Background: • Bracht Bros., Inc submitted payment for the 2009 calcium
chloride dust control treatment on 185th Street North. Total
cost of the treatment was $2,145.99 and amounts to
approximately 4,000 feet of roadway.
• Bracht Bros. is disputing which part of 185`h Street they should
be responsible for and are asking to be refunded $1,019.35, the
cost of treating approximately 2,000 feet of roadway.
• Bracht Bros. had submitted a dust control plan with for their
2009 Annual Operators Permit which gave a brief history of
where the treatment had been applied previously.
� In the 2009 AOP submittal it stated that dust control would
be maintained to the eastern entrance of the mining site.
Bracht Bros letter states that a good stopping point would
be the trucks hauling on the south side of the roadway.
The distance between these two points is approximately
1,400 feet of roadway which is one of the areas Bracht
Bros is disputing for calcium chloride treatment.
• A letter dated July 8`", 2008 from the City of Scandia
explained to Bracht Bros that complaints had been received
regarding dust traveling easterly from the last section of
185`" Street before Olinda Trail. This letter was sent to
Bracht Bros 3 months before the final submittal of the dust
control plan. This section of roadway accounts for 586
feet of 185`" Street and starts at Olinda Avenue and is the
other areas being disputed.
• The enclosed aerial view of 185`�' Street depicts the
approximate disputed treatment area and the 2009 actual

area treated from the AOP. Historically, approximately
2,000 feet of 185�" was treated and the area the City
thought was agreed upon in the 2009AOP, was a total of
4,000 feet treated.
• The City applied calcium chloride to the extent that was agreed
upon in the AOP. The City allowed for specific `start and stop
points' to be established during the AOP process and believed
it had gotten those from the letter sent to Bracht Bros. and the
plan that was submitted.
• Scandia's dust control policy recognizes the unique situation
of 185`" Street due to the sand and gravel operation.
Recommendation: I recommend the Council not refund any portion of the cost of the
calcium chloride applied in 2009. The proposed `start and stop points'
that have been submitted by Bracht Bros. can be negotiated during the
2010 AOP application process.

Dear Steve,
Upon receipt of the bill for the dust control applied on 185t" Street, I was very
surprised by the quantity of calcium chloride which was applied on the road.
This year 2,900 gallons were applied. Last year there was 2,424 gallons, while the
five prior applications were for 1200 gallons each. I believe the City should offer
an explanation and justification for why the amount of chloride has more than
doubled over the last two years. In addition, we need to clarify which areas of
185t" Street is our responsibility for dust control.
Both the CUP and the AOP state that Bracht Bros., Inc. shall be responsible to for
the cost of dust control applications for this street. The Dust Control Application
Policy also contains this vague language. Please understand that I do not have
an issue with paying for the cost of dust control, applied in a reasonable
manner. From all the meetings and discussions that took place during the CUP
and AOP process, our engineer, Kirsten Pauly and myself were under the
impression that we had arrived at an understanding that the area of 185t" Street
which needed to be treated was the areas with houses on it.
From 2004 to 2007, before Scandia became a city and all the rules and
regulations were rewritten, the part of 185f" Street that was our responsibility for
dust control began on the west at the tree line on the south side of 185th, which is
west of the first house on 185'h. The calcium chloride was then spread east down
185th Street, going past Engstrom's house, ending at the east end of the field
past Engstrom's house. This length is approximately 2000 feet, which required
1200 gallons of chloride.
In 2008, the calcium chloride application began, not at the tree line before the
first house, but at the beginning of 185th Street at Olinda Trail and ended past
Engstrom's house. This length is approximately 2600 feet and 2,325 gallons of
calcium chioride being applied. When I inquired abo�t the quantity, the City's
staff only response was that the City made the decision to have dust controi
applied from the beginning of 185th. That bill was paid with the anticipation of
resolving this issue during the permitting process.
Now in 2009, the calcium chloride was applied to an even greater length of
185'h. The application started at Olinda Trail and extended all the way down
185th to the main entrance to the pit. As noted earlier, the amount of chloride
applied this year is more than twice the amount applied in five of the last six
applications.
I feel that the application of calcium chloride to this entire length of 185th is a
waste of chloride and money. I have no objection to the application of calcium
chloride, when it is applied to help control the dust along the portion of the
street that has houses. The length of 185'" which was treated this year was 4003
fePt. Of this, less then half of the distance is resideniial fo^+age.
From the intersection of Olinda Trial and 185fh, it is 586 feet to the tree line on the
south side of the road. There are fields on both side of the road until this point.
The tree line is still west of the first house on 185fh. I propose that this is where the
application of chloride should start. Please refer to the pictures for reference. It
should aiso be noted that on this stretch of the road there is a natural tendency
for less dust to be created. If the trucks are going west, they are slowing down,
preparing to stop at Olinda Trail. If they are going east, they are traveling at a
reduced speed as needed in order to turn onto 185'h. As we all know, it takes a
while for trucks to get up to speed. The trucks are also asked to limit their speed
to 30 mph on this road.
The calcium chloride should continue to be applied past all the houses and their
yards. A good stopping point would be at the trucks hauling sign on the south
side of 185t" . This sign is 500 feet past the last house before the entrance to the
pit. At this point, there are fields on both sides of the road and no houses are
visible. Fields continue to border the remaining 1400 feet of road, up to the main
gate entrance to the pit. It should be noted that there is one house on the south
side of 185th, just west of the gate. As you can see by the picture, the house is set

slim. Also, like the western end of 185fh, the trucks are traveling at a slower speed
on this section of the road. If the trucks are eastbound, they would be slowing
down to turn into the pit or if westbound, they would be leaving the pit loaded
and slowly accelerating. By the time the truck reaches 30 mph, it would be
traveling on the portion of the road to which the calcium chloride had been
applied.
The area that I recommend for coverage would be approximately 2043 feet.
This distance should provide each of the five homes with adequate dust control.
If this were to be averaged out per house, each house would benefit from
approximately 410 feet of coverage. This will not only provide coverage in front
of the individual homes, but also the entire distance in between them.
I am enclosing two checks to cover the cost of the 2009 application calcium
chloride on 185th. The check in the amount of $1,126.64 will cover the cost of
treating 185'h for the distance that I thought we were responsible for, based
upon the agreement I thought we had in place after all the discussions and
meetings with the CUP and the AOP process. It is for 2100 feet at a cost of $.5365
per foot ($2,146.00 divided by 4000 feet.)
The second check is in the amount of $1,019.35. Before this check is cashed, I
would like the City Council to decide which part of 185'h Street is our
responsibility. If the City Council thinks that the neighbors benefit from an extra
1000 feet of calcium chloride applied along the sections of roads that have only
fields on each side and no houses within view, that is their right and I will abide
by their decision.
I regret that this took me an inordinate amount of time to respond the request
for payment. I knew that this would be a conflicted issue and would require a
public meeting and I am not the type of person who deals well with conflict nor
who likes public meetings. Even though we have spoken during this time and
even passed some rough drafts back and forth, we were not able to come to a
mutual agreement on this issue. Since you and I were not able to come to an
agreement, I feel that the involvement of the Council is needed. I hope the late
payment hasn't negatively impacted the City's budget.

In reply to your inquiry regarding tlie increase in the number of gallons of dust control applied to
185`h Street, the mining ordinance does state that the City will arrange for dust control
'applications at its discretion. The City did receive complaints about the amount of dust generated
by the g►-avel trucks along the entire stretch of I 85`h. Even though there is not a house situated
along the first stretch of roacl east of Olinda 'Trail, the dust does travel to the occupied houses
further along 185'�' Street. Ti�e City did make t}�e decision to have dust contro] applied from
Olinda Trail to the entrance of the pit, thus tlie increase in the number of gallons applied tliis
year.

Control Plan on August 28, 2008.
The City's primary concern related to dust control at the site is the control needed on haul roads - particularly
on 185th Street. Tlie proposed Dust Control Plan indicates that"Dust control will be provided on 185th
Street," and"If Old Marine Trail is used as a significant hauling route, and the City deems it necessary, dust
control will be provided o(s�)Old Marine Trail as we11."
Tlle plan provides no specifics regarding tlie type of dust control or anticipated frequency of dust control that
will be provided on 185ih Street. Additional detail sliould be provided by the Applicant to meet the
coriditions included in tl�e CUP - for example, the type and frequency of dust control that�vill be completed
under typical conditions.
The Applicant submitted a revised Dust Conti•ol Plan to the City on October 14, 2008. The revised
plan meets the requirements of'the Ordinance.
Noise
Tlie application indicates tliat all activities will bc conducted on tlle site to mect Federal, Staie and County
noise standards. The City's Ordinance states that the operator must meet Pederal, State and City standards,
as tlie County does not have standards tliat apply. I'he Application should be revised to cliange "County"to
"City"standards. Tlie CUP did not include additianal conditions related to noise. The Application has
been revised as requested.
Deptlr of Excavatio�i
The application indicates that ne��r areas of mining will not be exca��ated below 920' above mean sea level,
and no excavation wi11 be undertal:en closer tllan 3' to the highest ground water ele��ation. 'This meets the
requirements of the Ordinance and CUP.
Monitoring data gathered from new wells at the site will be used to establish the elevation of the ground
water table in die mine area, and klie City's consulting hydrogeologist (LBG} will review tl�e monitoring data
and authorize the deptll of excavation based on tlic elevation identified. The proposed excavation elevation
�vill be a minimum of three feet above tlie �vater table in accordanee with the Watershed District rules.

Dust Control Plan revised 9/22/08
This plan addresses dust control measures which are implemented at the gravel
mining site.
1. Strippinq Operations: Dust production at the site is related predominately to
wind erosion of the topsoil, stockpiles and mining activities. Due to the size
particles in topsoil it is subject to three times greater erosional losses than
the underlying sand and gravel deposits. Wind erosion, which creates dust,
will be most preva�ent during periods of stripping. The majority of the site
where mining will occur has been stripped. The only additional stripping will
occur in conjunction with the restoration of the site when the eastern portion
of the site will be sloped to create final restoration grades. When additional
stripping occurs the following pracfices will be followed:
o Conduct stripping operations as quickly as practical. This includes
removing all of the topsoil to expose the underlying sand and gravel with
reduced dust producfion potential, and stockpiling the topsoils.
� All berms will be stabilized as quickly as practical by applying seed and
mulch and watering as needed to assure proper establishment of
vegetation. All berms on the site have been stabilized.
2. Mininq and Processinq Operations: Mining operations contribute to dust
production in the extracfion, processing and transportation of product.
Mifigafive measures which can successfully be applied to various aspects of
the mining operation, and which will be followed by the operator are
discussed below:
• The general setting of operations are recessed and perimeter berms, act
to trap a portion of the dusf generated within the site, and prevent it from
migrating beyond site boundaries.
The natural moisture content af the de[posit as well as the washing process
minimizes dust generation.
3. Dust Control on 185�h and Old Marine Trail:
185�h Street
• The operator will provide dust control on 185'f'. Historically this has been
accamplished in cooperation with the City of Scandia. The City of
Scandia applies calcium chloride treatments as needed and bills Bracht
City of Scandia ;�,

The City of Scandia considers that applying dust control measures improves the quality of life of
its residents living on gravel roads. The application of calcium chloride improves the gravel
surface by compacting the gravel, which makes for a smoother surface and thus requires less
grading, as well as reducing dust. The City also encourages the application of dust control to
private roads and parking lots.
Dust Control on Public Roads
The City of Scandia will subsidize approximately fifty percent of the cost of one application of
dust control to city streets. In the spring of each year, city staff will obtain a quote to establish
the cost of for the current year. For 2008, the fee will be set at a minimum of$65.00 per 300
feet of frontage, with an additional minimum fee of$65.00 for each additional 300 feet of
frontage. In subsequent years, staff will set the fee based on the change in cost compared to
the previous year.
Staff will notify residents of gravel roads of the current cost by mail and inquire if they wish to
participate in the dust control program. To express their interest to the City to participate in dust
control, residents will pay the fee (by check or cash) to the City prior to the application of
calcium chloride. If the owners of a minimum of 75% of the frontage of a given street do not
request dust control by paying the fee, the city may elect to not apply it to that street. If the
owners of a minimum of 75% of the frontage of a given street request dust control by paying the
fee, the city may elect to apply it to the entire street. Residents will stake out their road frontage
with laths provided by the City, if they are requested to do so.
Special Provisions for 185th Street
Because 185`h Street serves and active sand and gravel mine, the need for dust control far
exceeds what would be necessary due to normal traffic volumes. Consistent with the
requirements of Chapter 4 of the Development Code and the Conditional Use Permit and
Annual Operators Permit for the mine, the City will arrange for dust control applications for this
street at its discretion. The operator will pay the full cost of dust control applications for this
street.
Private Roads, Driveways and Parking Lots
Business owners, residents of private roads and driveways, and other local governments may
also participate in the dust control program by paying the full cost of the calcium chloride applied
to the area they designate, plus fifteen percent of the contractor's cost to cover city staff time
and administration of the program. City staff will notify such business owners and residents who
have requested application in the past of the current cost, and will bill them after the application
with the payment due to the city within 30 days.

befween Oakgreen Ave. and Olinda Trail — (in front of the first house) to
the eastern entrance to the site. The calcium chloride treatments have
been applied as the City deems necessary, typically 1 or 2 treatments
per year depending upon weather and truck hauling activity. The
operator agree5 to continue this method and extent of dust control on
185ih Street.
Old Marine Trail:
• The CUP requires that the operator discourage trucks from using Old
Marine Trail. Therefore, only if there is a local job requiring a substantial
number of loads would it be necessary for the operator to provide dust
control on Old Marine Trail. In that event, the operator will contact the
City prior to beginning the job fo determine the appropriate dust control
requirements at that time.
