b.l Purpose and Scope
Open Space Conservation Subdrvisions(05CS)tue estaUlished to encom-age developme�rt af rural
housing clusters.All major suhdivisions where bonus lots are requested shall be Open Space
Conservation Subdivisions(OSCS),providing for the maximam protcction of agriculh�ral lands,
ecologically significazii tueas,nxtural landscapes,scenic athibutes,open space,and cuitural features.
QSCS must meet the fallo��ing purposes:

(1) Provide efficient use of the land�vhile maintaining contiguous blocks of economicaUy viable
agricultural lr�nd,mature Fvoodlands,and open space,and preserving historical Icatures,scenic

(2') Allow housing to be concentratcd on sites that have low�agricultural potential and/or high
natural housing appeal.

deveJopment.
(5) To provide commonly owncd open space areas for passive and/or active recreational use by
residents of the development and,�vhere specified,the larger community.
{6) To provide for a diversity of lot sizes,housing choices and building densities lo accommodate
a variety of age and income groups.
(7) To preserve scenic views and elements of ilie Tow�iship's rural character by minimizing views
oF ncw development from existing roads.
(8) Since an Open Space Conservation Subdivision reyuires ceriain unique characleristics and
features,not every parcel of available land is suitable for such devclopment.Size,location,
topogaphy,natural features and resources,etc.are unique tu each potential OSCS so that
development approval depends in part on the evaluation of suitable characteristics.Further,
due to such uniqueness,approval of an open space conservation subdivision cannot be inferred
as approval for other parcels.
(9) F.conomic conditions,i.e.potential devclopment profit,shall not constitute a hardship or
reasonable criteria for approval of an open space conservation subdivision if other mcthods for
subdivision of the property eacist under the terms of the llevelopment Code.
62 Dcfinitions
(1) Community Garden:Land which is cultivated by the residents of the development for the
production of h�ees,vegetables,fruits,flowers,hcrbs and grasses for the residents'use or to be
sold directly to consumers ttuough membership in the gardcn.
(2) Conservation Easement:An interest in rcal property created in a maruier that imposcs
limitations or affirniative obligations in regard to the use of property including the retention,
pi•otection and maintenance of natural resources,open space and agriculturc.
(3) Cultural Resource:The historic and archeological characteristics of the land,including
buildings end la�idscapes,which provide information regarding the history ofNew Scandia
Townslup and its peoplc.

(A) I]istoric Building and Structure:A struc[ure which has been identified by the Washington
County History Network Inventory or the State Historic Preservation Uffice and other
undesignated sirtictures such as residences and barns having public value due ro their notable
architectural or historic features relating to the cultural heritage of the County and thc Cily.
(5) Homeowners Association:A formally constituted non-profit association or cc�rporatiou made
up of the property owners and/or residents of the development for the purpose of owning,
operating and maintaining the common open space and facilities.
(G) Neighborhood:An area contanung a contiguous group o£residential lots where people live in
close proximity to one another.
� (7) Opcn Space:Land used for agrieulture,natura]habitat peclestriau corridors and/or rccreational
! pu�poses,that is undivided and pern�anently protected from future development.
I (8) Opcn Space Conservxtion S�bdivision�A grouping of residential structures on smaller lots
than allowed in the specific zoning district,leaving some land dedic�ted as open space.Major
subdivisions whcre bonus lots are allowed proviciing for the maximUm possible protection of
ecotogically significazrt a�•eas,naturnl landscapes,scenic ariributes,open space,and cultural
features.
(9) Yerimeter Road:A road tying outsidc of and abutting the development parCel.
(10) Plant Community:A grouping of plants with common environmental requirements living
within tl�e landscape,i.e.,wedands,grasslands,boreal forests.
(11) Protective or Restrictive Covenant: A contract entered into beh�cen private pariics that
constitutes a restriction of dic use of a particular parcel of property.
(12) Rcsource Inventory:A survey of the laiid's features including it's natural resources,cultural
resources,scenic vicws and viewsheds,and physical chazacieristies.
I 6.3 Applicabilitv
{1) '1'he OSCS standards ere an alternative set of standards for residential development within the

districts.OSCS shall be pennitted with a condition�l use pennit within these districts.Tlie

Shoreland Overlay Uistricts.
(2) The regulations of this Development Code are applicable oiily to OSCS approved aftei the _
effcctive date of this Development Code.
6.4 Avnlication
(1) A Conditional Use Permit is required for an open space conservation subdivision in the

(2) A Conditional Use Pcrmit application shall bc filed,in writing,with the Zoning Administrator
iu accordance with Chapter One,Scction 7,Conditional Uses.
(3) In addition to the criteria stated in Chapter Oue,Section 73,thc Planning Commission shall
consider the following:
(A) "Che OSCS is designed to preserve open space a�id the"fownship's rurai character
while creating compact residential ncighborhoods.
(B) "I'he OSCS is designed in accordance�vith ti�e standards of this Development Code.
(C) OSCS support the goals and policies ofthe Township's Comprehensive Plan.
I (A) In addition to those submittal requircments stated in Cl�aptcr One,Sect-ic��the following items
shali be submilted as part ofthe Conditional Use Pcrmit application for open spaee
conscrvation suhdivision:
(A) Resource Inventory
1. I'hc plan for an Open Space Conservation Subdivision shall includc a resource
im�entory,to include the following,mapped at a scale of no less than one inch: 100
fect.
I 2. Topographic contours at-I-92-foot intervals,showing rock outcrops and siopes of
more than 15 percent.
3. Soil type locations and ident�cation of soil type characteristics such as
agricultural capability,depth to bedrock,and suitability for wastewater disposal
Systems.
, 4. Hydrologic characteristics,including surface water bodies,floodplains,wetlands,
natural swales and drainageways.
5. Vegetation of the site,according to gcnerel covcr type(pasture,woodla��d,etc.),
defining boundaries of woodland areas and stand-alone trees�vith a caliper of more
than 1 S inches.Vegetative types shall be classitied as generally deciduous,
coniferous or mixed and described by plant communit��,relative age and condition.
G. Current land use and land cover(cultivated areas,pavcd areas,etc.),all buildings
and structures on the land,and all encumbrances,svch as easements or covenants.
7. Visual resources,showing views onto the tract from surrounding roads and public
areas,as well as views within the tract.
8. Cultural resources:brief descripiian of historic charactcr of buildings and
structures,historically important landscapes,and archeological features.

9. Context:general outlines of existing buildings,land use,and natural features such
as water bodics or wooded areas,roads a�id propc:rty boundaries within 500 feet of

(B) Yield Plan
1. Tlie appl icant shall submit a"yicld plan,"sUowing fhe maximum number of
dwelling units that would be permitted given the minimum lot sizc and lot widths
for convenlional subdivisions and otl�er requirements of thc Development Code
and Subdivision Regulations.7'he y�eld plan need not bc engineered;however,it
shall be drawn to scale and it shall identify all the major physical features on tlie
parcel.

(C) Concept 5ubdivision Plan.The applica�it shall submit one or more open space
conservation subdivision plans meeting the intent of this Chapter and including at least
Ihe following infarmation:
1. Open space areas indicating wluch azeas are to be protected.
2. 13oundaries of areas to be developed and proposcd general street and lot layout.
3. Number and typc of housing units proposed.
4. Areas proposed for stormwater management and on-or off-site se�vage treatment.
5. Said plans shall be dratim at a scale of 1 inch= 100 feet.
(D) Phasing Ylan.Open Space Caiservation Subdivisions may be phased in accordance
with a unified development plan for the entire tract meeting d�e following
requirements:
1. A phasing pian identifying the sequence of development sliowing approximate
areas,serially numbered with a description of cach phasc.Information shall be
provided regarding the number of d�velling units,proposed improvemcnts,and
common facilities far each.
2. The phasing plan shall be mac3e a part of'the conditional use permit and is effective
for five(5)years from the date oCpreliminary plat approval.If final plat approval
is not received within five(5)years,ihe permit shall become null and void.
3. Any common facilities,including golf cowses,shall be constructed prior to the
salc of any lots and shall be dearly markcd on a site map which shal(be an
attachmcnt to all sales agreements for individua]lots.

4. As part of tlie dcvelopment agreement,a fina�icial guarantee to ensure co�npletion
of common facilitics,trails and landscaping shall be provided.

(l) The designated open space and common facilities may be owned and mtuiaged by one or a
combination of the following:
(A) Nomeowners'Associatian
(B) Non-profit Organizatio3i
(C) Tlie County or another governmental body empowereci to hold interest in real p3•operty

6.7 Open S ace
(1) The minimum open spac�required per Section I2.10(4)(A)shali 0e subjeci to a pernianent
conservation easement and used for the purposes a�defined by this Development Code.The
conseiwation eascnient sfiail be dedicated to the Township,an acceptable land trustee or otl�er
similar organizaiion as approved by the Township.

6.8 Homeowncrs'Associations
{1) A Ilomeo�;�ners'Association shall be established if the open space is owned by a homcowner's
association.Membership in ihe Association is mandatory for al1 purchasers of homes in the
development and their successors.
{2) A Home��mers'As.�ciation Agreement,guaranteeing continuing maintenance,shali be
submitted to the Towns}up as part of the data requircd for the conditional use permit.The
Homeowners'Association documcnts or the declaration of covenanis,condiiions a��d
rest�•ictions shall contain the following information:
(A} the legal description of the common lands or facilities;
(A) the restrictions placecl upon the use and enjo}�nent of the Iands or facititics including
the persons or entities entitled to enforce the restrictions;
(C) a mechanism for resolving disputes among ihe owners or association members;

6.10 Performance Standards
(1) General considerations
(A) For single-family attached and multi-family structures,the mtucimum number of units
per freestanding building is six.
(B) Thc residentia]lot shall bc large enough to accommodate a house and two-car garage.
(C) All structures shall be setback a minimum of 75 feet from unclassified waterbodies.

(A) Neighborhoods shall be located to minimize their impacts on the natural,scenic and

(B) Neighborhoods shaii avoid encroaching on rare plairt communities or endangercd

for Nahiral Communities and Raze Species.
(C) Fragmentation of opcn space shall be minimiutd

lands on adjoining parcels.
(E) Neighb.orhoods should be sited to achieve Ihe following guals,to the extcnt
practicable.In cases where impact on one or more of thc follo�ving resource azeas is
unavoidable,the impact should be minimi�ed through use of landzcaping,topography,
or other features.
1. Avoid prunc farmland soils and large tracts of land iu agricultural use,and avoid
interference with normal agricultural practices;
2. Minimize disturbance to woodlands,hcdgerows,mxturc trees or other significant
vegetation;
3. Protect scenic views of open land fmm adjacent roads.
4. Protect existing historic buildings or vicorporate them through adaptive reuse.
(F) The maximum�urvber of residential lots permitted in a neighburhood is 50.
(G) More lhan one(1)ncighborhood may be developed if separated by a clear boundary
comprised of a combination of two or more of the following elements�street pattern,
marked topographical changes,drainageways,ponds,wetlands,strcams,geenways
and woodlands.

(A) Water far an OSCS Development shall bc pro�ided by individual on-site wells or by
one or more community wclls meeting the permit requirements of the Minnesola
Department of Iiealth.The use of shared or community��rells is encouraged.
(B) All OSCS Developments shall be provided wiih adequate sewage treatmcnt facilities

' Standards Regulations and the permit requircments of the Minnesota Pollution Control
Agency.
(C) Utilities wiil be placed underground;either parnllel to the sidewalk or under the street.

that:
1. Ground cover oFregularly mowed turf or meadows is maintained;
2. No agricultw�al activities are permitted within 50 feet of the drainficld area;
3. No hails or other recreational facilifies are located in drai�eld areas.

(7) GolfCourses
(A) Go1 f cow ses locatecl in thc open space must compiy with Chapter T���o,Section 10.11
of this Chapter.
(B) The golf course shall be regulatcd by a development agrcement that restricts any
further development or subdivision of land and requires the land to be retaincd as opcn
space use if a golf course is iio longer used as a golf course.
(C) The golf course shall be constructcd prior to the sale of any residential lots.
(D) A financial guarantee ensuring completion of the golf course in acwrdance�vith the
approved plans and permits shatl bc submitted to the"Loning Administrator.
