Action Requested: Approve the application of Daniel and Judith Booren for a Minor
Subdivision of property located at 11522 Mayberry Trail N., as
recommended by the Planning Commission.
Deadline/Timeline: 60-day review period expires November 14, 2010
Background: • The applicants request a minor subdivision,using lot averaging, to
split one 78.9-acre parcel into three parcels; Parcel A of 3.956
acres, Parcel B of 2.561 acres, and Parcel C of 72.404 acres.
There is one existing dwelling on the property, located on
proposed Parcel C.
• The Planning Commission held a public hearing on the proposal at
its October, 4,2010 meeting and recommended approval with the
conditions recommended by the Planner, with a couple of
additions. A condition indicating the remaining development
potential of Parcel C was added, and the condition regarding
dedication of easements was modified to add the roadway
easement for Mayberry Trail.
� The City Council postponed action on the resolution so that the
recommended changes could be made, and so that an error in the
legal description discovered by the City Attorney could be
corrected.
• Changes to the resolution since the October 4 meeting are shown
on the redlined version of the resolution, attached.
Recommendation: Staff recommends that the Council adopt the resolution approving the
minor subdivision.

WHEREAS,Daniel and Judith Booren have made application for a Minor Subdivision
to allow creation of Parcel A of 3.956 acres, Parcel B of 2.561 acres, and Parcel C of 72.404
acres, located at 11522 Mayberry Trail North, City of Scandia; and
WHEREAS, the property is legally described as follows:

FURTHER BE IT RESOLVED,that the following conditions of approval shall be met:
1_The minor subdivision shall be in substantial compliance the Certificate of Survey dated
September 15, 2010.
�-2. After recording of this minor subdivision, Parcel C may be further subdivided to
create a maximum of six lots,unless there are subsequent amendments to the Citv's

Comprehensive Plan and Development Code that would allow a greater or lesser density
than the 1 unit per 10 acre density that applies as of the date of this resolution.
�3. Wastewater treatment systems shall be approved by Washington County
Department of Health and Environment.
I �4. To comply with the Carnelian Marine on St. Croix Watershed District permit 10-
005, the existing low floor elevation notes must be removed from the survey and the
following note added to the survey: "Lowest grade (ground)elevation in contact with
structure shall be at least elevation 987.4 ft. The lowest basement elevation shall be at
least 4 ft above the observed current groundwater elevation."
� 45. Drainage and utility easements and the roadway easement for Mayberry Trail shall
be dedicated to the City as shown on the survey. In addition,utility easements shall be
dedicated along side lot lines and front lot lines, 20 feet in width centered on the side lot
line and 10 feet in width along the front lot lines.
�:6. The Applicant shall pay the park fee of$3,000.
�7. The Applicant shall pay all fees and escrows.
