7.b)1) Res 10-21-14-02 Ruddy Minor SubdivisionCITY OF SCANDIA, MINNESOTA RESOLUTION NO. 10-21-14-02 APPROVING A MINOR SUBDIVISION FOR 21020 MEADOWBROOK AVENUE NORTH WHEREAS, Mary Kay Ruddy has made an application for a Minor Subdivision to create two parcels, 5.00 and 31.4 acres in size, by subdividing a parcel located at 21020 Meadowbrook Avenue North; and WHEREAS, the property is legally described as follows: That part of the east 760.00 feet of the Southwest Quarter of the Southwest Quarter of Section 16, Township 32, Range 20, Washington County, Minnesota, lying northerly of the south 892.49 feet thereof and lying southerly of the centerline of Trunk Highway No. 97; and WHEREAS, the Planning Commission reviewed the request for the Minor Subdivision at a duly noticed Public Hearing on October 7, 2014, and recommended approval of the Minor Subdivision with conditions; and NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF SCANDIA, WASHINGTON COUNTY, MINNESOTA, that it should and hereby does recommend approval of a subdivision to create a new parcel 5.0 acres in size, on the property at 21020 Meadowbrook Avenue North. FURTHER BE IT RESOLVED, that the following conditions of approval shall be met: The minor subdivision shall be in substantial compliance with the Preliminary Plat received by the City on August 25, 2014. 2. The applicants shall obtain the required septic system permit from Washington County for development on the new 5 -acre lot before approval of a building permit. 3. The applicants shall obtain a building permit when construction is proposed on the new parcel. PC Resolution No.: 10-21-14-02 Page 2 of 2 4. The driveway access to the new parcel shall be from Meadowbrook Avenue North, and future development on the parcel shall maintain the existing drainage rates to MnDOT right-of-way. 5. The applicants shall obtain the required Watershed District permit. 6. The park dedication fee of $3,000 for the new parcel shall be due before the approval of the Final Plat. 7. No accessory structures shall be constructed on the new parcel before construction of a primary residential structure. 8. The applicant shall record the new parcel within one year of the date when the minor subdivision is approved. 9. The Applicant shall pay all fees and escrows associated with this application.
