Action Requested: Receive a report on staff s plans for monitoring Scandia's sand and
gavel mining operations.

Background: • The 2009 season will be the first that Scandia's sand and gravel
mines will be operating fully under the requirements of the city's
mining ordinance. The new ordinance requires that the city
closely monitor compliance with the Conditional Use Permit
(CUP) and Annual Operator's Permit(AOP) for each site.
• Staff has prepared a description of our approach to monitoring the
operations, which will be shared with the public and the mine
operators. An inspection schedule will be set with specific dates at
the start of�ach mining season, tailored to the requirements of
each permit.
• A checklist for inspections will help staff consistently document
the activity of the operations and compliance with ordinance and
permit requirements.
• Staff will compile a file or workbook on each operation, so that all
of the documentation for each operation is in one location for easy
access. When the AOP is reviewed each year, a clear record will
be available so the city can determine whether all of the City of
Scandia's requirements have been met.
Recommendations: Staff recommends that the Council receive and review the report, ask
any questions you might have, and give staff feedback on the
monitoring program.

Monitoring Program
Sand and Gravel Mining Operations

Purpose and Intent
The purpose of the monitoring program is to allow for the mining of sand and gravel in Scandia
while strictly enforcing the requirements of Chapter 4 of Scandia's Development Code, and the
Conditional Use Permit (CUP) and Annual Operator's Permit (AOP) issued to each mining
operator.
The mining operators are responsible for strict adherence to the ordinance and CUP and AOP
requirements. Strict compliance will help with the public's acceptance of the mining activities.
Operators are expected to collaborate with the residents of Scandia for the protection of
Scandia's natural resources and landscape. Operators are expected to be proactive in anticipating
effects of their actions on the surrounding neighborhood, and take all steps necessary to prevent
environmental impacts.
The City of Scandia staff is responsible for
• performing periodic inspections;
• ensuring that all testing data and reports are submitted as required by the permits;
• documenting all of the information necessary for the city to determine compliance with the
ordinance, the CUP and the AOP;
• tracking all deposits, escrows and financial guarantees; and
• bringing significant violations or failures to comply with permit requirements to the attention
of the City Council,recommending appropriate enforcement measures.
Summary of Monitoring Procedures
Site inspections will follow a checklist format, designed to create a historical record for
enforcement of the ordinance and permits. Inspection reports will be completed after each
inspection, showing the date, property address, owner name, list of items inspected, comments
and items requiring corrections. Copies will be provided to the operator.
A photo log will be created to depict major areas of concern and reclamation. Photo points shall
be located on the site map. Every effort will be made to duplicate pictures from one inspection
to the next. A GPS unit will be used to locate major areas of concern with coordinates, as well as
the approximate coordinates of photo points. The photos will be numbered to match the photo
points on the site map and a written description made to explain the intent of the photo.
A file or workbook will be created for each site, to organize all of the documentation and serve
as the historical record of the mining operation. This record will aid in the review and issuance
of the Annual Operators Permit (AOP), and used as a reference when the final restoration of the
areas is complete.

Inspection/Monitoring Items
1. Mining Progress or Sequencing: at the time of the CUP issuance the remaining mining
operations were broken down into phases:
o Detail the extent of excavation completed in the past 12 month period on the site
plan (C4), submit to City at time of Mining Progress site inspection;
o Submit a phasing plan showing modifications that have been made due to the
progress of the mining operation (C4), submit to City at time of Mining Progress
site inspection (if applicable).
2. Identify processing areas showing any additions or alterations in the existing Processing
Equipment (C4), submit to City at time of Mining Progress site inspection.
3. Screening: (site visit)
o Maintenance of existing trees,berms or natural vegetation;
o Installation of new screening due to mining progress,
o Future plantings or stockpiling requirements.
4. Fencing, gates and signage (site visit). Normal City activities will provide coverage of
this issue as well as any complaints that the City may receive.
5. Appearance/impact of site: (site visit)
o Dust control-maintenance records of filtering or cleaning systems could be
summarized at season end's�owing the effort made to minimize dust;
o Material on Roadways-all trucks hauling material should be covered to minimize
loose material;
o Noise-reminding drivers not to 'jake brake' or create unnecessary engine noises;
o Traffic: monitoring when the highest output of product is being shipped out and
tracking the routes of the trucks;
o Site clearance: trees should not topple or land should not slide down slopes after
the mining of a hillside has been completed;
o Condition of buildings and equipment should be kept in a workmanlike shape;
o Condition of reclaimed areas in regard to vegetation needs to be maintained to
allow for long term stabilization of the site.
6. Reclamation: (site visit)
o Condition of reclaimed areas in regard to erosion prior to the long term
stabilization done through best management practices;
o Maintenance/formation of 4:1 slopes with 4"of topsoil, a description of reclaimed
areas shall be provided at the close of seasonal operations. ;
o Formation of 6:1 slopes within 100' of created lake, a description of the progress
of the lake excavation shall be provided at the close of seasonal operations. A
new site plan showing the lake and other parts of the final reclamation is required
every 5 years (C 1).

7. Ground Water Protection {if applicable}: (site visit)
o Expected range of dates when excavation into ground water will be ongoing thus
prompting more site visits;
o Summary of ground water lake creation done in the latest seasonal operation:
➢ Size of excavation in acres;
➢ Current depth of exaction into groundwater;
➢ Distance of processing areas.
o Equipment maintenance occurring off site.
o Condition of storage tanks and secondary containment.
o Spill prevention:
➢ MPCA reports filed in last year;
➢ Surface water monitoring:
■ SWPPP on site;
■ BMP's being maintained to avoid the discharge of untreated
stormwater from the site;
■ Erosion and sediment control practices being maintained.
o Tier II Chemical inventory submitted to Scandia Fire Department.
o Activities occurring on the site not related to mining:
➢ Farming;
➢ Other.
8. Ground Water Monitoring will require a site visit only to verify the wells are still active
and being protected:
o Monitoring and protocols approved by City Hydrogeologist being implemented
and copy available;
o Production well pumping records;
o Ground water sample analysis on file;
o MN County Well index updated to show additional wells drilled.
