On the above date New Scandia Planning Commission held their
regular monthly meeting. The following Board Members were also
present: Dennis Seefeldt, Chairman, Paul Rasmussen, Vice
Chairman, Robert Jensen, Kevin Nickelson and Bruce McConoughey.
Ken Kopka-Variance
Planning Commission recommends the Town Board to grant the
variance's to Ken Kopka, 18420 Norell Avenue, Marine, MN 55047.
Lots 11 and 12 Erickson 2nd Addition. 1) Luke Setback 100 feet
to 40 feet; 2) Lot Size 1.5 acres to .54 acres; 3) Lake Frontage
150' to 102.19 feet; and 4) Road Frontage 150 feet to 100 feet.
To construct a addition to existing dwelling. On the grounds
that this is an expansion of an existing home and not a new
construction, the 201 Collector System could handle the
expansion, the septic tank location would be a problem if
structure were moved back and the garage would then be closer to
the lake than the house. Conditions are the driveway be 5 feet
off the Carroll property line and the snow removed be kept on
owners's property. Findings are neighbors do not object and the
house will be no closer to the lake than it is at the present
time.
Paul Rasmussen made a motion to accept the Planning Commission
recommendation. Kevin Nickelson seconded. Paul Rasmussen,voted,
yes, Kevin Nickelson, voted, yes. Robert Jensen, voted, no,
Dennis Seefeldt, voted no, and Bruce McConoughey, voted, no.
Motion failed.
Vernon Jellum-Minor Subdivision
Planning Commission recommends to the Town Board to approve the
Minor Subdivision for applicant Gregory Jellum, 14071 30th Street
North, Stillwater, MN 55082 and owner, Vernon Jellum, 13623 195th
Street, Marine, MN 55047. Part of Govt. Lot 2, Section 27,
Township 32, Range 20 West. To divide a 5 acre parcel from a 33
acre parcel, and the variance request to build a garage closer to
the road than the house on the grounds that it meets all zoning
and shoreland management ordinances. Conditions are: 1) drainage
easements be dedicated around the wetlands; 2) 33 feet from the
centerline of 195th Street be dedicated to the township for road
purposes; 3) the home is setback 100 feet from he OHW mark; 4) 30
feet from the bluffline; and 5) 75 feet from wetlands. Findings
are soil tests have been completed and approved, variances are
generally approve from garages closer to the road than the house
on lakeshore property and it would be heavily screened.
Robert Jensen made a motion to accept the Planning Commission
recommendation. Bruce McConoughey seconded the motion and motion
adopted unanimously.

Scott Duncan/Jean Larson Conditional Use Permit
Planning Commission recommends to the Town Board to grant the
Conditional Use Permit to owner Scott Duncan, 19707 St. Croix
Trail, Marine, MN 55047 and applicant, Jean Larson, 3052 Jamley
Avenue North, Lake Elmo, MN 55042. Block 10, Lots 4 and 5,
Revision of Vasa. The Conditional Use Permit shall be for a
period of one year to operate a painting studio on the grounds
it is a reasonable use of the property. Conditions are: 1) the
building shall not be enlarged; 2) signage shall be of the same
size, etc., that presently exists. Findings are the property has
been used for commercial purposes in the past.
Bruce McConoughey made a motion to accept the Planning Commission
recommendation. Robert Jensen seconded the motion and motion
adopted unanimously.
Robert Loughrey-Variance
Planning Commission recommends to the Town Board to grant the
variance to Robert Loughrey, 21363 Olinda Trail North, Scandia,
MN 55073. Lot 6, Scandia Addition and Part of Lot 2, County
Auditors Plat No. 6, for Lot size 2.5 acres to .56 acres for the
construction of a new home. Conditions are: 1) an additional
1,000 gallon septic be added and there is room for a backup
septic system; 2) the existing home be removed within 60 days of
issuance of a Certificate of Occupancy; (3 the smallest shed be
removed within 30 days of issuance of a Certificate of Occupancy;
and 4) the temporary canvas covered storage be removed in two
years. Findings are the road setback is improved.
Kevin Nickelson made a motion to accept the Planning Commission
recommendation. Paul Rasmussen seconded the motion and motion
adopted unanimously.
Gerald Moe -Variance
Planning Commission recommends the Town Board to grant the
variance to Gerald Moe, 132 Demont Avenue, #320, Little Canada,
MN 55117. Lots 25 and 26 Erickson 2nd Addition. The following
variances to construct a new dwelling: 1) Lake Setback 1.5 acres
to 23,000 square feet existing; 2) Lake Setback 100 feet to 90
feet proposed; 3) Lot Width 150 feet to 92 feet existing; and 4)
Road Frontage 150 feet to 89 feet existing on the grounds that
this is a reasonable use of the property. Conditions are the
minimum floor elevation be 946.5 feet and that the home will be
connected to the 201 Collector System. Findings are the lot has
been a parcel of record for a long time.

Robert Jensen made a motion to accept the Planning Commission
recommendation. Bruce McConoughey seconded the motion and motion
adopted unanimously.
Jeff House -Bluffs Of East Bay Final Plat Approval
Planning Commission recommends to the Town Board to grant final
plat approval Bluffs of East Bay for Jeff house with the grounds
this is a reasonable use of the property. Conditions are: 1)
Metal barns be removed- the large barn may remain; 2) covenants
and restrictions are recorded prior to the sale of any lots.
Findings are the required specifications of the township have
been meet.
Paul Rasmussen made a motion to accept the Planning Commission
recommendation. Bruce McConoughey seconded the motion and motion
adopted unanimously.
