04-02-96 tb,pcApril 2, 1996 On the above date New Scandia Planning Commission held their regular monthly meeting. The following Board Members were also present: Chairman, Charles Nordin, Vice Chairman, Duane Thompson, Edith Hadlich, Kevin Nickelson and Paul Rasmussen. GRAVEL HEARING, JAMES ZAVORAL PIT Planning Commission recommends to the Town Board to grant the renewal of the Mining Permit 494-91132, Dr James Zavoral, Section 19, on grounds that the annual inspection found no violations of the permit during 1995 and that we are informed by Roger Rydeen that the County has received the annual report with the same conditions as in 1995. Findings are no complaints were received from the public. Edith Hadlich made a motion to accept the Planning Commissions recommendation. Duane Thompson seconded the motion and motion adopted unanimously. GRAVEL HEARING, BRACHT PIT Planning Commission recommends to the Town Board to grant the renewal of Mining Permit #94-91104 to Mr Paul Bracht, Bracht Pit,Section 35, on the grounds that the mine is operating in compliance with the County's ordinance and permit requirements with the same conditions as 1995. Findings are no complaints were received from the public. Paul Rasmussen made a motion to accept the Planning Commissions recommendation. Duane Thompson seconded the motion and motion adopted unanimously. GRAVEL HEARING, TILLER CORPORATION/BARTON SAND AND GRAVEL Planning Commission recommends to the Town Board to grant the renewal of the Mining Permit # 94-94033, for Tiller Corporation/ Barton Sand and Gravel in Section 7, on the grounds no violations were found during the annual inspections and the operation has complied with the requirements imposed as part of their mining permit with the same conditions as 1995. Findings are the activities completed in 1995: installation of a new containment system for the above ground storage tanks, repair of fencing, installation of landscaping for screening purposes along 228th Street North, conducting noise tests, groundwater quality testing of three on -site wells, increasing the asphalt plant's stack height, and completing restoration of the north 40 acres. page 2 Duane Thompson made a motion to accept the Planning Commissions recommendation. Paul Rasmussen seconded the motion. Mr Kevin Nickelson stated he has received complaints regarding odor from the Mining Operation and one resident stated he has received a coating of a black product on their residence. Mr Brent Schlueter informed the boards if a problem like this occurs to call him directly. The motion adopted unanimously. GRAVEL HEARING DRESEL PIT No representative of the dresel Pit was in attendance as required by the township. The clerk was directed to send Dresel Contracting a letter stating no action on permit renewal was taken at this meeting and Dresel Contracting shall be present at the May 7, 1996 Planning Commission. Kevin Nickelson made a motion to send a letter to Dresel Contracting and inform them the Mining Permit has expired and that no hauling from the pit shall be allowed. The Public Hearing for the Dresel Contracting shall be held on May 7, 1996. Paul Rasmussen seconded the motion and motion adopted unanimously. REQUEST FOR OPERATING FIVE (5) SATURDAYS IN 1996 WITH A 36 HOUR NOTIFICATION A letter was read dated February 15, 1996, to New Scandia Township from Brent Schlueter/Tiller Corporation, requesting permission to operate five (5) Saturdays in 1996 with a 36 hour request and notification period instead of the required 10 day prior request and notification requirement of Section 701.10. The reason given was the difficulty in complying with the 10 day prior request and notification requirement of and to alleviate customer scheduling conflicts. Planning Commission recommends to the Town Board that it set a date in the future for a Public Hearing concerning a possible change in the future to address Section 701.10 in New Scandia Township's Mining Ordinance. Kevin Nickelson made a motion to accept the Planning Commission recommendation. Edith Hadlich seconded the motion and motion adopted unanimously. SCOTT AND MARY DUNCAN CONDITIONAL USE PERMIT Planning Commission recommends to grant the Conditional Use Permit to Scott and Mary Duncan, applicant, 19677 Parkview Lane North, Scandia, Mn 55073 and owner Dr Jordon R Arvold, 1339 Hungerford Pt. St Croix Falls, Wisconsin 54024. Property that page 3 part of Lots 5 and 6, Revision of Vasa, 19707 St croix Trail North, Scandia, MN 55073. For a Music Studio and Retail Business on the grounds that usage is similar to prior use with the following conditions: (1) Minnesota Department of Transportation reviews the proposed use and driveway entrance and the driveway widened to 24' if they recommend this be done. (2) The historic character of the building remain in tact. No additional signage is allowed. A sign permit must be obtained from,Washington County for change in the existing sign. (3) A new joint parking agreement between Dr Arvold and Mr Bennett specifying number of spaces Dr Arvold is entitled to and length of agreement be recorded with the township. Edith Hadlich made a motion to accept the Planning Commissions recommendation. Kevin Nickelson seconded the motion and motion adopted unanimously. JAMES BAKER CONDITIONAL USE PERMIT Planning Commission recommends to the Town Board to grant the Conditional Use Permit to James Baker, 23140 Melanie Trail North, Scandia, MN 55073. Lots 12 and 13, Linnell Bone Lake Addition on the grounds that it would meet the definition of a home occupation with the following conditions: (1) The office is to be located in the house. (2) No staining in garage on site. (3) Limited amount of product stored on premises. (4) Obtain a hazardous waste generator's license from Washington County if required by Washington County. Findings are two precedents of record for home occupations of this type, no onsite business activities, no traffic problems and no extra parking spaces. Kevin Nickelson made a motion to accept the Planning Commissions recommendation. Duane Thompson seconded the motion. Mr Nickelson stated the Town Board is comfortable with Washington County directing the Hazard Waste part of the permit. Motion adopted unanimously. page 4 BETTY WOJTOWICZ/MINOR SUBDIVISION Ms Betty Wojtowicz, 26695 Olinda Trail North, Scandia, MN 55073. Part of the South Half of the Northeast Quarter of Section 11, Township 32, North, Range 20 West for a Minor Subdivision on the grounds that the remaining 35 acre parcel will meet ordinance requirements after the split and an approvable driveway can service that parcel, with the following conditions; (1) The 5.2 acre parcel transferred to Mr Goodrich must be combined on the.same deed as the parcel Mr Goodrich already has and that no additional residence be constructed on the newly created 10.6 acre parcel. (2) Drainage easements are dedicated around wetland areas. (3) Driveway permit is approved by Washington County Department of Public Works. (4) That wetland easement deeds be granted to the Township for water conservation purposes. (5) Soil testing is done on the remaining 35 acne site and it can accommodate a mound septic system. (6) A narrative description of the wetland easement be added to the April 2, 1996 Certificate of Survey. Duane Thompson made a motion to approve the Planning Commission recommendation with the addition that no Park Fee of $400.00 be paid at this time, but the $200.00 Park Fee be assessed when a building permit is issued by Washington County. Paul Rasmussen seconded the motion and motion adopted unanimously. BRUCE SWENSON CONCEPT OF MAJOR PLAT/CLUSTERING ROUSING Mr Bruce Swenson presented the concept of a Major Subdivision/Cluster Housing for review. Planning Commission recommends to the Town Board to approve the new concept for Swenson Goose Lake Farm, Certificate of Survey for April 2, 1996. Paul Rasmussen made a motion to accept the Planning Commissions recommendation. Duane Thompson seconded the motion and motion adopted unanimously. page 5 GROWTH MANAGEMENT TASK FORCE Kevin Nickelson made a motion to appoint the following persons to the Growth Management Task Force. Edith Hadlich, Kevin Nickelson from the Town Board, all members of the Planning Commission, Colleen Firkus, Secretary, Gary Hogle, Richard Tetzlaff, John Borchert, Teri Dryer and LaVayne Dupslaff.
