Background: • Mr. Boreen farms approximately 135 acres and is asking to build a
3200 square foot agricultural building.
• According to Section 9.2 of Chapter 2 of the Scandia
Development Code, a CC is required for an agricultural building
but not a building permit.
• The building is outside of the Lakeshore District and will be in
front of the house but setback from the road more than 200 feet.
All other setback requirements are met.
Recommendation: I recommend the Council approve the Certificate of Complince.

RESOLUTION APPROVING A CERTIFICATE OF COMPLIANCE FOR
ROBIN BOREEN
WHEREAS, on September 30, 2009, Robin Boreen applied for a Certificate of
Compliance at the City of Scandia to permit construction of a 3,200 square foot agricultural
building at 11529 Mayberry Trail North; and
WHEREAS, the property is legally described as the W 1/2 of the SW 1/4 '/4, Section 20,
Township 32, Range 20, Washington County, Minnesota; and
WHEREAS, Section 9.5 of Chapter 1 of the New Scandia Development Code provides
that a certificate of compliance shall become null and void one year after it has been issued, if
the use has not been established; and
WHEREAS, the building has not been constructed, and will meet all setback
requirements of the Zoning Code.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE TOWN BOARD OF
NEW SCANDIA TOWNSHIP, WASHINGTON COUNTY, MINNESOTA, that it should
and hereby does extend the Certificate of Compliance dated November 1, 2005 for one year to
expire on November 1, 2007, based on the same plans and findings of the original application;
and
FURTHER BE IT RESOLVED, that the following special conditions of the permit
shall be met:
1. The uses of the buildings on the property shall be primarily agricultural.
2. All fees are paid.
