The following present: Charles Nordin, Robert Jensen James Conlan Commission held their Board Members were also and Paul Rasmussen. Planning Commission recommends to the Town Board to grant the variances to James Conlan, 19186 Larkspur Avenue North, Marine, MN. 55047. Lot E of Registered Land Survey No. 72. To construct a 24 x 28 garage: 1)Lot size 11,200 square feet, 2) Rear yard setback 10 feet , and 3) Wetland setback 30 feet on the grounds that the present garage is inadequate. Conditions are no filling of wetland and the garage match the house in color. Findings are it is behind the house and least intrusive to the neighborhood and there were no complaints from neighbors. Robert Jensen made a motion to accept the Planning Commission recommendations for Mr. James Conlan. Paul Rasmussen seconded the motion and motion adopted unanimously. Jerome Fearing Planning Commission recommends to the Town Board to grant the Minor Subdivision to Jerome Fearing, 20200 Quinnel Avenue, Scandia, MN 55073. SW 1/4 of SW 1/4 of Section 19, Township 32, Range 20. To divide 16.53 acres into three parcels of 5.08, 5.87 and 5.58 acres on the grounds that all three of the parcels meet the minimum dimensional requirements of the ordinance and contain at least one acre of buildable land excluding all setbacks. Conditions are: 1) drainage easements are dedicated around the wetland area and along the creek. 2) Thirty-three feet from the centerline of Quinnell Avenue is dedicated for roadway purposes, and 3) one shed (205 square feet) is removed. Findings are it is the consensus of the Planning Commission that the angles delineated are best sites for lot lines, mound septic systems have been approved by the Washington County Department of Public Works, and no concerns from neighbors. Paul Rasmussen made a motion to accept the Planning Commission recommendation. Robert Jensen seconded the motion and motion adopted unanimously. Nancy Stratton/Rezone Maxwill Bay Mr. Fritz Knaack, Attorney representing Ms. Stratton, requested the Planning Commission and Town Board consider keeping all lakeshore lot sizes the same, whether platted or unplatted, when they revise the zoning ordinances. A letter was read from Dennis O'Donnell, Washington County Senior Land Use Specialist, stating the property is zoned A-2 which requires a five acre page 2 minimum lot. The property was platted in 1988 by Fred Rierman and each lot was at least five acres. Anyone purchasing the property in this development knew or should have known the property was zoned A-2. Land areas surrounding the Maxwill Bay Subdivision are also zoned with five acre minimums under the Township zoning. Ms. Stratton stated she was aware of the five acre lot size, but requested the Township be consistent with Washington County. Ms. Stratton would attend the Growth Management Task Force meeting. Neal Hanson Planning Commission recommends to the Town Board to grant the variances to Neal Hanson, 23255 Lofton Court North, Scandia, MN. 55073. Lot 12, Sandgren Addition. The following variances for a addition to existing homesite: 1) Setback 74 feet from 100 feet from the lake, 2) Lake Frontage 99.99 feet from 150 feet, and 3) Lot Size 23,585 square feet from 1.5 acres, on grounds that is the most reasonable use of the existing property. Conditions are the three season porch will not be constructed. Findings are no objections form neighbors, homes on adjacent properties are closer to the lake, the addition as proposed is no closer to the lake than existing deck, a new septic system, is proposed, a new well has been installed for a three bedroom system and is adequate for the house design, and the proposed 3.5 feet additional roof height will not add additional living space. Robert Jensen made a motion to approve the Planning Commission recommendation. Paul Rasmussen seconded the motion and motion adopted unanimously. The Township Board did discuss the porch addition and stated a three season porch is a nice addition to a home, but agreed not to include this in their motion. The following concepts were presented for review: Bonneyview Too, Ekdahl Estates and Glenfiddich, the public hearings for these plats will be September 23, and September 24. Jeff House/Rezone Request Mr. Jeff House requested a rezone from Conservancy to R-1 residential on a 13 acre parcel on the north side of Big Marine Lake. This parcel of land is landlocked and Mr. Hebert, Township Attorney stated a rezone could not be considered until it is determined how the landrwill be accessed.
