Re: Liquor License Renewal for Chikos Enterprises, dba Chiko’s Bar & Grill (On-Sale/Sunday On-
Sale Intoxicating) for 2015
Background:
Ordinance No. 93, adopted on January 2, 2007, regulates liquor licensing within the City of
Scandia and provides that the City Council has discretion on whether to grant or renew any
liquor license. The Washington County Sheriff’s Department conducts compliance checks and
reviews license applications on behalf of the City. All annual licenses expire on December 31,
2014.
Issue:
Should the Council approve renewal of the On-Sale/Sunday On-Sale Intoxicating Liquor License
for Chiko’s Bar & Grill?
Proposal Details:
The business had previously been known as Mi Casita Mexican Grill, but in 2012 changed the
trade name to Chiko’s Bar & Grill. The license renewal application was submitted on November
25, 2014 along with the required certificate of liquor liability insurance and workers
compensation certificate of compliance.
There have been two compliance check failures at the business in the past five years. The first
violation occurred on December 30, 2009. After a hearing, the City Council imposed a civil
penalty of $500 and a one-day license suspension, which was served on April 26, 2010. The
business failed a second compliance check on October 15, 2010. A hearing was held on April 19,
2011 at which time the City Council imposed a civil penalty of $1,000 and a three-day license
suspension. The suspension began on April 25, 2011.
The Sheriff’s Department investigation found no other issues with the current license and has
signed off on the renewal.
Options:
1) Approve renewal of the liquor license for Chikos Enterprises, dba Chiko’s Bar & Grill
(On-Sale/Sunday On-Sale Intoxicating) for 2015.
2) Delay action on the liquor license renewal.
3) Do not approve the liquor license renewal.
Recommendation:
Option 1.
