APPROVING MINOR SUBDNISION OF 78.9 ACRES INTO THREE LOTS, LOCATED
AT 11522 MAYBERRY TRAIL NORTH
WHEREAS, Daniel and Judith Booren have made application for a Minor Subdivision
to allow creation of Parcel A of 3.956 acres, Parcel B of 2.561 acres, and Parcel C of 72.404
acres, located at ] 1522 Mayberry Trail North, City of Scandia; and
WHEREAS, the property is legally described as follows:
The south half of the northwest yuarter, the south half of the north half of the northwest
quarter and part of Government Lot 3, all in Section 20, Township 32 North, Range 20
West, City of Scandia, Washington County, Minnesota; and
WHEREAS, the Planning Commission reviewed the request at a duly noticed Public
Hearing on October 5, 2010, and has recommended approval; and
NOW,THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL
OF THE CITY OF SCANDIA, WASHINGTON COUNTY, MINNESOTA, that it should
and hereby does approve the minor subdivision.
FURTHER BE IT RESOLVED, that the following conditions of approval shall be met:
l. The minor subdivision shall be in substantial compliance the Certificate of Survey dated
September l 5, 2010.
2. Wastewater treatment systems shall be approved by Washington County Department of
Health and Environment.
3. To comply with the Carnelian Marine on St. Croix Watershed District permit 10-005, the
existing low floor elevation notes must be removed from the survey and the following
note added to the survey: "Lowest grade (ground) elevation in contact with structure shall

be at least elevation 987.4 ft. The lowest basement elevation shall be at least 4 ft above
the observed current goundwater elevation."
4. Drainage and utility easements shall be dedicated to the City as shown on the survey. In

feet in width centered on the side lot line and 10 feet in width along the front lot lines.
5. The Applicant shall pay the park fee of$3,000.
6. The Applicant shall pay all fees and escrows.

BRIEF DESCRIPTION OF THE REQUEST:
The Applicants request a minor subdivision to split one parcel into three parcels. The parcel is approximately
78.9 acres. The lot averaging method of subdivision is proposed to create Parcel A of 3.956 acres, Parcel B
of 2.561 acres, and Parcel C of 72.404 acres. There is one existing dwelling on the property, located on
proposed Parcel C.
The property is in the Agriculture District. The eastern portion of the property, part of proposed Parcel C, is
also within the Shoreland Management Overlay District for Big Marine Lake. Parcels A and B are outside of
the Shoreland District.
DETAILED EVALUATION OF THE REQUEST:
Comprehensive Plan
The subject property is designated Agricultural Core on the Future Land Use map. The plan encourages lot
averaging to create a variety of lot sizes between 2 and 5 acres, or 20 acres or greater, to support continuation
of agricultural land uses.

The Planned Connections for Discontinuous Streets map within the Comprehensive Plan shows no planned
street connections that would affect the property. The Comprehensive Plan's Park and Recreation Search
Areas map shows that the subject property is not within a Park Search Area.
Density
The maximum density for conventional and lot averaging subdivision in the AG District is 4 units per 40
acres. The subject property is 78.9 acres and therefore may yield 8 density units. The proposed subdivision to
create three lots meets the densitv standard of the AG District.
Lot Size and Frontage
New lots in the AG District must be 2 to 4 acres in size, or 20 acres or geater in size. Minimum frontage on
a public street is required as follows: lots 2 to 3 acres must have a frontage of 160 feet, lots 3 to 4 acres must
have 240 feet, and larger lots must have 300 feet.
Parcel A of 3.956 acres has a frontage of 242 feet, Parcel B of 2.561 acres has a frontage of 190 feet, and
Parcel C of 72.404 acres has frontage in excess of 1,000 feet. The proposed parcels meet the lot size and
fronta�quirements.
Wetlands
There are wetlands on the eastern edge of Parcel C. The wetlands were delineated and reviewed by the
Washington Conservation District in 2008. A drainage easement over the wetlands is included in the survey.
There are no building plans or development proposed in this area as part of the minor subdivision request.
There is a drainage easement shown on Parcel A. The Washington Conservation District has reviewed this
area and determined it does not constitute a wetland. The proposed minor subdivision complies with
applicable wetland rules.
Setbacks
The required setbacks are front yard of 40 feet, side yard of 20 feet, and rear yard of 50 feet. Mayberry Trail
is classified as a Collector roadway and therefore a setback of 100 feet from the centerline also applies. The
bluff setbacks and wetland setbacks of the Shoreland Management District are applicable in the eastern
portion of Parcel C; however, there are no existing or proposed structures in the area. The proposed parcels
meet the minimum setback recLuirements.
Buildable Area
A minimum of 1.0 acre of buildable area is required for each parcel. The survey reports a buildable area of
l.47 acres for Parcel A and l.53 acres for Parcel B (Parcel C also has greater than 1 acre of buildable area).
The rec�uest meets the buildable area requirement.
Wastewater T��eatment
Soil borings were taken on Parcels A and B and provided to Washington County. Wastewater treatment
systems must be approved bv Washin€;ton Countv Department of Health and Environment.

Stormwater Management
The property is within the Carnelian Marine on St. Croix Watershed District. The District issued a permit for
the property on August 12, 2010. Condition 4 of the permit provides that the notes on the survey must be
revised as follows:
Remove existing low floor elevation notes and add the following note: "Lowest grade (ground)
elevation in contact with structure shall be at least elevation 987.4 ft. The lowest basement elevation
shall be at least 4 ft above the observed current groundwater elevation."
Access
Two new driveway access points, one each for Parcels A and B, are proposed on Mayberry Trail. The
driveway for Parcel A is placed on the east side of the parcel, maximizing the distance between the curve of
Mayberry and the driveway. The driveways are spaced approximately 170 feet apart. The proposed
drivewavs are in appropriate locations, given the location of the Ma ��v Trail curve.
Easements
The survey shows an easement for Mayberry Trail. Proposed drainage easements around wetland areas are
shown on the survey to be dedicated to the City. A utility easement should also be provided, 20 feet in width
centered on the side lot lines and 10 feet in width alon�the front lot line.
Park Dedication
Park dedication requirements must be met for two lots. The City has the option to obtain park land or collect
the fee in lieu of land ($1,500 per lot). The property is not within a Park Search Area per the Comprehensive
Plan so the City mav wish to collect the park fee of$3,000 in lieu of land.
ACTION REQUESTED:
The Planning Commission can recommend/City Council can act ta:
1. Approve the request.
2. Approve the request with conditions.
3. Deny the request with findings.
4. Table the request.
PLANNING STAFF RECOMMENDATIONS:
The Planner recommends approval of the minor subdivision located at 11522 Mayberry Trail North to create
three parcels consisting of Parcel A of 3.956 acres, Parcel B of 2.561 acres, and Parcel C of 72.404 acres,
with the following conditions:
1. The minor subdivision shall be in substantial compliance the Certificate of Survey dated September
15, 2010.
