6.a) Res 09-16-14-02 Vacating 2nd StreetCITY OF SCANDIA RESOLUTION NO. 09-16-14-02 RESOLUTION FOR VACATING 2ND STREET BETWEEN COLUMBUS STREET AND BLUFF STREET WHEREAS, a petition signed by the majority of property owners abutting 2nd Street in the Revision of Vasa Plat, City of Scadnia was received by the City Clerk on the 7th day of August, 2014; and WHEREAS, the petition requested that the City Council pursuant to Minnesota Statute §412.851 vacate 2nd Street between Columbus Street and Bluff Street; and WHEREAS, the City Clerk reviewed and examined the signatures on said petition and determined that such signatures constituted a majority of the landowners abutting upon the street to be vacated; and WHEREAS, a public hearing was held on the 16d' day of September, 2014 at 7:00 p.m. in the Scandia Community Center Board Room, 14727 2091 Street, Scandia, MN, after due published and posted notice had been given by the clerk, and a reasonable attempt was made to give personal notice to all affected property owners, and all persons interested were given an opportunity to be heard; and WHEREAS, any person, corporation or city owning or controlling easements contained upon the property vacated, reserves the right to continue maintaining the same or to enter upon such way or portion of vacation to maintain, repair, replace, remove or otherwise attend thereto; and WHEREAS, it appears that it will be in the best interest of the city to vacate such streets; and NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Scandia, Washington County, Minnesota, that 2nd Street between Columbus Street and Bluff Street and as shown on Exhibit A is hereby vacated. Resolution 09-16-14-02 Page 2 of 3 BE IT FURTHER RESOLVED, that the Mayor and City Clerk are hereby authorized to sign all documents necessary to effectuate the intent of this resolution.
