5.b) Scandia Marine Lions, Gambling Premises Permit for Scandia Community Center Meeting Date: 4/6/2010 Agenda Item: ��� City Council Agenda Report City of Scandia 14727 209`h St. North Scandia, MN 55073 (651) 433-2274 Action Requested: Approve a Lawful Gambling Premises Permit for the Scandia Marine Lions Club at the Scandia Community Center(Resolution No. 04-06- 10-01) Deadline/ Timeline: N/A Background: • Ordinance No. 100, adopted on March 6, 2007 governs lawful gambling within the city. The ordinance establishes the qualifications that must be met by organizations and premises for gambling. The organizations is required to spend 75%of its lawful purpose expenditures within the City's trade area, which is defined as Scandia and contiguous municipalities, and any additional area within ISD No.831. • The Lions Club currently has a premises permit to conduct lawful gambling at Meister's Bar and Grill. They have submitted monthly reports that document that their lawful purpose expenditures meet the ordinance requirements. • The Lions have applied for a premises permit for the Community Center so that they may hold the drawings for their monthly cash raffle as part of their regular meetings. Officials of the state Gambling Control Board recently informed the Lions that they may only draw for the raffle prizes at a location for which they hold a premises permit. • Scandia's Ordinance provides that gambling may be conducted only in the licensed organization's hall where it has its regular meetings, or in a licensed on-sale liquor, wine and beer establishment. The Lions qualify for a premises permit for the Community Center because it is their regular meeting place. The ordinance further provides that an organization may conduct lawful gambling only on premises it owns or leases, except as authorized by law. The state does not require that they have a lease to hold a raffle. • It is possible that in the future the Lions may wish to conduct other types of gambling at the Community Center. If that were proposed, the Lions would be required to enter into a lease Page 1 of 2 03/31/10 agreement with the City for use of the Community Center for other types of gambling. • Once approved, a premises permit runs concurrently with the organization's gambling license on a perpetual basis, unless the permit is suspended or revoked by the Gambling Control Board or is voluntarily terminated by the organization.
