12-05-00 tb,pcDecember 5, 2000 On the above date New Scandia Planning Commission held their regular monthly meeting. The following Board Members were also present: Chairman, Dennis Seefeldt, Vice Chairman, Paul Rasmussen, Michael Hinz, John Martineau and Kevin Nickelson. Tom Boesel-Conditional Use Permit Planning Commission recommends to the Town Board that they grant a transfer of Tom Boesel's Conditional Use Permit for a landscaping andreconditioning and sales of used farm equipment business to 21060 St. Croix Trail North on the grounds of the unique conditions of the business it's a continuation of a previous existing use, and there have been no complaints. Paul Rasmussen made a motion to approve the Planning Commission recommendation for the Conditional Use Permit for Tom Boesel. Michael Hinz seconded the motion and motion adopted unanimously. Jean Womack -Conditional Use Permit Planning Commission recommends to the Town Board that the zoning be verified, clarify who has zoning authority, any physical expansion will require relocation to another suitably zoned area, and consider requiring the paving area and remove the trailer on site. Kevin Nickelson made a motion to accept the Planning Commission recommendation with the following changes: The Conditional Use Permit shall expire in five(5) years with the following findings: (1) this is not a home based business; (2) it is commercial business in a area zoned agriculture;(3) the township will not require to pave the parking area;(4) the township will not require to remove the trailer. Michael Hinz seconded the motion and motion adopted unanimously. Steve Yehle/Lot Line Mr. Yehle presented information on recreational easement requesting that this could be conveyed to Parcel A. A survey was presented on the home next door that he is purchasing. Mr. Hebert had reviewed Mr. Yehle information and he suggested that the township could wavier the Minor Subdivision. Paul Rasmussen made a motion to wavier the Minor Subdivision for Steve Yehle property designated for a recreational easement to Parcel A. The two parcels could not be sold in the future separately from each other. Kevin Nickelson seconded the motion and motion adopted unanimously. Peter Nielsen -Minor Subdivision Planning Commission recommends to the Town Board to grant the Minor Subdivision to Peter C. and Ann M. Nielsen, 13160 2301h Street north, Scandia, MN 55073. SW '/4 of the SE'/4 of Section 4, Township 32, Range 20. To divide a nominal 40-acre parcel into two parcels of 20.06 acres (Parcel A) and 18.43 acres (Parcel) B, grant a variance on Parcel B for Road Frontage from 160 feet to 75 feet proposed, and allow an accessory building on Parcel B to be 70 feet from the south property line on the grounds this is a reasonable use of the property. Conditions: 1) thirty-three feet on the south portion of both parcels be dedicated to the township for road purposes2)septic system location be approved by the County for Parcel B;3) the cul-de- sec be approved the Township Engineer. John Martineau made a motion to approve the recommendation by the Planning Commission for the Minor Subdivision for Peter C and Ann Nielsen. Michael Hinz seconded the motion and motion adopted unanimously. Page 3 John Jackson -Minor Subdivision Planning Commission recommends to the Town Board to approve the Minor Subdivision request for John and Carolyn Jackson, 15297 Thurston Lane SW, Tigard, Oregon 97224. That part of the East Half of the Southeast Quarter of Section 9, Township 32, Range 20 W, lying northerly of the centerline of Oakhill Road North. To divide 26.75 acres in to two parcels of 3.0 acres and one parcel of 20.75 acres on the grounds this is a reasonable use of the property. Conditions are: 1)a development agreement is submitted and approve by the Town Board that includes the transferring and restricting density of the parcel to the south;2)the County approves the septic location;3)thirly-three feet is dedicated to town for road purposes the full length of the property on both Nolan Avenue and Oakhill Road. Michael Hinz made a motion the approve the Planning Commission for the Minor Subdivision for John and Carolyn Jackson.
