4.b) res 04-01-14-02 ODonnell Minor Subdivision docx CITY OF SCANDIA, MINNESOTA PC RESOLUTION NO. 04-01-14-02 APPROVING A MINOR SUBDIVISION FOR 23160 LOFTON AVENUE NORTH WHEREAS, Joel Anel, Landmark Surveying, Inc., applicant, and Scott and Lisa O’Donnell, owners, have made an application for a Minor Subdivision to create two parcels, 5.00 and 25.53 acres in size, by subdividing a parcel located at 23160 Lofton Avenue North; and WHEREAS, the property is legally described as follows: The Southeast Quarter of the Southwest Quarter of Section 5, Township 32 North, Range 20 West, Washington County, Minnesota, except the North 300.00 feet of the East 840.98 feet thereof, Washington County, MN; and WHEREAS, the Planning Commission reviewed the request for the Minor Subdivision at a duly noticed Public Hearing on April 1, 2014, and recommended approval of the Minor Subdivision with conditions; and NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE PLANNING COMMISSION OF THE CITY OF SCANDIA, WASHINGTON COUNTY, MINNESOTA, that it should and hereby does recommend approval of a subdivision to create two parcels, 5.00 and 25.53 acres in size, on the property at 23160 Lofton Avenue North. FURTHER BE IT RESOLVED, that the following conditions of approval shall be met: 1. The minor subdivision shall be in substantial compliance with the Preliminary Plat received by the City on March 25, 2014. 2. The applicants shall obtain the required septic system permit from Washington County for Lot 2 before approval of a building permit. 3. The applicants shall obtain a building permit when construction is proposed on Lot 2. 4. The applicants shall obtain any required Watershed District permits. 5. The park dedication fee of $3,000 for Lot 2 shall be due before the approval of the Final Plat. PC Resolution No.: 04-01-14-02 Page 2 of 2 6. No accessory structures shall be constructed on Lot 2 before construction of a primary residential structure. 7. The applicant shall record the new parcels within one year of the date when the minor subdivision is approved. 8. The Applicant shall pay all fees and escrows associated with this application.
