On the above date New Scandia Planning Commission held their
regular monthly meeting. The following Board Members were also
present: Charles Nordin, Chairman, Duane Thompson, Vice
Chairman, Edith Hadlich, Kevin Nickelson, Paul Rasmussen.
David Braun
Planning Commission recommends to the Town Board to grant the
Minor Subdivision to David Braun, 2380 Legion Lane, Lake Elmo, MN
55042. Part of the N 1/2 of NE 1/4 of Section 14, Township 32,
Range 20. On the grounds that all three lots have suitable
soil for mound type sewage treatment systems with enough approved
area to deal with long-term sewage treatment. Conditions are:
(1) Thirty-three feet from the centerline of Parrish Road North
and 220th Street North, and 50 feet from C.S.A.H. 3 to be
dedicated for road purposes; (2) Drainage easements are dedicated
around the wetland areas; (3) Access control is dedicated along
C.S.A.H. 3.
Duane Thompson made a motion to accept the Planning Commission's
recommendation. Paul Rasmussen seconded the motion and motion
adopted unanimously.
Kristen Bjornson
Planning Commission recommends to the Town Board to grant the
Conditional Use Permit to Kristen Bjornson, 23140 Olinda Trail,
Scandia, MN 55073. Lots 7 and 8, Scandia Addition. For a home
occupation on the grounds that it meets the definition of a home
occupation as contained in the Township Ordinance. Conditions
are: (1) must not create need for more than 3 parking spaces at
any given time; (2) no work shall be conducted in any accessory
building; (3) adequate off-street parking must exist; and (4)
signage must meet all New Scandia signage regulation. Findings
are precedence for home occupations of this type exist.
Edith Hadlich made a motion to approve the Planning Commission's
recommendations. Kevin Nickelson seconded the motion and motion
adopted unanimously.
Clifford Schlenker
Planning Commission recommends to the Town Board to deny the
variance to Clifford Schlenker, 13690 205th Street, Scandia, MN
55073. SE 1/4 of NW 1/4 of Section 22, Township 32, Range 20.
To house animals in the building as it doesn't meet Township
Ordinance for that purpose, the building permit specifically
stated no animals could be kept in the building and no hardship

was shown.
Kevin Nickelson made a motion to approve the Planning
Commission®s recommendation. Paul Rasmussen seconded the motion.
Kevin Nickelson, yes, Paul Rasmussen, yes, Duane Thompson, yes
and Charles Nordin, yes. Edith Hadlich vote no. Motion adopted.
Robert Larson
Planning Commission recommends to the Town Board to grant the
variance to Robert Larson,.12620 182nd Street, Marine, MN 55047.
Lot 10 and 11, Big Lake View Addition. For three variances to
construct an addition to the existing dwelling: (1) Lot size
40,000 square feet to 22,000. (2) Lake setback 100 feet to 28
feet (3) Road setback 40 feet to 27 feet. on grounds that many
neighboring homes are large on small lots. Conditions are: (1)
The addition is no larger than 241x 321. (2) Garage is no larger
than 27.81x24. (3) Maximum of two bedrooms. Findings are
property is improved by the addition septic is adequate for a two
bedroom home and addition is no closer to the lake than existing
dwelling.
Duane Thompson made a motion to approve the Planning Commissions
recommendation. Edith Hadlich seconded the motion and motion
adopted unanimously. 1.
Renewal Of Conditional Use Permits
Planning Commission recommends to the Town Board to grant the
following businesses in Hawkinson Business Park a renewal of
the following businesses in Hawkinson Business Park for a
five year permit: (1) Federated Co-op; (2) Olde Towne Liquor;
(3) Scandia Post Office; (4) Debra Schlenker, Scandia Pizzeria;
(5) Louise Barton, Total Entertainment; (6) Michelle Carlson,
AM-TEC Design; (7) PN Products, Ozark Court.
Paul Rasmussen made a motion to accept the Planning Commission
recommendations to approve the seven (7) Renewals of the
Conditional Use Permits in the Hawkinson Business Park. Duane
Thompson seconded the motion and motion adopted unanimously.
Planning Commission recommends to the Town Board to grant the
renewal of a five year Conditional Use Permit for Jean Womack's
Transmission Shop.
Planning Commission recommends to the Town Board to renew the
Conditional Use Permit for a five (5) year period for J. Scott
Plumbing for a sign on HWY 97.

Edith Hadlich made a motion to accept the Planning Commission's
recommendation to renew the Conditional Use Permit for a five
year (5) period to J. Scott Plumbing for a sign on HWY 97.
Duane Thompson seconded the motion and motion adopted
unanimously.
Duane Thompson made a motion to accept the Planning Commission
recommendation for the renewal of Jean Womack's Transmission
Shop for a period of five (5) years. Edith Hadlich seconded the
motion and motion adopted unanimously.
Planning Commission recommends to the Town Board to grant the
renewal of a five year Conditional Use Permit for David
Haselbauer's Machine Shop.
Kevin Nickelson made a motion to accept the Planning Commission
recommendation to approve the renewal of David Haselbauer's
Machine Shop for (5) years. Paul Rasmussen seconded the motion
and motion adopted unanimously.
Arthur Gullette
Planning Commission recommends to the Town Board to grant the
variance to Arthur Gullette, 23265 Lofton Court North, Scandia,
MN 55073, Lot 7 Sandgren Addition. For the following variance's
to construct a addition to existing dwelling: (1) Lake setback
100 feet to 64 feet. (2) Bluffline 30 feet to 4 feet. (3)
Sideyard setback 10 feet to 8 feet. (4) Lot size 1 1/2 acres to
19,100 square feet. To remove the single level front half of the
home and replace it with a two-story addition on the grounds that
there are water problems with the existing structure. Conditions
are no more than two bedrooms will be built and new addition does
not exceed 231x32' on both levels. Findings are it increases the
sideyard setback from 5.2 feet to 8.1 feet and Mr Gullette has
support from his neighbors.
Kevin Nickelson made a motion to accept the Planning Commission
recommendation. Paul Rasmussen seconded the motion and motion
adopted unanimously.
Donald Wheatlake
Planning Commission recommends to the Town Board to grant the
following variance's for construction of accessory building
301x30' Donald Wheatlake, 5219 E 114th Street, Thornton,
Colorado, 80233. Lot 7 and 8, Revision of Vasa and part of Govt

Lot 6, Section 6, Township 32, Range 19. (1) Minimum lot size
OHW 2.5 acres to 1.8 acres. (2) River setback from 200 feet to
100 feet. (3) Bluffline setback from 100 feet to 30-feet.
Duane Thompson made a motion to accept the Planning Commission
for Mr Donald Wheatlake. Kevin Nickelson seconded the motion and
motion adopted unanimously.
Bone Lake Estates/Gill and Evelyn Regnier
Mr Charles Nordin opened the discussion of the road width for the
plat and informed Mr and Ms Regnier and the Planning Commission
that the Town Board rescinded the motion of the road width at the
7:00 p.m. Town Board meeting for the Bone Lake Estates Plat from
20 foot to 24 foot road width. Mr Nordin stated the former
Township Engineer had questioned the reason of changing the road
width when the township already has established a road width
policy and other plats required the 24 foot road and he also made
reference to the letter from the Washington County Plat
Commission.
Planning Commission recommends to the Town Board to approve the
final plat dated 8/5/96 for Bone Lake Estates/Evelyn Regnier,
9060 Knollwood Drive, Stillwater, MN 55082. Part of Govt Lot 8,
Section 5, and part of Govt Lot 1, Section 8. For a Major
Subdivision of 51 acres with 26 acres of open space on the
grounds the development meets the overall density of 1:10 and
meets existing PUD ordinances. Conditions are the plat is
subject to change the drainage easement from between Lots 4 and 5
to between Lots 2 and 3.
Paul Rasmussen made a motion to accept the Planning Commission's
recommendations. Duane Thompson seconded the motion and motion
adopted unanimously.
Kevin Nickelson made a motion to approve the 3 documents for
Covenants, Homeowners Association and Development Agreement with
figures added at a later date and approved by the township
attorney. The road width be 24 feet and a cul-du-sac instead of
a T turn around. Edith Hadlich seconded the motion. Charles
Nordin voted yes, Edith Hadlich, yes, Kevin Nickelson, yes and
Paul Rasmussen, yes. Duane Thompson voted no. Motion adopted.
Duane Thompson made a motion the road width of 24 feet be
included in the Development Agreement. Kevin Nickelson seconded
the motion and motion adopted unanimously.

The clerk was directed to contact Dennis O'Donnell, Washington
County Department of Health requesting a refund of the $250.00
fee that was paid by Gill and Evelyn Regnier for the Public
Hearing regarding the variance for a 20 foot to a 24 foot road
width.
Rural Landscape Preservation Committee
Curt Hadland reported the committee developed a one page, double -
sided handout containing information on the New Scandia Rural
Landscape Preservation Committee, New Scandia Township's
Comprehensive Plan regarding natural resources and the Township's
ordinances dealing with the removal or destruction of vegetation
during building and developing. A partial list of references,
sources for native plants and local resources for landscape
information is also provided. This handout will be distributed
at the County level when they apply for building permit. A
five page guideline for the RLPC was also developed outlining the
Committee's purpose, goals, and protocol. Mr Hadland requested
approval to continue the volunteer committee and distribute the
one page handout to Washington County.
Planning Commission recommends to the Town Board to approve the
continuation of the nine member Rural Landscape Preservation
Committee and the distribution of the handout via Washington
County.
Paul Rasmussen made motion to accept the Planning Commission
recommendation regarding the Rural Landscape Preservation
Committee, but the reference needs more completion and the
committee consists of nine (9) members. Kevin Nickelson seconded
the motion and motion adopted unanimously.
Public Hearing Requirements
Dolores Peterson, Clerk, submitted an outline of a Public Hearing
Policy. The information in the outline states all required info
must be submitted to the township office three weeks prior to the
public hearing. Blair Joselyn, Planning Commission requested
these procedures be adopted immediately. Mr Joselyn requested
that the clerk notify Dennis O'Donnell, Washington County
Department of Health, that review letters should be submitted to
the township prior to the field trip of the month the hearing is
scheduled.
