seconded by Krinke, moved to recommend to the City Council the Planner's
conditions of approval for the variance and to make the applicant aware that no further
acdon be taken on the property until all permits are approved. The motion carried 5-0.
PUBLIC HEARING: MINOR SUBDIVISION AND VARIANCES TO CREATE A 10-
ACRE LOT,AND VARIANCES FROM THE MAXIMUM NUMBER AND SQUARE
FOOTAGE OF ACCESSORY STRUCTURES, 23620 OLINDA TRAIL
Roger and Joyce Heinisch own 300 acres on eight connected parcels in Scandia. They have
requested a minor subdivision to create a 10-acre parcel on one of the existing 40-acre parcels
along Olinda Trail that would include the existing home and accessory structures. They are
working with the Minnesota Land Trust to create a permanent conservation easement on the
remaining 290 acres. They have discussed potential future ownership of the easement area with
the Minnesota DNR. No future residential, commercial or industrial uses or structures would be
permitted under the easement. The easement would allow for a variety of agricultural,
recreational and open space uses. The applicants are willing to allow public use of the property.
City Planner Buss presented the planner's report and explained the request for the variances. The
property lies in the AG C District and requires a variance for the creation of a 10-acre parcel.
The proposed parcel has 14 significant accessory structures, including barns, sheds, silos and a
detached garage. The combined square footage totals approximately 34,000 square feet. The
ordinance allows two accessory structures and a total of 2,500 square feet on a 10-acre parcel.
The applicants have indicated that the property will continue to be a farming operation and that it
is important that the buildings be retained. Planner Buss advised that controls should be in place
that prevents potential future incompatible uses on the property, such as trucking business, auto
repair businesses, or large kennels.

Planner Buss explained that the City has the option to obtain park land or collect the fee in lieu
of land ($3,000). Planner Buss recommended that the City consider waiving the park dedication
requirements if the conservation easement and owners allow public use of the property.
The Parks Committee is scheduled to discuss the application at their November 7 meeting, and
will make a recommendation to the City Council.
Planner Buss explained in the findings that granting the variance to allow the 10-acre parcel in
the AG C District furthers the goals of the Comprehensive Plan to preserve open space and
protect natural resources. The minor subdivision was compared to Open Space Conservation
Subdivisions (OSCS) that require at least 55% of the property be permanently dedicated for
agricultural use or open space. The minimum lot size allowed for an OSCS is 1.5 acres, with no
maximum size specified. The designation of a conservation easement over 96% of the property
accomplishes the same goals as OSCS and it is reasonable to allow the flexibility that would be
allowed for an OSCS.
Planner Buss recommended approval of the variances and recommended that the Planning
Commission further discuss the number and square footage of accessory structures that should be
permitted.
Chair Maefsky opened the public hearing.
Roger Heinisch, 23620 Olinda Trail: Mr. Heinisch recognized that some of the buildings should
be removed and stated that one grain bin and the corn crib are scheduled for removal. The
remaining buildings are used by himself and a renter for the continued operation of the farm. Mr.
Heinisch stated that the two historic barns are in good condition. The pole buildings are less than
twenty years old and that it would be a tragedy to tear them down. He has pursued a conservation
easement through the Minnesota Land Trust so that no houses could ever be built on the open
parcels and it could be preserved for the public to enjoy.
Mr. Heinisch went on to explain the importance of creating a ten-acre parcel. It would allow the
existing field road to be south of the proposed lot. This would provide access to the fields so that
agricultural activities can continue if the 10-acre parcel is sold in the future. Other access options
are limited.
Nancy Kofka, Conservation Director of the Minnesota Land Trust, Red Wing branch: Ms. Kofka
described how the conservation easement would allow existing uses to continue and that the
Land Trust would monitor and hold the property even in the eventual transfer to the DNR. A
covenant is placed on the land so that it can never be built upon or divided. Future plans for the
land include restoration of some of the fields to native grassland, wildlife management, limited
timber harvest and primitive trails open to the public.
There were no further public comments and Chair Maefsky closed the hearing.
Commissioner Krinke asked for clarification of the park fee issue. Planner Buss stated that the
Park Committee will discuss this at their meeting on November 7 and make a recommendation to

the Council. Administrator Hurlburt offered the question of how would the city ensure that the
easement is accessible to the public and how would this be enforced. Ms. Kofka stated that the
conservation easement allows public access but does not require it. Planner Buss suggested that
the City Attorney should advise on this matter.
Commissioner Krinke asked if Condition #3 should be decided tonight. Planner Buss replied that
the Commission should make a recommendation on the number of accessory structures allowed
on the 10-acre parcel. Maefsky asked if an Interim Use Permit could be issued. Administrator
Hurlburt replied that this wouldn't be correct in this instance, but should be a condition of the
variance. Buss stated that the wording of the resolution would include that the structures could
stay on the property as long as they are only used for agricultural purposes or storage, although
enforcement and monitoring is difficult. Hurlburt agreed and stated that the resolution would be
recorded with the land and would show up in a title search, as a tool of enforcement. Ordinances
are in place to prohibit commercial use of the 10-acre parcel.
Philippi asked if exceptions could be made for the historic barns and be required to remain.
Consensus was that this could be allowed but not enforced. If they fall into disrepair, they should
come down.
Schwarz questioned if allowing all structures to remain would be setting a precedent and is in
contrast to what the ordinance states. A parcel would need to be in excess of 80 acres to allow
this number. Hurlburt explained that the surrounding 290 acres would remain undeveloped and
there is rationale that it is in proportion to the surrounding open space.
Krinke, seconded by Hogle, moved to recommend to the City Council the Planner's
conditions of approval for the minor subdivision and variances with Condition#3 to state
the existing accessory structures be allowed to remain as long as they remain in
agricultural use or any other use as allowed in the ordinance.
Commissioner Philippi stated that he would like to stipulate that the historic barns remain on the
property should the property be restored to native habitat or agricultural use otherwise lapse, but
that the balance of the accessory structures must be removed with the exception of a garage. He
was concerned about the intensity of the use of the 10-acre parcel when the surrounding property
is no longer used for farming.
Hurlburt stated that there are accessory uses for the property as allowed in the ordinance and also
permits for conditional uses, such as bed and breakfasts, ag related businesses, livestock type
uses, outdoor private recreational uses, and ag tourism, among others. Hogle and Maefsky stated
that they did not see any conflicts with these uses, they are compatible uses, the surrounding
acreage will permanently remain open and the rural atmosphere will be preserved as the
Comprehensive Plan intended.
The Commission voted on the above motion. The motion was approved 3-2, with Philippi
and Schwarz opposed.

DETAILED EVALUATION OF THE REQUEST:
Comprehensive PCan
The subject property is designated Agriculture Preserves and Agricultural Core on the Future Land Use map
included in the Comprehensive Plan. (Parcels included in Agricultural Preserves are at the south end of the
property, and indicated on the map attached.) The Agriculture Preserves status of the parcels enrolled in that
program expired on May 7,20l 0,but the zoning status remains.
The Comprehensive Plan includes the following goals related to the AG Core District that are relevant to the
proposed subdivision request:
• The plan encourages lot sizes that will support continuation of agricultural land uses.
• The plan encourages protectin�a�-icultural production as a long-term land use, and encourages long-
tertn protection of agricultural lands and open space through conservation easements,the Agriculture
Preserves program, Open Space Conservation Subdivisions and similar programs.
• The plan also encourages preservation of historic agricultural structures in order to support long-term
agriculture use and maintain the rural character of Scandia.
• The plan encourages protection and restoration of natural resources and wildlife habitat.
The applicants are proposing to place a permanent conservation easement on 290 of the 300 acres that they
own. The consetvation easement would be held and monitored by the Minnesota Land Trust. The applicants
have discussed potential transfer of the easement area to the Minnesota DNR in the future. Minnesota Land
Trust staff indicated that the following uses will be allowed in the area under the conservation easement:
• Continuation of agriculture use on the existing cultivated fields.
• Restoration of some or all fields to native grassland,with a management plan.
• Wildlife management,including hunting.
• Limited timber harvest in woodland areas with a management plan.
• Protectiom or expansion of stream buffers.
• Primitive(non-paved)trails. ATV's or other motorized use would only be allowed to use the area to
support agricultural activities or habitat management.
• Recreation and educational uses with minimal impacts.
• Benches or rustic structures related to recreation could be placed on the property.
No future residential, commercial or industrial use or structures would be permitted under the easement. No
utilities may be developed on the property.
The proposed subdivision is consistent with the intent and manv of the�oals in the Comprehensive Plan.
However, it is not consistent with the recommended lot sizes for the A�riculture Core District recommended
in the Comprehensive Plan The�u�pose of the lot size recommendations in the AG C District is to supvort
continuation of agricultural uses.

Density
The maximum density for conventional subdivision in the AG C District is 4 units per 40 acres. The subject
property includes 300 acres and would create a new 10-acre parcel with one dwelling unit and preserve the
remaining 290 acres in eight parcels with no existing or future dwelling units. The proposed subdivision
meets the density standard of the AG C Districf.
Lot Size and Frontage
The Development Code requires that new lots in the AG C District be 2 to 5 acres in size, or 20 acres or
greater in size. The code allows lot sizes in Open Space Conservation Subdivisions(OSCS)to vary from the
specified sizes. The code indicates that the minimum lot size in an OSCS is 1.5 acres; no maximum lot size
is identified.
Minimum frontage on a public street is required as follows: lots 2 to 3 acres must have a fronta.ge of 160 feet,
lots 3 to 4 acres inust have 240 feet, and larger lots must have 340 feet.
The proposed new parcel would have a lot size of 10 acres, and a frontage of approximately 600 feet on
Olinda Trail North. The proposed�arcel does not meet the lot size requirement in the AG C district,but
does meet the fronta�e re�uirements. The applican#s have requested a variance fi•om the lot size standard to
permit creation of the 10-acxe parcel.
Accessory Structures
There are 14 existing significant accessory buildings on the site(excluding miscellaneous small sheds). The
structures include barns, sheds, silos,and a detached garage. The structures aze located on the parcel
proposed for subdivision(identified on attached figure). The total area of the 14 accessoxy structures is
approximately 34,000 square feet. The Development Code allows a ma�cizrxum 2 accessory structures and
tota12,500 square feet of accessory structures on lots of 10 to 20 acres in size.
The ordinance limitations on the number and size of accessory structures on lots less than 40 acres in size is
designed to prevent potential future incompatible uses on these parcels. Other communities have recently
addressed sites where non-agricultural uses such as trucking businesses,auto i�epair businesses,and large
kennel operations have begun operation in larger accessory buildings in zones where these businesses are not
permitted.
The applicants highlighted the two traditional hip-roofed 6arns tbat are hand-hewn, wood pegged structures
in the application. The total area of the two barns is approximately 8800 square feet and the area of the
detached garage is approximately 600 square feet. The applicants indicated verbally that they would like to
keep most or all of the accessory structures on the parcel.
Wetlands
There are no wetlands within the proposed 10-acre parcel. No new developrnent is proposed on the parcel.
Existing wetlands on the 290-acre parcel are shown on Exhibit B submitted with the application. No new
development is proposed on this parcel.

Setbacks
The required setbacks are front yard of 40 feet, side yard of 20 feet, and rear yacd of 50 feet. The existin�
structut•es meet the repuired setbacks and no new buildin�s are proposed.
Burldable Area
No new buildings are proposed on the new or existing parcels_
Wastewater Treatmertt
The existing homestead is served by an on-site septic system. No new uses that would require wastewater
treatment are proposed.
Stormwater MnnRgement
No alteration is proposed in the gc•ades on the site, and no new impervious surfaces are proposed.
Access
The existing driveway is located on Olinda Trail, a county roadway. The application was referred to the
County for comment, as required by the Development Code. The County's letter dated October 15, 2011
indicates that no impacts or concerns were identified for Olinda Trail.
Easements
Minnesota Land Trust staff indicated that the property owners are proposing to place a permanent
conseivation easement on the 290 acres ofthe property outside the 10-acre homesite. The conservation
easement would be held and managed by the Land Trust. The applicants have discussed eventual sale of the
property with the easement to the Minnesota DNR with staff of the agency.
The easement would allow for a variety of agricultural, recreational and open space uses, and would prohibit
any residential, commercial or industrial development on the property in perpetuity. The easement would
allow for public use of the property for recreational and educational purposes,and the applicants are willing
to allow public use of the property.
Park Dedication
Paxk dedication is reyuired for new subdivisions. The City has th�option to obtain park land or collect the
fee in lieu of tand{$3,000). The property is not within a Park Search Area per the Comprehensive Plan, so
the City could propose to collect the park fee of$3,000 in lieu of land. However,the applicants are
proposing that the area within the conservation easement be open to the public for passive recreational use
such as walking, biking,horseback riding, and nature observation.
The Parks Committee is scheduled to discuss the application at their meetin�on November 7, after the
Plant�in�Commission and before the Council meeting on November 15. This will allow the Committee to
make a recomm,endation re�ardin�potential park dedication rec�uirements. The Planner recommends that the
City consider waiving the park dedication req,uirements if the conservation easement and owners allow
public use of the property.

DETAILED DISCUSSION OF THE VARIANCE REQUEST
The State of Minnesota has recently passed legislation modifying the statute regarding variances. The City
Attorney has advised that we use the new state language for this application, and that the City's ordinance be
updated to include the new state language related to the criteria for granting a variance.
The new language states that "Yariances shall only be permittec�when they are in harmony with the general
purposes and interrt of the offrcial control and when the variances are consistent with the comprehensive
plan. Variances may be granted when the applicant for the variance establishes that there are practical
difficulties in complying with the official control. Variances may be granted when the applicant for the
variance establishes that there are practical difftculties in complying with the o�cial control. `Practical
diffrculiies, 'as used in connection with the granting of a variance, means that the property owrrer proposes
to use the property in a reasonable manner not permitted by an official control; the plight of the lando�mer
is due to circumstances unique to the property not created by the landowner; and the variance, if granted
will not alter the esse»tial character of the localrty. Economic considerations alone do not constitute
practical difftculties. "
FINDINGS
The following bullets present the Planner's fmdings related to the Heinisch request for a variance,based on
the statutory criteria for granting a variance. Each of the criteria are shown in italics:
• The property owrrer proposes to use the property in a reasonable manner under the conditions allowed
by official control(s).
Agriculture and Single Family Residences are pennitted uses in the Agricultural.C�re(AG C)District,
and are therefore reasonable uses of the property.
However, the applicants are requesting the following variance fi•om the official controls:
� A variance from the required lot size to allow a ten-acre lot. The development code specifies
thaf lots in the AG C District be 2.0 to 5.0 Acres or 20 acres or greater.
• A variance from the total nutnber and area of accessoiy shuctures allowed in the AG C District.
Lot srze variance request analysrs
The applicants provided the foliowing rationale for the requested lot size variance:
• Expansion of the proposed 10-acre parcel to 20 ac�•es would encompass an existing access road that
provides access to the agi7cultural fields. The existing road is just south of the proposed 10-acre
parcel, and is shown on the attached figures. They believe that this existing road needs to rennain in
order to provide access to the fields so that the agricultural activities can continue if the 10-acre
parcel is sold in the future. The applicants indicated that other access options are limited,and that
feasible accesses in other locations would divide existing fields, and require grading and a new
culveri.

The Planner su�,gests that t�rantin�the variance to allow the 10-acre parcel in the AG C District based on the
followin�:
• Granting the variance will further the goals of the Comprehensive plan to prese�ve long-terin
agricultural use and open space and protect natural resources in the AG C district.
• The Development Code does allow flexibility in lot sizes#'or Open Space Conservation Subdivisions.
OSCS require that at least 55 percent of the property be permanently dedication for agricultural use
or open space. The minimum lot size allowed for OSCS is l.5 acres, with no maximum size
specified. The application of a conservation easement over 96%of the property owned by the
applicant accomplishes the same goals as OSCS,a.nd exceeds the required dedication of open space.
Therefore, it is reasonable to allow the flexibility that would be allowed for an OSCS.
• Allowing the 14-acre parcel would more easily allow maintenance of the two existing barn structures
than a 2 to 5 acre lot,
• Allowing the 10-acre parcel allows maintenance of the existing access road,and helps to maintain
long-term agricultural use on the property.
Accessory structure varin�:ce analysis �
The applicants are requesting a variance from the allowed number and total area of accessory structures in
order to preserve two historic barn structures. The applicants noted the significance of the two traditional
barns in the application, and indicated verbally that they would like to keep most or all of the accessory
structures on the parcel.
The Plannin� Commission should discuss the applicant's request and make a recomnnendation re�axdin�the
number and area of accessoiy structures that will be pernutted to remain on the site. Issues to consider
include:
• Comprehensive Plan goals to preserve traditional agricultural buildings and the agricultural character
of the community.
• Potential concerns related to future incompatible use of the accessory structures
• A garage is a necessary accessory structure in the local climate.
. The practical diff cultres are not caused by the landowner, and are unique to the property.
The practical difficulties are caused by the location of the existing field and roadwayconfiguration, and
by the location of the existing historic barn structures on the property. The difficulties are unique to the
historic development of the property, and were not created by the current landowner.
• The variance would not alter the e.ssential character of'the area.
Granting tlxe variances would help to protect the agricultural character of the area,and to preserve and
enhance existing natural resources.
• Economic conditions alone shall not cvnstitute practical di�cultres.

The applicants indicated that the request for a 10-acre parcel was made ui part because a 10-acre parcel
is more saleable than a 20-acre parcel. However,they indicated that this economic consideration is not
the only reasoz�for the request.
• Variances shall only be pernzitted wherr they are in harmony�vith the generalpurposes and intent of the
offtcial control.
Granting the requested variances is in harmony with the purposes and intent ofthe Comprehensive Plan
and Development Code as follows:
o The variances will support protecting 290 acres with a permanent eonservation easement that
limits future use to agricultural production,habitat and wildlife management, and open space.
o The vat•iances will allow preservation of historic agricultural structures and maintain the rural
character of Scandia.

PLANNING STAFF RECOMMENDATIONS:
The Planner recominends that the PIanning Commission approve the proposed minor subdivision of the
property located at 23620 Olinda Trail North. The Planner also recommends that the Planning Commission
approve the requested variances to altow a 10-acre parcel in the AG C District,and to allow some of the
accessory structures to remain on the parcel,based on the findings noted above. The Planning Commission
should recommend the number and total area of accessoiy structures that cnay remain. The Planner
recommends the following conditions for the subdivision:
1. The minor subdivision shall be in substantial compliance with Exhibit B included in the application.
2. The applicant shall establish a permanent conservation easement on the 290 acres of their property
that are outside the 10-acre homesite. The permanent conservation easenaent shall prohibit future
residential, commercial and industrial development on the parcel.
3. _accessory structures totaling_square feet in area shall be permitted to remain on ihe 10-acre
parcel. All structures that are not permitted to remain shall be removed before the applicant records
the 10-acre pareel.
4. The Applicant shall pay the park dedication fee of$3,000 unless the Park Committee and City
Council agree to waive the fee due to allowed public use of the property that wi11 be permanently
protected by a conservation easement.
5. The Applicant shall pay all fees and escrows.

We are asking for a variance on a ten acre parcel;
1. We do not meet the buiiding limit for 10 acres—fiave 10 buildings,2 corn cribs and a
bunk feeder plus the hause and garage.
2. 7wo of the buildings are hip roof barns that are hand hewn and wood pegged which
makes them his#arical. Removing the pole buildings wouid destroy the rural
characteristic of the farm.
