05-07-96 tb,pcMay 7, 1996 On the above date New Scandia Township Planning Commission held their regular monthly meeting. The following Town Board Members were also present: Chairman, Charles Nordin, Vice Chairman, Duane Thompson, Edith Hadlich, Kevin Nickelson and Paul Rasmussen. Gravel Hearing, Dresel Contracting Planning Commission recommends to the Town Board approval to renew the Dresel Mining Permit for one year with the conditions that all repairs are completed to Mr. McCurdy's satisfaction including backfill and restoration of the excavated area; that excavation cease on the embankment near the north property line and within the required 100' setback; and excavation be limited to the area indicated as Staged on the south side of the mine. Duane Thompson made a motion to approve the Planning Commission recommendation. Edith Hadlich seconded the motion. There was discussion that Mr McCurdy should write a letter to the township informing the township that Mr Dresel has completed the restoration and that he was satisfied. The township office shall speak to Mr McCurdy. Mr Nickelson questioned the problem with gravel falling off the trucks on the highway. Mr Dresel informed the board the trucks are cleaned before they leave the pits. The motion adopted unanimously.,.. Anton Roggemann Minor Subdivision Planning Commission recommends to the Town Board to grant the Minor Subdivision to Anton Roggemann, 16946 Scandia Trail, Scandia, MN 55073. The East 25 acres lying west of the East 33 feet of the SW 1/4 of SE 1/4 of Section 13, Township 32, Range 20. To divide 25 acres into two parcels. The request for the Minor Subdivision is approved as both parcels meet minimum ordinance requirements with the following conditions: (1,) Washington County Soil and Water Conservation District approves fill for the driveway and establishes a culvert size. (2) Drainage easements are dedicated around the wetland areas. (3) Lowest floor of the new structure must be at least three feet above the highest known elevation of the pond. page 2 Findings are Minnesota Department of Transportation has issued a driveway permit and Washington County has approved the soil tests submitted for the installation of an on -site septic system on the new parcel. Paul Rasmussen made a motion to accept the Planning Commission recommendations. Kevin Nickelson seconded the motion and motion adopted unanimously. Terrance Bennett/Crabtrees Kitchen Planning Commission recommends to the Town Board to grant the variance and Conditional Use Permit to Terrance Bennett/Crabtrees Kitchen, 19713 Quinnell Avenue North, Scandia, MN 55073. Lots 1- 4 and Lots 9-16, all in Block 10 and Lots 1-8, Block 15, in the Revision of Vasa. The following variance is required to construct a covered 81x49' walkway on the front of Crabtrees Kitchen. Variances: Existing condition, front setback 18 feet from required 40 feet and side yard setback 7 feet from required 40 feet and side yard 22 feet from required 40 feet. Both existing the condition and the proposed addition fall within the required 150 foot setback from the center line of Hwy. 95. On the grounds that it will not be any closer to the road than the walkway in front of the existing structure and will not encroach on the parking area West of the structure. Mr. Plowman also recommends to the Town Board that it grant a variance and Conditional Use Permit to Mr. Bennett to add an outside 261x26' deck to the south side of the existing structure on the grounds that Dennis O'Donnell has not found it to be in conflict with County Zoning Ordinances. With the following conditions: (1) The septic tanks be inspected an pumped 4 times a year. (2) Water usage be metered. If any one -day the use exceeds 3,000 gallons, or any 30 day use exceeds an average of 2,100 gallons per day, Mr Bennett must add to the system and/or tanks, or take steps to reduce his use. (3) This property lies within the boundaries of the St. Croix River District. As such, the restaurant would be considered a non -conforming use and could not expand. Technically, the addition of the deck could be considered an expansion of a non -conforming use. An opinion must be received from the Minnesota DNR on this matter. page 3 Findings are there is metering of water usage and effluent; the National Park Service has no objections provided that the expansion conform to all County and Local Ordinances; there are more than enough parking spaces to accommodate the seating of 80 in the restaurant and 24 on the proposed deck; and there is handicapped access on the south end of the proposed walkway. Paul Rasmussen made a motion to accept the Planning Commission recommendations. Edith Hadlich seconded the motion. Mr David Hebert, Township Attorney informed the board that New Scandia Township is the local government and this is a conforming use as it is Zoned RB. Kevin Nickelson made a amendment to the motion that adequate septic capacity exists on the property for the additional use. Edith Hadlich seconded the amendment. Motion adopted unanimously. Robert Larson Robert Larson request was tabled until Mr. Larson has a new plan approved by Dennis O'Donnell. Gilbert and Evelyn Regnier/Bone Lake Estates A sketch plan of a Major Subdivision for Bone Lake Estates was presented by LaVayne Dupslaff of Landmark Surveying for Gilbert and Evelyn Regnier, 9060 Knollwood Drive, Stillwater, MN 55082. The sketch plan has no common area and the remaining 20 acre lot will have a deed restriction to prevent further development. Lot size variances would be needed as the township is still using current zoning ordinances. Kevin Nickelson suggested the lot size on the lake lots could be reduced to 1 1/2 acres to reduce the depth of the lake lots. Mr David Hebert reviewed the Townships current Cluster Development Ordinances an PUD Ordinances. Many of these ordinances won't apply to the current cluster proposal. Dan Booren/Cluster Development Mr Dan Booren, 11522 Mayberry Trail, Marine, MN 55047 and Mr Todd Drescher of Tood Drescher Architecture presented two designs for a cluster development.
