12-06-94 tb,pcDecember 6, 1994 On the above date, New Scandia Planning Commission held their regular monthly meeting. The following Town Board members were present: Charles Nordin, Chairman, Edith Hadlich, Kevin Nickelson, Paul Rasmussen, Duane Thompson. RONALD MULLINS/RIVERVIEW ESTATES Planning Commission recommends to the Town Board to grant Preliminary Plat approval for Riverview Estates with the following conditions: 1. A mitigation plan must be submitted and State agencies notified. 2. On the final plat, the lowest floor elevation ( 1 foot above the 100 year flood elevation) must be shown on those lots which abut a wetland/ponding area. 3. A development agreement must be drafted and recorded with the plat specifying Outlot A and Lot 1, Block 1 must be tied together in perpetuity. The agreement must also state no structures are allowed to be constructed on Outlot A. 4. Final approval of road plans by Township Engineer. 5. Rough grade to three hundred feet of the south property line. 6. Drainage easement for the ponding area be designated on the plat for Lot 2 Block 1 and the ponding area outfall structure be required to be maintained by property owner. 7. If the property south of Pomroy is developed, that future developer will be responsible for the cost of finishing the portion of Pomroy that is in Riverview Estates. Paul Rasmussen made a motion to accept Planning Commission recommendation, with the following addition: That a Development Agreement with all the issues addressed such as; letter of credit and title opinion. Edith Hadlich seconded the motion. page 2 Duane Thompson, Road Supervisor expressed his desire to have the road completed to the end of the Riverview Estates Plat. Tom Prew, Township Engineer had sent a written statement, that the road should have 3 inches of bituminous surfacing, as this road could be a collector road at a later date. Kevin Nickelson made the following amendment to the motion: That 2 inches of bituminous surfacing be applied to Pomroy Avenue in Riverview Estates. Edith Hadlich seconded the amendment. The following members voted yes, Edith Hadlich, Charles Nordin, Kevin Nickelson, Paul Rasmussen and Duane Thompson voted no. Amendment passed. Paul Rasmussen made the following amendment to the motion: Pomroy Avenue shall be completed to the end of Riverview Estates Plat, with 2 inches of bituminous surfacing and a T turnaround. Duane Thompson seconded the amendment and amendment passed. The following was the vote on the complete motion: Edith Hadlich, Charles Nordin, Paul Rasmussen and Duane Thompson voted, yes. Kevin Nickelson vote no. Motion passed. James Hickey Planning Commission recommends renewal of the Conditional Use Permit for James Hickey, 16099 209th Street, Scandia, MN 55073. Outlot a, Balfanz Valley View, for one year extension to operate a dog kennel with the condition all previous restraints be maintained. Duane Thompson made a motion to accept the Planning Commission recommendation. Edith Hadlich seconded the motion and motion passed unanimously. David McCurdy Planning Commission recommends to grant the Minor Subdivision to David McCurdy, 22130 Lofton Avenue, Scandia, MN 55073. SE 1/4 of SW 1/4, except the North 2 Rods, Section 8, Township 32, Range 20. To create a five acre Minor Subdivision on the grounds that it does have sufficient frontage on the Lofton Avenue right of way and in future development, the one house per five acre density can be met with the following condition: A drainage easement be dedicated around the wetland area by the south property line of the parcel. Findings are soil testing for a drainfield and alternate site have been approved and the building and septic sites do not threaten the wetland to the south.
