7-01-97 tb,pcJuly 1, 1997 On the above date New Scandia Planning Commission held their regular monthly meeting. The following Town Board members were also present: Charles Nordin, Chairman, Paul Rasmussen, Vice Chairman, Kevin Nickelson, Robert Jensen and Dennis Seefeldt. Alan Burke Planning Commission recommends to the Town Board to deny the variance request to Alan Burke, 22080 Kirk Avenue, Scandia, MN 55073, Block 1, Lot 2, Williamsburg Plat. A variance of 20 feet to 10 feet on the ground that there is sufficient area to build a garage that wouldn't require a variance. Findings are that granting this variance would set a precedent for granting variances on new construction. Robert Jensen made a motion to accept the Planning Commission's recommendation as the structure can be placed on the lot without a variance. Dennis Seefeldt seconded the motion and motion adopted unanimously. Lee Debeau Planning Commission recommends to the Town Board to grant the variance's to Lee Debeau, 19039 Larkspur Ave., North, Marine, MN. 55047. Lot 5, Block 2, Holiday Beach 2nd Plat. A bluffline setback to construct a 24' x 34' garage on the grounds that it is the best location for the structure. Conditions are: 1) erosion be controlled on the bluffline, 2) the southeast corner of the garage has to be no more than 20 feet east of the bluffline and 10 feet from the side property line, 3) the garage color matches the house which will be painted white, and 4) the garage be one story. Findings are erosion and drainage will be improved and there is no objection from neighbors. Paul Rasmussen made a motion to accept the Planning Commission's recommendation to approve the variance request for Lee Debeau. Robert Jensen seconded the motion and motion adopted unanimously. Neal Hanson This hearing was tabled until the August 5, 1997 Planning Commission meeting. Shirley Seliger Planning Commission recommends to the Town Board to grant the following variance's to Shirley, Seliger, 2671 Midvale, Maplewood, MN. 55119. Lot 17, Block 4, Bliss Plat 1st Division. To construct a 111 x 28' porch addition on the south side of the page 2 home; a 10' x 10' entryway addition on the west side of the home; and a 22' x 30' detached garage: (1) Lot size- 1.5 acres required; .26 acres exiting (2) Lake setback - 100' required; 31' to porch addition and 53' to the garage (3) Road setback - 40' required; 26' proposed for the garage (4) Approval to construct the garage closer to the road than the house on the grounds that 1) the entryway addition on the roadside would meet the road setback requirement and would not have any negative impact on the view from the lake, 2) the porch addition would not extend any closer to the lake then the existing structure, 3) the garage is proposed closer to the road than the house, however that is common on lakeshore lots and actually preferable, and 4) all other setbacks would be met for this addition. Conditions are as follows: 1) the height of the addition shall not exceed the height of the existing cabin, 2) the two sheds on the northwest corner of the property be removed by the time the building project is complete, and 3) the remaining shed is to be 10 feet from the north property line and have a 20 foot road setback. Robert Jensen made a motion to accept the Planning Commission's recommendations for Shirley Seliger. Kevin Nickelson seconded the motion and motion adopted unanimously. Gravel Pit Inspections Dan Booren and Dennis Seefeldt inspected the gravel pits on June 30, 1997. Mr. Seefeldt reported there was no activity at the Bracht Pit. The road was in need of repair and the township has received complaints from neighbors about the road. At Barton pit the area was neat and clean, but there was a odor from the pit 1/2 mile away. Dresel Pit they saw no survey stakes on the north end, and this was to be surveyed 6 months ago. There is a 929' grade elevation required and they were below the grade by 3 to 6 feet. Some restoration had been done on the north slope; back - fill from County 52 Project was put there. The south slope had been reclaimed and reseeded last year. Now it has been remined, it is below grade and they are putting in back fill. Mr Booren will review the County's mining permit application for Bracht and comment to the Town Board. Charlie Benson, Melanie Trail, asked the Planning Commission to reconsider their denial of his request to build a boat garage. page 3 Mr. Hebert, Township Attorney informed Mr. Benson he has the right to submit another request six months after denial and go through the public hearing process again.
