The regular monthly meeting of the Town Board was called to order
to Chairman, Charles Nordin. The following Board Members were
present: Charles Nordin, Chairman, Edith Hadlich, Kevin
Nickelson, Paul Rasmussen.
Paul Rasmussen made a motion to accept the following consent
agenda:
A. Call to order
B. Clerk's minutes for 9/20/94 and 10/4/94
C. Approval of Treasurer's report
Balance September 1, 1994 $1,357,271.06
Receipts 7,241.78
Expenditures 116,54-6.88
Balance $1,247,965.96
D. Approval for payments of October expenditures

Duane Thompson seconded the motion and motion passed unanimously.
TOWNSHIP ENGINEER (TOM PREW)
Kevin Nickelson made a motion for partial payment to Valley
Paving for the 1994 Road Improvement Project for $141,714.73 and
Oxboro Intersection in the amount $18,711.73. Edith Hadlich
seconded the motion and motion passed unanimously.
The board questioned the two turnarounds on 197th Street and
195th Street by Hay Lake School, which were constructed with the
1994 Improvement Project. The Engineer would review these two
items.
Mr Prew reported Valley Paving will begin the restoration of the
project within the next couple of weeks. Mr Nordin voiced his
concern upon the completion date not being meet and 237th Street
not being surfaced as of this date and questioned how could we
asses those parcels without completion of the bituminous
surfacing.

Mr Hebert, Attorney informed the board the bonds have been sold
and the interest has to be paid when the bonds come due January
1, 1995 and the penalty will benefit all township tax payers.
Mr. Prew informed the board the 1994 Grading Project has begin on
195th Street and Larkspur.
Mr Nordin questioned the assessment for Easel and Wendell Johnson
on Novak Avenue and Mr Nordin was assured this is the only access
to the property and this is the township policy.
JULIET BLOOM PROPERTY
Edith Hadlich made a motion to accept the new boundary for the
Bloom property with reference to Sandgren Addition Lot B to
correct the 40 foot error on the edge of the plat. Paul
Rasmussen seconded the motion and motion passed unanimously.
PETITION PRESENTED BY NEW SCANDIA RESIDENTS
The following petition was presented to the Town Board regarding
a policy for complaints.
All complaints or correspondence to be considered for action must
be in writing, with name, address and daytime telephone number of
the person filing the complaint.
All anonymous correspondence, shall be held for 30 days to allow
the complainer to identify themselves. If after 30 days, there
is no response and the above information has not been given, said
correspondence shall be disregarded.
All complaints by telephone shall have numbers verified by the
caller T.D., when possible. If the caller chosen to remain
anonymous, by any means, the call may be terminated at any time
by the recipient. The complainer shall give their name, address
and daytime telephone number. The text of the conversation will
be noted and made available to the town board.
Any further dispersal of the above information shall be subject
to the Freedom of Information Act.
Gene Smith, Arlen Johnson, Gene Collier, Shirley Nagle, Nancy
Collier, Robert Jansen, expressed their concerns about a letter
mailed to residents and felt the residents are being harassed and
that their area is the only area the township enforces the
ordinance. The residents were assured that it is not only their
area, but if the board has a complaint persons are mailed letters
informing them of the violation and to adhere to the ordinance.

Mr David Hebert, Attorney presented a letter to the town board
referring to Minnesota Statues and Mr Hebert opinion was as
follows.
The Town Board could adopt a policy in which it will take no
action on complaints unless the complainant furnishes the Town
Board with his or her name, address and telephone number. The
Town Board and Town officials would not be permitted to disclose
the name of the complainant if the complaint relates to the use
of property.
However, since many citizens may have legitimate complaints but
do not wish to run the risk that their names will become public,
I do not believe the Town Board should adopt a policy in which it
totally ignores anonymous complaints.
If the complaints appear to have some basis in fact and would,
if proved, violate a Township ordinance, the complaint should be
handled in the same manner as signed complaints.
In nearly all cases, the Township officials attempt to obtain
voluntary compliance with the Township ordinances by letters and/
or personal visits. The Township uses the Court system to obtain
enforcement only as a last resort
It was agreed Al Goodman be more aggressive throughout the
township and notify the office of any violation of the ordinance.
EMPLOYMENT FOR A SECOND FULL TIME MAINTENANCE PERSONAL
Mr Duane Thompson reported upon recommendation from the Road
Committee the township should review the possibility of a second
full time Maintenance Person. The Town Board shall hold a
special meeting November 7, 1994 at 7:00 P.M. to review the
possibility of a full time employee for the Road and Bridge
Department.
SPEED LIMIT FOR OLD MARINE TRAIL
Paul Rasmussen made a motion to send a letter to Minnesota
Department of Transportation with a copy of the petition for a 30
mile an hour speed zone on Old Marine Trail from the intersection
of Olinda Trail County (3) to Oxboro Avenue.
Kevin Nickelson seconded the motion. Mr Nickelson made the
following amendment to the motion. To increase the speed zone to
40 miles an hour. Duane Thompson seconded the motion and motion
passed unanimously.

PODIUM FOR CENTER
Mr Paul Rasmussen informed the board he would contact a local
person to build a podium for the center and install a sound
system.
PARK AND RECREATION COMMITTEE
Ms Edith Hadlich made a motion to appoint Curt Augustine to the
Parks and Recreation Committee. Duane Thompson seconded the
motion and motion passed unanimously.
GEORGE LINDGREN
Mr Charles Nordin informed the board Mr George Lindgren expressed
his desire to meet with the Town Board and David Schwartz from
Northern States Power as the Power Company has requested to cut
brush under the power lines and Mr Lindgren does not want this
done until Mr Lindgren has settled with Northern States Power.
The board informed Mr Nordin to inform Mr Lindgren this is not a
board issue and this is between Mr Lindgren and Northern States
Power.
PARK AND RIDE SIGNS
The board informed the clerk to
install Park and Ride Signs on

SPEED ZONE OAKHILL ROAD
instruct the maintenance man to

Department of Public Works (James Hanson) for a 20 mile an hour
speed zone from Olinda Trail and Oakhill to Scandia School and
flashing lights for the school entrance. Paul Rasmussen seconded
the motion and motion passed unanimously.
T. H. 97 AT OLINDA TRAIL
The clerk read a letter from the Minnesota Department of
Transportation regarding holiday weekend traffic counts. The
opinion of the department was as follows: While sufficient
volumes were present during both weekend periods to meet the
requirements of the all stop warrant, we do not believe that the
installation of an all -way stop is appropriate for this
intersection.
TOWN GARAGE .AND COMMUNITY CENTER
Duane Thompson expressed his concern for the need of some future
plans for needed space of the maintenance building and Dolores
Peterson expressed the need for additional storage and space in
the kitchen for the Community Center. The Road Committee would
review plans for the maintenance building and the Scandia, Marine
Lions would have plans prepared for the Community Center.
