3-21-00 tbMarch 21, 2000 New Scandia Town Board meeting was called to order by Clerk, Dolores Peterson. Ms. Peterson gave the Oath of Office to Supervisor, Dennis Seefeldt, John Martineau and Kevin Nickelson at 7:00 p.m. before the payment of vouchers. The following Board Members were present: John Martineau, Kevin Nickelson, Paul Rasmussen and Dennis Seefeldt. Michael Hinz was absent. Clerk, Dolores Peterson stated the first order of business was to elect a Chairman and Vice Chairman for the year of 2000. Dennis Seefeldt was elected Chairman and Paul Rasmussen was elected Vice Chairman. CONSENT AGENDA Paul Rasmussen made a motion to approve the following consent agenda with the following amendment. Paul Rasmussen made the motion to approve the Bracht Bros. Mining Permit for the minutes of the Planning Commission of 02/29/00. Kevin Nickelson seconded the motion. 1) Call to order 2) Clerk's minutes have been presented for Town 02/15/00 and 02/29/00 Town Board and 02/29/00 Planning Commission 3) Balance February 1, 2000 $1,184,762.62 Receipts 1,192,877.52 Expenditures 137,550.73 Balance of February 29,00 $2,240,098.41 Kevin Nickelson seconded the motion and motion adopted unanimously. Sheriff James Frank Sheriff James Frank reviewed the possibility of applying and receiving a "Cops Grant". Sheriff Frank stated major crimes are on the decline in the county, but nuisance crimes, of vandalism and speeding are concerns for the community. He stated that a assigned officer like Ms. Simonson is a asset to the community as the officer will get to know the people and the problems of the community. It is Presidents goal to have more Police Officers on the streets. The grant is a total of $75,000.00 over a three (3) year period and the approximate cost for a police officer for one year would be $62,000.00 to $65,000.00. Paul Rasmussen made a motion to hold a special meeting on March 30, 2000 at-7o00 p.m. to discuss this issue. John Martineau seconded the motion and motion adopted unanimously. page 2 Steve Soence/Fire Chief Mr. Spence stated May Township had concerns how New Scandia Township and New Scandia Fire and Rescue Department arrived at the figure for fire protection for their township, so Mr. Spence suggested to avoid problems in the future to figure the fees on a per capita basis. Kevin Nickelson made a motion to set a policy that in the future New Scandia Fire Rescue Department charge May Township and Franconia Township on a per capita basis for fire protection. Paul Rasmussen seconded the motion and motion adopted unanimously. Erickson Cartway/Public Hearing A Public Hearing was held in the matter of the petition of Edward L. Erickson and Elizabeth Erickson for the Establishment of a Cartway. The petitioners are the owners of the SW 1/4 of Sw 1/4 of Section 22,E Township 32, Range 20 West, a tract of land containing —i acres and said tract has no reasonable access thereto except over the land of others. The petitioners request that a cartway be established over and across part of the NE 1/4 of NW 1/4 of Section 28, Township 32, Range 20, owned by Milton Ambourn and Rita Ambourn. Also across part of SE 1/4 of SE 1/4 of Section 21, Township 32, Range 20, owned by Barbara Sanders and Charles Kummer. All the members of the Town Board viewed the property at 6:15 p.m. on this date. David Hebert, Township Attorney stated the affected property owners all received notice, but the Ambourn's did not receive the notice in time for the 10 day requirement. Mr. Hebert stated to fill the requirement the Public Hearing would have to continue to April 4, 2000 at 7:00 p.m. Mr. Charles Kummer a affected property owner disturbed copies of the Minnesota Statutes 1999, table of contents for Chapter 164. He stated that in contents 164.08 Cartways, Subdivision No. 2 it states the following: 1) Upon petition presented to the town board by owner of a tract of land containing at least five acres, who has no access thereto except over the lands of others. Mr. Kummer reference this section as Mr. Kummer states Mr. Erickson has access from his homesite on 205th Street. This cartway is close to wetlands, including a large and small pond and also the area is a home for wildlife. The Kummer land is very narrow less then 9 acres and it would reduce the property value. Mr. Kummer expressed that Mr. Erickson has used his access on 205th Street for the past 50 years and this access is well established. page 3 Ms. Rita Ambourn stated that this pond is one of the prettiest ponds in Scandia Township and once the environment is destroyed it is gone forever. Ms. Barbara Sanders stated if that is the way the cartway must be established there should be some conditions and I understand he wants to sell his property, but we should be able to keep our property. Is this a matter of profitability and because of profit our land should not be taken. Mr. Erickson could build a road back to the property from 205th Street.. Kevin Nickelson, Supervisor stated he was concerned about the environment with the access over the land of the property owners, but Mr. Erickson would have to construct a very lengthy road and the cost would be approximately $125,000.00 to $200,000.` Ms. Colleen Firkus questioned if Mr. Erickson would not have to submit a concept plan for the entire property as to how it would be developed in the future. Mr. Erickson stated if he would have to construct a road from 205th Street the entire property would have to be subdivided and there would be a lot of homes constructed. With the cartway there would only be one homesite. His plan is not to developed now and is intending to place the farm in the Historical Register of Farms. At this point the Public Hearing was adjourned until the hearing will be reconvened on April 4, at 7:00 p.m. Tom Peterson/Township Engineer Problems with the Froberg and Kees driveways on Pilar was discussed and Mr. Seefeldt stated that Frobergs have corrected the problems with their driveway, but Kees have not corrected the problems with the driveway. It was agreed the Town Board would look at the driveway and drainage problem with Kees driveway. E. H. Renner Pay Request No. 6 Paul Rasmussen made a motion to approve the Pay Request No. 6 for E. H. Renner in the amount of $10,402.50. Kevin Nickelson seconded the motion and motion adopted unanimously. Septic System Quote For New Scandia Fire Rescue/Public Works Bldg The following quotes for the New Scandia Fire Rescue/Public Works Building were received: 1) Peterson Excavating; $8335.00, 2) Scandia Trucking, $7485.00; 3) C and B Excavating, $7600.00; 4) 8093.00. page 4 Kevin Nickelson made a motion to award the contract to Scandia Trucking in the amount of $7485.00 for the construction of the septic system and holding tanks for the New Scandia Fire/Rescue and Public Works Building. John Martineau seconded the motion and motion adopted unanimously. Informational Meeting For 188th Street, Norell and Newqate John Martineau made a motion that a Informational Meeting be held on April 11, 7:00 p.m. to review the proposed widening and improvements for 188th Street, Norell and part of Newgate by Big Marine Lake. Kevin Nickelson seconded the motion and motion adopted unanimously. Certificate of Compliance/Goehl Motors, Countryside Arts, Arvold Chiropractic Paul Rasmussen made a motion to approve the Certificate of Compliance for Goehl Motors, Countryside Arts, Arvold Chiropractic with the following amendment to the Certificate for Goehl Motors: To change the wording on the Certificate of Compliance from Washington County to state: 1)There maybe one or two vehicles displayed for sale in the area at one time. Kevin Nickelson seconded the motion and motion adopted unanimously. 201 Septic System/SCADA Kevin Nickelson made a motion to appoint John Martineau to represent the 201 Septic System/SCDA for New Scandia Township. Dennis Seefeldt seconded the motion and motion adopted unanimously. The township office informed the Town Board that they would prefer that Washington County Department of Health/Pete Genzel continue with the administering the 201 Project with pumping, repair issues and preparing the billing for the township office. Mr. Genzel figures the fees for the yearly billing, but the township office prepares the billing, mailing and collecting. Paul Rasmussen made a motion to inform Washington County that New Scandia Township wants to continue the administering of the 201 Project by Washington County Department of Health. Dennis Seefeldt seconded the motion and motion adopted unanimously. Tour of Township Roads Paul Rasmussen made a motion that the New Scandia Township Board tour the township roads on April 1, 9:00 a.m. John Martineau seconded the motion and motion adopted unanimously. page 5 Planning Commission Appointments The clerk stated that the terms of David Schad and Peter Schwartz were expired on the Planning Commission. Both Mr. Schad and Mr. Schwartz were appointed to fill unexpired terms, so therefore they could be considered for reappointment. Paul Rasmussen made a motion to reappoint David Schad and Peter Schwartz to the Planning Commission with expiring in 2005. Kevin Nickelson seconded the motion and motion adopted unanimously. Carnelian Marine Watershed Board Appointment Kevin Nickelson made a motion to inform the Washington County Administation to consider the reappointed of Michael White to the Carnelian Marine Watershed Board. John Martineau secnded the motion and motion adopted uanimously. Washington County Soil and Water Conservation District The Department of Natural Resources request review and comments for a application by Washington County Soil and Water Conservation District for bioengineering practices. The Town Board stated they would endorse the proposal. Tree Planting/Cub Scout Troop 173 Paul Rasmussen made a motion to approve the purchase of tree transplants from Washington County Soil and Conservation in the amount of $168.00. The trees shall be planted on the east and west side of New Scandia Fire Rescue/Public Works Department. John Martineau seconded the motion and motion adopted unanimously. Legal Paper For The Year Of 2000 The following quotes were received for the legal paper for the year of 2000: ECM Publishers, $5.25 a column inch and County Messenger $4.40 a column inch. John Martineau made a motion to designate the Country Messenger as the legal paper for the township for the year of 2000. Paul Rasmussen seconded the motion and motion adopted unanimously. Weed Inspector For The Year of 2000 Paul Rasmussen made a motion to appoint John Morrison as the Weed Inspector for the year of 2000. Dennis Seefeldt seconded the motion and motion adopted unanimously. page 6 Depository For The Year of'2000 Paul Rasmussen made a motion to approve the following depositories for the year of 2000 Security State Bank, County Bank, and the 3M Fund through the League of Minnesota Cities. Kevin Nickelson seconded the motion and motion adopted unanimously`. Forest Lake Youth Service Bureau Kevin Nickelson made a motion to donate $4500.00 for the year of 2000 to the Forest Lake Youth Service Bureau.
