6-03-97 tb,pcJune 3, 1997 On the above date New Scandia Township Planning Commission held their regular monthly meeting. The following Town Board members were also present: Chairman, Charles Nordin, Vice Chairman. Paul Rasmussen, Kevin. Nickelson, Robert Jensen and Dennis Seefeldt. John Kramer and Joyce Kramer Planning Commission recommends to the Town Board to grant the variance to John and Joyce Kramer, 19355 Oxboro Avenue, Marine, MN 55047. NW 1/4 of SE 1/4 of Section 2-6, Township 32, Range 20. To construct a 240 square foot horse barn 90 feet from a wetland versus the required 200 foot setback on the grounds that it is the most suitable location for configuration of property. Conditions are that New Scandia's Ordinance 730.01 will be followed in regards to manure management. Findings are no comment or concerns from neighbors. Kevin Nickelson made a motion to accept with the condition that only one horse shall be allowed due to only 2 1/2 acres grazable land. Paul Rasmussen seconded the motion. Kevin Nickelson yes, Paul Rasmussen, yes. Charles Nordin, no, Robert Jensen, no and Dennis Seefeldt, yes. Motion failed. No Gregory Benson Planning Commission recommends to the Town Board to grant the variance to Gregory Benson, 21120 Olinda Trail, Scandia, MN 55073. County Auditors Plat No. 6, Lot 11. Sideyard setback variance from 20 feet to 4 feet on the grounds that it would be an improvement of the property. Conditions are:) a maintenance agreement be established with the neighbor, 2) a drainage plan be established for water runoff between the garages to the back of Benson's lot, and 3) an easement over both properties be recorded. Findings are no neighbors objecting. Dennis Seefeldt made a motion to accept the Planning Commission recommendations. Paul Rasmussen seconded the motion and motion adopted unanimously. Curt Kees Planning Commission recommends to the Town Board to grant a Minor Subdivision to Curt Kees, 212 Hwy. 35, Osceola, Wisconsin 54020. N 1/2 of the NW 1/4 of Section 12, Township 32, Range 20. To divide a. 10.57 acres into two parcels of 5.07 and 5.5 acres, and the road frontage variance from 300 feet to 296 feet on Parcel A on the grounds that it meets ordinance requirements with the exception of the road frontage on Parcel A. June 3, 1997 page 2 Conditions are: 1) drainage easement is dedicated around the wetland area, 2) thirty-three feet from the centerline of Pilar Road North is dedicated to the Township for road purposes, and 3) a 66 foot easement is dedicated across Parcel A to the 26 acre parcel. Paul Rasmussen made a motion to approve the Planning Commission recommendations with the following conditions: 1) a easement of 33 feet be dedicated across Parcel A for public access. No buildings shall be built on the 26 acres unless developed. Robert Jensen seconded the motion and motion adopted unanimously. Gerald Olson Planning Commission recommends to the Town Board to grant Preliminary approval for the Plat of Greenfield Estates for Gerald Olson 11360 232nd Street, Scandia, MN 55073. Parts of Section 4 and 5, Township 32, Range 20 West. On the grounds that all parcels meet ordinance standards. Conditions are: 1) drainage plan approved by WMO, 2) a road agreement be obtained from Mr. Olson and Mr. Dahlin dedicating the south 33 feet of Dahlin's property and the north 33 feet of Olson's property to the township for road purposes, 3) Mr. Olson donate land for a township built turnaround on the end of 235th Street, 4) the lake lot is not part of the subdivision, and 5) Mr. Olson works with the township engineer in relocating driveways on Lots 2, 3 and 9. Kevin Nickelson made a motion to accept the Planning Commission recommendations with the following additions: Mr. Olson not be required to pay the one time payment of $5,000.00 for possible future maintenance or replacement of the private drain tile recommended in the letter dated April 10, 1997 from Mark Doneux, Minnesota Soil and Water Conservation District. Mr David Hebert, shall contact Mr. Warren Dahlin regarding the the conveyence of 30 feet for road proposes on Meadowbrook. Mr. Olson has agreed to convey 30 feet for easement. Paul Rasmussen seconded the motion and motion adopted unanimously. U.S. West New Vector/Joe Yasis Planning Commission recommends to the Town Board to grant the Conditional Use Permit to U.S. West New Vector Group, Inc. Jaymes D. Littlejohn, 4700 EDS Center, 80 South Eighth Street, Minneapolis, MN 55402-2228 and property owner Jose -Maria and Teresa Yasis, 12160 Scandia Trail, Scandia, MN 55073. Part of SE 1/4 of SE 1/4 of Township 32, Range 20 West. For a cellular base station and tower on the grounds that it meets the standards of the ordinance. Conditions are: 1) This permit allows for the construction of a 199 foot telecommunications tower and associated base equipment as shown on the submitted plans. June 3, 1997 page 3 2) The tower shall be located in accordance with the submitted site plan and be on the design submitted. 3) The addition of any new antennas to the tower shall require township approval. The construction or addition of any base equipment for other providers shall also require township approval. 4) The Conditional Use Permit shall remain in effect as long as the conditions of this permit are met. The grounds for revocation of this permit shall be based on a find that: (i) The permittee has failed to comply with conditions of approval imposed; or (ii) the facility has not been properly maintained; or (iii) the facility is no longer in use and has not been in use for the previous twelve (12) months. 5) All rules and regulations of the FCC and FAA must be met and complied with. 6) In the event of revocation of a permit, the tower and all accessory structures must be removed and the site restored to its original condition within 120 days. 7) Permanent platforms or structures, exclusive of antennas, other then those necessary for safety purposes or for tower maintenance are prohibited. 8) No advertising or identification signs shall be placed on the tower or antennas. 9) Structural design, mounting and installation of the antenna and tower shall be in compliance with manufacturers specifications. The plans shall be approved and certified by a registered professional engineer. 10) Associated base equipment must be located within a structure. Existing vegetation must remain to screen the base of the structure. The tower accessory structures shall be constructed of materials designed to minimize visibility to the neighborhood and as approved by the Zoning Administrator. 11) The tower owner shall, in good faith, lease space to other users so long as there is no disruption in the existing service provided by the tower's existing users or no negative structural impact upon the tower. 12) The bottom of the tower from ground level to 12 feet above ground shall be designed in a manner to preclude unauthorized climbing or shall be enclosed by a six (6) foot high chain link fence with a locked gate;. 13) Antenna and tower owners shall be required to conduct an annual inspection of their facilities to insure continuing compliance with this permit. A copy of the annual inspection report shall be provided to the township. 14) A Conditional Use Permit must be obtained from Washington County. 15) An access permit must be obtained from Minnesota Department of Transportation. 16) The tower will have a 500 foot setback from any neighboring residence. Findings are no neighbors voicing opposition. Dennis Seefeldt made a motion to approve the Planning Commission recommendations. Robert Jensen seconded the motion and motion adopted unanimously. June 3, 1997 page 4 Brad Smith Planning Commission recommends to the Town Board to grant the Minor Subdivision to Brad Smith, 611 South Holcomb, Stillwater, MN 55082. Nw 1/4 of the SW 1/4 of Section 16, and the NE 1/4 of the SE 1/4 of Section 17, Township 32, Range 20 West. On the grounds that it meets all ordinances. Conditions are :1) Sixty- six feet road dedication to the township is'made for the gravel road off of Highway 97. A turnaround be constructed in accordance with township specifications. 2) Thirty-three feet from the'centerline of Meadowbrook Avenue North be dedicated to the township for road purposes. 3) Soil testing is completed and approved for the two vacant parcels. 4) Drainage easements are dedicated around the wetland areas. 5) No deed will be approved for recording until all issues above have been satisfactorily completed. Findings are no negative comments from neighbors. Kevin Nickelson made a motion to approve the Planning Commission recommendations and the turn around is adequate as inspected by the Road Committee, Chairman, Kevin Nickelson. Paul Rasmussen seconded the motion and motion adopted unanimously. Meeting adjourned.
