Recycling Agreement Meeting Date: 2/16/2010 Agenda Item: �, b� �� City Council Agenda Report City of Scandia 14727 209th St. North Scandia, MN 55073 (651) 433-2274 Action Requested: 1) Hear a brief report from SRC, Inc. on the recycling program, and 2) approve an extension of the recycling agreement with SRC Incorporated to December 31, 2010. Deadline/Timeline: The current agreement expired on December 31, 2009. Background: • Rick Prahl, SRC Inc., will be present at the February 16 meeting to update the Council on the recycling program. • In March of 2001 New Scandia Township entered into a contract for collecting and disposing of recyclable materials. The agreement has been extended several times. • SRC is willing to extend the agreement at the same contract price that has been in effect since 2001-- $2,320.50 per month. • The contract is within the amount budgeted for 2010. Grant revenue from Washington County helps offset a portion of this expense. Recommendation: Staffrecommends that the Council hear the presentation, and then approve extending the agreement. IZ�CYCL"ING AGR�EMENT THIS AGREEMENT made this 15` day of March, 2001 by and betvveen NEW SCAArDIA TOWNSHIP, Scandia, Minnesota(Town) and SRC INCORPORATED, 6320 East Viking Boulevard, Wyomin�, MN 55092 (Contractor). WHEREAS, the Town believes it to be necessary and advisable ta promote the collection for reuse and recycling of beverage containers, glass, plastic, paper, metal and any and all other materials suitable far reuse or recycling; and WHEREAS, the Contractor is in the business of collecting and disposing of recyclable materials; and WHEREAS, the Town receives funds from Washington County for recycling services and public education related to recycling;and WHEItEAS, the Tow•n desires to contract with the Contrac:tor for the purpose of collecting and disposing of recyclable materials; NOW, THEREFORE, in consideration of the mutual promises and covenants contained l�erein, it is mutually agreed as follows: 1. Contractor shall provide a curb side pick up service of recyclable materials a minimum of two days each month. Contractor shall provide all labor and equipment required for the receipt and disposal of recyclable materials. 2. The Town shall pay to Contractor, as and for services rendered by it, the sum of$2040.00 per month commencing Tanuary 1, 2001 and $2320.50 per month comniencing Mazch 1, 2001. This Ageement shall l�e renewed by muhial agreement entered into 30 days prior to the end of eacli agreement year. 3. Contractor shall at all times during ihe tern� of this Agreement keep in force the following insurance: t . � (a) General liability insurance for bodily injury or property damage to any one person for injuries or damages arisinb from any one incident in an amount of not less than$1,000,000.00. (b) ��Vorker's Compensation for ali employees employed by Contractor in fulfilling its obligations under this Agreemenc. (c) Motor vehicle liability insurance on any and all vehicles used in connection with this agreement with limits of not less than $1,OOO,U00.00. A certificate of insurance evidencing this insurance coverage must be provided to the Town before the effective date of this Agreement. 4. All recyclable materials received by Contractor shall become the property of Contractor and Contractor shall dispose of same in accord witl� a11 govemment regulations and shall not permit the recyclable materials to become a nuisance to the Town. 5. Contractor shall prepare and submit semi-annual recycling reports to the Town. The report covering the period January 1 to June 3U in each yeai shall be due by July 1 S and the report covering the period from July 1 to December 31 in each year shall be due by January 15 of the following year. 6. Contractor shall defend, indemnify and hold hannless the Tovvn and Washington County and their officers, employees and agents against any and all liability, loss, cost, damages and expenses which the Town and Washington County and their officers, employees and agents may hereafter sustain, incur or be required to pay arising out of the Contractor's performance or failure to adequately perform its obligalions pursuant to this Agreement. 7. Nothing contained in this Agreement is intended or should be construed as creating the relationship of co-partners or joint venture witli tlie To��vn. No tenure or any rights of benefits, including worker's compensation, unemployrnent insurance, medical care, sicic leave, vacation leave, severance pay, PERA or other benefits available to Town employees shall accrue to Contractor or employees of the Contractor performing services under this Agreement. � 8. During the performance of this Agreement, Contractor sliall not, on the �nounds of race, color, religion, age, sex, disability, marital status, public assistance status, criminal record, creed or national origin, exclude any person from full employment rights in, participation in, be denied the 2 benefits of, or be otherwise subjected to discriinination under any and all applicable federal and state laws against discrimination. 9. It is understood and agreed fihat the entire Agreemeiit between the parties is contained herein and that this Agreement supersedes all oral agreements and negotiations between the parties relating to the subject matter. All items referred to in this Agreement are incorporated or attached and are deemed to be part of this Agreement. Any material alterations, variations, modifications, or �vaivers or provisions of this Agreement shall be valid only when they have been reduced to writing as an antendment and signed by the parties. The tenn of this Agreement shall be January 1, 2001 to December 31, 20Q1. IN WITNESS WHEREOF, the parties have hereunto set their hands this day of March,2001.
