Re: Development Code Update
We are pleased to provide you with a complete draft of Chapters 1 and 2 of the Development Code
with your materials for the July 27 meeting. While there are still many items for discussion,we
believe that it will be helpful to have the definitions and procedural requirements contained in Chapter
l at the same time you are reviewing the develop�nent standards in Chapter 2.
We recormnend that you first focus discussion on Section 3 of Chapter 2 (Develop�nent Standards)
be��inning on page 2-30. These are the sections that have not been reviewed at a previous work
session. What cannot be completed at the July 27 meeting should be discussed at the August 3
meeting. Once we are satisfied with Section 3, an overall review of Chapters 1 and 2 would be the
next step.
Chapters 1 and 2, with the zoning map,together constitute a complete zoning ordinance for the city.
Chapter 3 (the Subdivision Regulations)may be adopted as a separate ordinance at a later date. We
suggest that the Council and Planning Commission discuss the timing of the formal process for
adopting the first two chapters. One option would be to hold an informational public�neeting to
present the ordinance and get public input(perllaps soinetime in September)prior to holding the
formal public hearing(possibly at the October 5 regular Planning Commission ineeting.)
While preparing the draft,we found it impractical to provide a"redlined"copy of the existing
ordinance language showing the changes as the text became very confusing. Therefore, we've
provided the attached list of"highlights"and notes about the Development Standards that should help
everyone understand the key differences between the draf�and the current ordinance(now numbered
as Section 9 of Chapter 2,if you wish to compare t11e two.)
Please retain these materials for the August 3 meeting, as a new draft will not be�nailed prior to that
meeting. We'll supply you with a binder to make this docu�nent easier to use at tlie July 27 ineeting.

2-32/3.2 Accessory Structures • This section has been reformatted to make it easier to read,including

2-34/ Environmental • The sections on Hazardous Materials, Explosives,Radiation and
33 Regulations Electrical Interference and Hazardous Waste have not changed.
• The section on Refuse(page 2-36, Section 33(4)(D))has been edited

2-36/ Exterior Storage • This section has been rewritten to capture direction given at the last
3.4 work session. It will be important to review this language with the
new defmitions for recreation equipment,recreation facilities and
recreational velucles(see Chapter 1,page 1-24.)
• This section now references the parking section,where the mm�ber and
types of vehicles allowed may be found(see pages 2�8&2-49.)
• New language on exterior storage of shipping containers has been
added. A definition was also added to Chapter 1 (see page 1-27.)
2-37/ Fences • The most si�,mificant change is requiring compliance with the Scandia
3.5 Architectural Design Guidelines,as applicable.
2.38/ Land Alteration and • Major revisions have been made to the current Land Alteration and
3.6 Grading Grading section(Section 9.6 of Chapter 2)which included some
and general stonnwater manage�nent and tlle land alteration/�,nading
3-42/ Stonnwater requirements. Two sections have been created for the code update to
3.7 Management make the standards and procedures for each item clearer.
• Section 3.6 requires an Administrative Pernut for land alteration and
gading activities. It includes a fee and escrow to cover the costs of
City inspections,and details the inspection and enforcement
procedures.
• Section 3.6 includes some basic general standards(item E),and
requires that applicants at a minimwn meet the MPCA's standards for

Erosion and Sediment Control. The MPCA provides detailed
standards and design guidelines for erosion and sediinent control
measures that are updated frequently,and do not need to be detailed in
the ordinance. Ciry staff can use the MPCA manuals to provide
infonnation to applicants and to review erosion and sediment control
plans.
• Section 3.7 has been updated to address the goals in the City's Local
Surface Water Management Plan(included in the Comprehensive
Plan). The design options in item D address several goals in the
Surface Water Plan. This section also references the MPCA's surface
water guidance manuals,which provide extensive detail on the design
and implementation of Best Management Practices for stormwater
management.
• Sectio�13.7 notes that local Watershed Districts or Watershed
Management Organizations have pernZitting authority in much of the
City,and references their standards for water quality and quantity
management. Since their standards may change more frequently than
the City's development code,and differ among the districts,the
specific standards are not included in this Section.
• Definitions have been moved into Chapter 1.
2-44/ Land Clearing • Current code language has been retained.

• The list of prohibited types of lighting has been expanded to be
consistent with the Desi�l Guidelines.
2-48/ Parking • This section has been significantly reorganized,with the addition of
3.10 tables and diagrams.
• The table showing the minimum number of parking spaces has been
updated to delete uses not provided for in the ordinance. Parking
standards located elsewhere in the code have been moved into this
section.
• The current ordinance lacks many design specifications for parking
lots,which have been added.A requirement for adequate off-street
loading areas was also added.
• Language requiring compliance with the Scandia Architectwal
Design Guidelines,as applicable,has been added(3.10(1)(B).)
2-54/ Woodland and Tree • Definitions have been inoved into Cllapter 1 (see page 1-30.)
3.11 Preservation • Under item(6)(C)Species Requirement,an addition to#3 has been

• Black,Green and White Ash species have been removed from the
recommended plant materials list(item(G),page 2-61),as all of these
species are killed by the Emerald Ash Borer. American Mountain Ash
does not need to be removed from the list as it is in the genus Sorbus,
not a true ash in the Fraxinus genus. No required tree may be an ash
tree. We have also removed the ash species from the definition of
"primary deciduous tree"(see page 1-31),which means that healthy
ash trees would not require replacement. We should discuss this
change.
• Language requiring compliance with the Scandia Architectural Design
Guidelines,as applicable,has been added(3.12(4)(A).)
• The screening section(item(5)on page 2-62)is substantially the same
as current language. We should discuss item(A)4. It may not be
