On the above date New Scandia Planning Commission held their
regular monthly meeting. The following Board Members were also
present: Dennis Seefledt, Chairman, Paul Rasmussen, Vice
Chairman, Robert Jensen, Kevin Nickelson and Bruce McConoughey.
Chris and Diane Ness
Planning Commission recommends to the Town Board to grant
the following variances to Chris and Diane Ness, 18440 Norell
Avenue, Marine, MN 55047. Lot 8, Erickson Addition. 1) Lot size
1 1/2 acres required to 11,736 square feet; 2) Lake setback 100
feet to 80 feet; 3) Lot width at water 150 feet to 50 feet; 4)
Road frontage 100 feet to 50 feet; 5) Road setback 40 feet to
23 feet. On the grounds that it is a reasonable use of the
property. Findings are neighbors support the variance request,
no negative comments from neighbors, the house cannot be moved
any further from the lake than what is proposed due to septic
tank location.
Paul Rasmussen made a motion to approve the Planning Commission
recommendation. Kevin Nickelson seconded the motion. Mr. Jensen
and Mr. McConoughey voiced negative statements regarding the lot
size, and questioning if a deck is a hardship. Mr. Nickelson
stated that this lot has not been filled, but the neighbors lots
have been filled when this was allowed. Dennis Seefeldt, yes,
Paul Rasmussen, yes and Kevin Nickelson, yes. Robert Jensen,
opposed and Bruce McConoughey, opposed. Motion adopted.
Richard and Aina Busman
Planning Commission recommends to the Town Board to grant the
variance to Richard and Aian Burgman, 625 Prospect Drive,
Waterloo, Iowa 50701. Property location 12130 Lakamaga Trail,
that part of the N 1/2 of Govt. Lot 2, Section 29, Township 32.
The variances required for reconstruction of the decks and
construction of screen porch and connecting deck are: 1) Lake
setback 100 feet to 63 feet; 2) Road frontage 150 feet to 90
feet; 3) Lake frontage 150 feet to 80 feet. On the grounds that
the present deck is a danger to users new construction is
preferred to repair of existing deck. Conditions are the
screened porch is never converted to an enclosed porch. Findings
are this will be no closer than the existing deck with the
exception of the additional 1 foot overhang.
Paul Rasmussen made a motion to accept the Planning Commission
recommendation. Kevin Nickelson seconded the motion.

The Town Board held a discussion regarding the closeness to the
lake, but the rebuilding would improve the property, but also the
view from the lake would be hindered. Mr. Hebert stated there is
no hardship and this would be violating the setback.
The Town Board voted that Mr. Richard Burgman can rebuild the
deck, but not the screen porch. Dennis Seefeldt, yes, Kevin
Nickelson, yes, Robert Jensen, yes and Bruce McConoughey, yes.
Paul Rasmussen, no. Motion failed.
Kevin Nickelson made a motion to approve the Planning Commission
recommendation except the building of the screen porch. Robert
Jensen seconded the motion. Dennis Seefeldt, yes, Robert Jensen,
yes, Kevin Nickelson, yes, Bruce McConoughey, yes. Paul
Rasmussen abstained. Motion approved.
