On the above date New Scandia Planning Commission held their
regular monthly meeting. The following Board Members were also
present: Dennis.Seefeldt, Chairman, Paul Rasmussen, Vice
Chairman, Michael Hinz and Robert Jensen.
Zoning Code Amendments
The Planning Commission discussed five changes to the zoning
ordinance.
1. To decrease the amount of overhang to the zoning ordinance.
2. To increase the minimum lot size of the first tier of lots in
the Shoreland Overlay District for natural environment
lakes to a five -acre minimum.
3. To rezone the property north of Highway 97 east and west of
County Road 3 from General Business to Retail Business.
4. To allow further subdivision of five -acre lots on
Recreational Lakes.
5. Add to zoning code that subdivision approval is not required
in cases where the new lot and resulting lots created exceed
20 acres and have 500 feet of frontage on a public road.
David Hebert, Attorney stated the Shoreland Overlay District
language needs to be clarified in regards, Washington County or
New Scandia Township as their is a difference between the two
Shoreland codes. Goose Lake is a natural environment lake, and
this lake, needs to be treated differently as this lake is in the
Village Center and the this allows 2.5 acre lots.
Planning Commission recommends to the Town Board hold a public
hearing to amend the Zoning Ordinance for New Scandia Township to
decrease the amount of overhang required on a building from two
feet to one foot.
Michael Hinz made a motion to hold a Public Hearing on January 4,
2000 to consider the change in the Zoning Ordinance Section 9.13,
Chapter Two. Paul Rasmussen seconded the motion and motion
adopted unanimously.
Anna Crain/Variance
Planning Commission recommends to the Town Board to grant the
variance request for Anna Crain, 22640 Nolan Avenue, Scandia, MN
5.5073. NW 1/4 of SW 1/4 of Section 3 and part of the NE 1/4 of
SE 1/4 of Section 4, Township 32, Range 20. For road frontage
from 300 feet to 40 feet on the grounds it is an existing parcel
with no other options for access. Conditions are no additional
subdivision without further public road access, driveway

construction is centered within the easement so there is a
minimum 5.foot setback from the property lines, and necessary
wetland permits be obtained prior to construction of driveway.
Findings are this was hardship created by Washington County.
Robert Jensen made a, motion to approve the recommendation for
road frontage for Anna Crain. Paul Rasmussen seconded the motion
and motion adopted unanimously.
Barry Farver/Sherwood Acres Two Plat
Planning Commission recommends to the Town Board to grant final
plat approval for Sherwood Acres Two for Ellen Farver and Barry
Farver on grounds that it meets the provisions of the development
code. Conditions are: 1)a title opinion be submitted prior to
the final signing of the plat; 2)the town engineer approve
drainage and road plans; 3)a development agreement be prepared
for the road and any other construction; 4)a letter of credit be
filed if construction occurs after plat approval; 5)obtain
township approval for protective covenants, easements and
restrictions; 6)park dedication be cash in lieu of land; and 7)
soil testing be approve. Findings are it is a reasonable use of
the property.
Paul Rasmussen made a motion to approve the Planning Commission
recommendation for the final plat approval for Sherwood Acres
Two. Robert Jensen seconded the motion and motion adopted
unanimously.
Tri-Star Trucking/Charles Schwartz
Planning Commission recommends to the Town Board to invite Mr.
Schwartz by letter to the December 21, Town Board Meeting to
discuss the complaints received and request written proof that
he has met the conditions of the permit or his permit will be
discontinued.
The board directed the township office to send Mr. Schwartz a
letter and request his attendance at the December 21, Town Board
and request the information that he has meet the conditions on
the Conditional Use Permit.
