9.b Liquor License application for new business at 21050 Ozark Ave. Staff Report Date of Meeting: May 15, 2018 To: City Council From: Brenda Eklund, Deputy Clerk Re: Liquor License Application for Brookside Pizza & Hoagies Background: The former Chikos Bar & Grill is being sold to new owner Matthew Miller. He has applied for an On-Sale Intoxicating Liquor License and Sunday On-Sale Intoxicating Liquor License, both of which the prior business also operated under. Issue: Should the City approve a liquor license for Brookside Pizza & Hoagies to new owner Matthew Miller? Proposal Details: Ordinance No. 93 regulates liquor licensing in the City of Scandia. The Council in its sound discretion may either grant or deny the application for any license or for the transfer or renewal of any license. A complete liquor license application including proof of insurance has been submitted and the required (pro-rated) license and investigation fees. The application states that the business will operate as a full-service pizza parlor and bar. Operating hours will be Monday – Friday from 2:30 p.m. to 11:00 p.m. (or up to midnight depending on customer activity) and Saturday- Sunday from 11:00 a.m. to midnight. He plans to open for business on July 9, 2018. The Washington County Sheriff’s office conducted a background investigation of the applicant on behalf of the city. The investigation found no negative informati on or criminal arrests that would disqualify the applicant from holding a liquor license. The investigation reviewed calls or complaints at the other business Mr. Miller owns (Brookside Bar & Grill in Marine) and found no incidents that took place the wou ld prevent approval of a new liquor license for the business in Scandia. Mr. Miller will be in attendance at the Council meeting. Options: Opportunity must be given to any person to be heard for or against the granting of the license. The Council has discretion to either grant or deny the application. If the Council determines that the license should be issued, the term will expire on December 31, 201 8. 1) Approve an On-Sale Intoxicating Liquor License and Sunday On-Sale Intoxicating Liquor License to Matthew Miller for operating Brookside Pizza & Hoagies at 21050 Ozark Avenue North. 2) Do not approve an On-Sale Intoxicating Liquor License and Sunday On-Sale Intoxicating Liquor License to Matthew Miller. Recommendation: Option 1.
