3. Staff Report - Wyldwood Acres Development AgreementTo: City Council From: Tim Kieffer, Director of Public Works Date: August 6, 2014 Staff Report kpo SCANDIA Re: Wyldewood Acres Development Agreement Background: The roads within Wyldewood Acres are scheduled to be seal coated this year. Staff noticed a damaged sewer gate valve while preparing the roads before seal coating occurs. The Development Agreement between the Association and City states the sewer system is privately owned. Staff contacted the Association about repairing the valve. The Association's viewpoint is that the valve is the City's responsibility because it is in the roadway. Staff is suggesting that the valve is part of the private sewer system. There would be no valve if there was no sewer system. The Association was in the process of obtaining quotes but requested to come before the Council first. City staff had to repair the valve due to the seal coat timeline being moved up. The repair included removing bituminous material and replacing the top section of the valve and cap. Proposal: Staff is proposing to charge Wyldewood Acres for services rendered. Fiscal Impact: The total cost of time and materials is $1,472.97. Options: 1) Charge Wyldewood Acres for services rendered. 2) Do not charge Wyldewood Acres for the valve repair. 3) Other options.
