The City Council has requested that the Planning Commission address an issue raised in a
tetter from Sydney Stephan, 22200 Meadowbrook Avenue North (attached). Mr. Stephan would
like to create an "event cente�"on his property. The City's ordinance does not currently have a
use that fits the use that he proposes.
Mr. Stephan would like to create an"event center'for outdoor events, such as weddings, fund
raisers, company picnics and similar events. Resorts/Conference Facilities is the use most
similar to what he is proposing, but is not a good fit.
The Council would like the Planning Commission to consider whether the use that Mr. Stephan
is proposing should be permitted in the code; and if yes,to update the code to address the use.
This would include creating a definition, determining the districts where it would be allowed,
determining any permit requirements, and identifying performance standards.
This memo introduces the issue to the Planning Commission, and provides a local example of
an ordinance that includes a similar use. The Planner would like the Commission's feedback
regarding the proposed use, its fit in Scandia, and potential issues before proceeding further in �
looking for examples or drafting a definition or ordinance sections.
Local Example
Several years ago Stillwater Township had a request for an event facility use. The request was
for a simpler facility than Mr. Stephan is proposing, but it provides a local example for the
Planning Commission to consider. The Township determined that a "ceremony facility" for
weddings and other events fit the rural character of the Township. The Township has an
existing "event facility" (Outing Lodge)that is a grandfathered use in the Township that has a
larger scope. The Township did not want to allow for more uses similar to Outing Lodge due to
some past neighbor concerns about outdoor amplified music and noise from larger events. The
Planner reviewed a variety of ordinances for such uses, and created the following definition for
the use that was acceptable to the Township:

" Ceremony Facilify:A /ocation to conduct a formal ceremony observing a special occasion, and
operated with the intenfion of earning a profit by providing the facilrty to the pub/ic."
I have attached a copy of the performance standards that Stillwater Township adopted for
ceremony facitities. The standards include:
• The use requires a Conditional Use Permit
• The minimum lot size is 5 acres
• The use is accessory to a homesteaded dwelling
• This use allows ceremonies only—no parties or overnight accommodations
• No amplified outdoor music .
• Hours of operation are limited
• Parking must be provided on-site
• Buffering may be required between the use and neighboring properties
Questions for the Plannins� Commission
The Planning Commission should discuss the following issues at its meeting on February 5:
• Is an event-type use appropriate in Scandia?
• What type of use is appropriate? What is the definition of the use?
• Should the use require a permit? CUP? Administrative permit?
• What performance standards do we need to address?
If the Planning Commission recommends that we add this use to the Zoning Ordinance, you
should provide guidance on the standards to be included. Planning staff can develop a draft
ordinance for review at the March meeting if the Commission wants to consider including an
events use in the Development Code.

Conditional Use Pernut to create an event center on my property at 22200 Meadowbrook
Ave. North. Upon reviewing the Scandia Zoning Regulations,I do not see a definition
that matches my intended use. Consequently, I am respectfully requesting that ihe
Council provide an initial review of my request so that I miglrt continue my application
along the proper channels. ,
Item 4.21,Resorts/Confezence Facilities,Chapter 2,Page 80 is only marginally similar
and describes a use that is still quite dif�'erent from mine. My intent is to use my property
for outdoor events,primarily weddings,but also for community events such as fund
raisers, company.picnics, anniversaries and day retreats.Activities would center around
my historic red barn and spacious lawns and pastures.
The idea to purstie this venture originated from numei�us requests from friends and from
the public, some of whom live in or near Scandia. Upon attending previous private family
weddings held on my pr�perty,these persons encouraged me to consider offering m}�
barn as a wedding venue to the wider public. While attending a Gammelgarden silent
auction and barn dance which was held at my farm, several attendees asked if we would
allow other such events and weddings.The popularity of outdoor/barn weddings and
events has increased significandy and yet it has become apparent that local venues to host
such events aze very scarce.
My farm represents a picturesque example of a rural Scandia setting that should be
preserved and enjoyed by those who wish to connect with the past in a meaningful way.
Creating an event location around these values would be a welcome asset to the
community.

Dear Commission Members:
Thank you for including me on the Planning Commission agenda for February 5, 2013.
You already have in your possession a copy of my letter dated December 4, 2012 which
introduced my desire to establish an outdoor event venue on my property. As you know,
on January 8, 2013 the Scandia City Council voted unanimously to pass consideration of
my proposal on to the Planning Commission. At that time the Council members were also
in agreement that the City should support and encourage business ventures such as the
one I am proposing.
The view has also been expressed that the current zoning ordinance does not adequately
address an event center use such as the one I am proposing and that it may be desirable to
amend the ordinance. 1 agree. I believe it is proper to start with amending the ordinance.
Consequently, the purpose of my current letter is to support the creation of an amendment
to the City of Scandia zoning ordinance and to respectfully submit a draft of some
possible objectives and a framework of the proposed amendment.
Furthermore, since there are likely other desirable land uses for Scandia agricultural
properties that are not permitted in the ordinance such as vineyards, orchards and
specialty farms that wish to sponsor public events, corn mazes, crafting, music festivals,
heritage fairs, and the like, 1 believe it is prudent for the City to consider an amendment
that is broad enough to benefit not only myself but other Scandia property owners as
well.
Consider the following excerpts from the 1998 City of Scandia Comprehensive
PlanNision 2030 as if read from that year in the present tense:
Scandin of 2030 has successfully managed the change that has been a constant in the
surrounding region to maintain its unique rural character,ag�icultura/heritage,historic
charm, and natural resources. .....Growth management emphasizes the protection of a rural
ag�icultura!fee/without pulling up the drawbridge to change. The City has a reputation for
being a welcoming,open,accepting place filled with new opportunities that build on and
protect Scandia's many assets...._Rural buildings endowed with Scandia's history and identiry
are preserved or incorporated into development and redevelopment,and family farms can still
be found within the City....Art and recreationa!tourism provide a synergy that brings a variety
of visitors to the City.
One of the themes of the above is that "managed change"can coexist with and, in fact,catalyze
the goal of "maintaining rural character". 1 submit that in order to preserve Scandia's "rural
character, agricultural heritage and historic charm"it will become necessary for the survival of
many of the City's small family farms to supplement their livelihoods with revenues other than

those derived from the sale of typical commodities such as grain,hay and livestock. To quote the
Vision 2030,the City desires to be a "welcoming, open,uccepting place filled with new
opportunities that build on and protect Scandia's many assets."
What are these"new opportunities"wisely envisioned above that will give hope for rural Scandia
property owners who wish to preserve their properties from the offers of real estate developers?
Corn, soybeans and hay are not sustainable answers, not on 40 acres-not even on 80 acres.
Again note the Vision statement,"Rura!buildings endowed with Scandia's history and identity
are preserved or incorporated into development and�edevelopment,and family farms can still
befound within the City."But such preservation of rural buildings and history will not come
about through sentimental dreams or wishful thinking. Instead, as the Vision Statement wisely
predicts,"new opportunities"are a more viable avenue to rural preservation. New opportunities
to preserve rural properties that were envisioned under "art and recreational tourism"(Vision
Page 2)could include vineyard and orchard tours, agricultural history events, corn mazes,
crafting, music festivals, antique shows, ethnic heritage fairs, retreats and wedding
ceremonies and receptions. The emphasis here is to provide new opportunities for
economic growth by attracting visitors from nearby urban communities who are seeking
to experience the rural atmosphere.
I have witnessed firsthand the euphoric desire of the Scandia Comprehensive Plan to
preserve the City"s scenic viewsheds. A guest at a private wedding on my farm said, upon
viewing the sunset across my west pasture, "Oh, that is so wonderful!", she said, '`It is so
beautiful out here in Scandia. You should consider opening up your farm to the public for
weddings." Preservation of historic settings in Scandia will continue to be threatened
unless there is economic incentive for rural landowners to stay put and to be part of the
dream. This incentive has its source in revenue from tourists and visitors. The local
ordinance must allow and encourage such activity or the goal of preservation is not
realistic.
Agriculture in the narrow sense of crops and livestock cannot be the sole source of
revenue for saving Scandia's rural heritage. Yes, one might save a few large contiguous
acreages by selling or leasing to corporate farms, but don't expect that the accompanying
farmsteads will be saved. Witness the trips I made this past year to North and South
Dakota, Nebraska, Kansas and Oklahoma. Plenty of"farmland" still there ...sure... in
fact, as far as the eye could see! But not the heritage. Why? The buildings were gone. Or
worse yet, the houses and barns remained but they were abandoned and caving-in, a sad
and depressing phantom of what has been but can never be again. The nearby
communities were similar—declining in population and buildings boarded up.
So land, per se, does not create heritage, it is the visual evidence of people on the land
that is the stuff of which history is made. One cannot fault the once proud owners who
moved away, taking local heritage with them. Many would have remained had there been
economic incentive to do so. Now, I am not suggesting that I have a solution for all of the
rampant consolidation of America's farmlands. However, 1 do assert that given Scandia's
�eography there is a chance to put flesh on the City's Vision to save our rural heritage by
encouraging an expanded variety of rural business that is compatible with preserving
rural ambience and history.

Therefore, and in accordance with Scandia Zoning Regulations Chapter 2: 1.3 which
allows for a landowner to initiate an amendment to the Zoning Ordinance, 1 propose that
the City of Scandia Zoning Ordinance be amended to include a use entitled "Rural
Recreational and Retail Tourism" as follows:
• Definition: Rural Recreational and Retail Tourism businesses will attract travelers
or visitors to areas historically or traditionally used for agricultural purposes,
which are generally small-scale, low-impact, and entertainment, recreation,
ceremonial and/or education focused;
• Purpose: In accordance with the stated goals of the City of Scandia
Comprehensive Development Plan, it is the purpose of this subdivision to:
o Preserve and celebrate Scandia's rural and agricultural heritage, and
historic landscapes;
o To recognize Scandia's scenic viewsheds, exceptional rural ambience,
historic sites as desirable local amenities which will draw outside revenue
from visitors, that is vital to the local economy;
o Enhance Scandia's appeal to visitors who are drawn to its rural
atmosphere;
o Provide opportunities for new economic growth through Rural
Recreational and Retail Tourism businesses;
o Assist the City's citizens in the transition from primarily agricultural land
uses, to an expanded variety of rural business opportunities as active
family farming continues to diminish in the City of Scandia.
• Standards: Rural Recreational and Retail Tourism Businesses shall meet the
following standards:
o Rural Recreational and Retail Tourism businesses shall be located within
the Agriculture District AG CORE;
o Rural Recreational and Retail Tourism businesses shall require a
Conditional Use Permit in accordance with the requirements of this
Ordinance;
o Rural Recreational and Retail Tourism businesses shall be shown to have
a unique and demonstrable relationship with the City of Scandia or its
region, and its history, culture, traditions, arts, crafts, lore, natural
resources, or other features and amenities, in accordance with the
above stated purposes.
• Allowed Uses: Allowed Rural and Recreational Retail Tourism businesses shall

reasonably related merchandise, and other uses determined by the City to be

25. Rural Retail Tourism businesses which attract travelers or visitors to areas historically or
traditionally used for agricultural purposes, which are generally small-scale,low-impact, and
entertainment, recreation, and/or education-focused.
SECTION 4 GENERAL PROVISIONS
SECTION 4.I5 Rural Retail Tourism Businesses
.
A. P ose. In accordance with the stated goals of the Chisago County Comprehensive
Development Plan, it is the purpose of this subdivision to:
■ Preserve and celebrate Chisago County's azchaeological properties, rural and
agricultural heritage, and historical landscapes;
■ To recognize Chisago County's scenic features, exceptional rural ambience, historic
sites as desirable local amenities which will draw outside revenue from visitors, that
is vital to the local economy.
■ Enhance Chisago County's appeal to visitors who are drawn to its rural aunosphere;
■ Provide opportunities for new economic growth through Rural Retail Tourism
businesses;
■ Assist the County's citizens in the transition from prima.rily agricultural land uses,to
an expanded variety of rural business opportunities as active fanuly farming
continues to d�minish in Chisago County.
B. Standards. Rural Retail Tourism Businesses shall meet the following standards:
I. Rural Retail Tourism businesses shall be located within the A or RVC Zoning
Disrricts;
2. Rural Retail Tourism businesses shall require a Conditional Use Permit in
accordance with Section 8.04 of this Ordinance;
3. Rural Retail Tourism businesses shall be shown to have a unique and demonstrable
relationship with Chisago County or its region, and its history, culture, traditions, arts,
crafts,lore, natural resources, or other features and amenities, in accordance with the
above stated purposes.
C. Allowed Uses. Allowed Rural Retail Tourism businesses shall include things as fazm or
other historical heritage attractions, single fanvly residential rental properties for retreats,
crafting, weddings, receptions, bed & breakfasts; small-scale,low impact special events or
music festivals, corn mazes, holiday celebrations and haxvest festivals, country-aaft/antique
shops,unique local venues providing for the sale and serving of locally produced raw
and/or value-added agricultural products> goods and services, and other reasonably related
merchandise, and other uses determuied by the Department to be similar in nature and
scope.
D. The terms "small-scale" and "low-impact" shall be construed to refer to land uses which:
I. Do not create an excessive demand upon existing services or amenities;
2. Are screened or able to be screened adequately, or are sufFiaendy separated from
adjacent development or land, to prevent undue negative impact to nearby
properties;
3. Will not have an appearance that is inconsistent or incompatible with the �
surrouncling area;
4. Will not cause traffic hazard or undue congestion;
5. Will not negatively impact the neighborhood by intrusion of noise,glare, odor,
or other adverse efFects.
Applications which are determuied to be unable to meet the above criteria may be
processed as a major commercial conditional use,provided the use is allowed in the
relevant Zoning District.
E. All conditional uses for Rural Retail Tourism shall meet the applicable requirements of
Section 8.
F. Code Com�liance An existing structure or SSTS which is subjected to a change in
occupancy or GPD loading as a result of an approved CUP for a Rural Retail Tourism
business shall be retrofitted and/or upgraded to conform to current code requirements. All
existing buildings proposed for use in assodadon with the business shall be cerrified by an
architect or engineer to be in compliance with current structural standards for the new
occupancy prior to any use of the structure.
