6-20-00 tbJune 20, 2000 The regular monthly meeting of New Scandia Town Board was called to order by Chairman, Dennis Seefeldt. The following Board Members were also present: Dennis Seefeldt, Chairman, Paul Rasmussen, Vice Chairman, Michael Hinz, John Martineau and Kevin Nickelson. CONSENT AGENDA Paul Rasmussen made a motion to approve the following consent agenda: 1. Call to order 2. Clerk's minutes have been presented for 05/16/00, 05/24/00, 06/06/00 Town Board and 06/06/00 Planning Commission 3. Balance April 31, 2000 $2,230,043.38 Receipts 64,774.86 Expenditures 97,659.32 Balance May 1, 2000 $2,197.158.92 Kevin Nickelson seconded the motion with the following correction on the June 6, 2000, Town Board Meeting under Parking Lot on Outlot A/Bonneyview. Dennis Seefeldt, yes, Michael Hinz, yes, John Martineau, yes, Kevin Nickelson, opposed. Motion adopted. Motion adopted unanimsoulsy on approval on consent agenda. Sheriff Department/Captain McGlothlin Captain McGlothlin presented the Agreement -Law Enforcement Services Contract between New Scandia Township and Washington County for Police Protection. Captain McGlothlin stated the appointed Deputy should be on duty approximately by the 15th of July or the lst of August. John Martineau made -a motion to sign the Agreement -Law Enforcement Services Agreement with Washington County. Paul Rasmussen seconded the motion and motion adopted unanimously. Fire Chief/Steve Spence May Township had issued a check to New Scandia Township in the amount of $12,000.00 for the year of 2000 and it appears that there is a difference in legal opinions from both townships. Mr. Seefeldt thought it maybe reasonable to accept the $12,000.00 and negotiate for the following year. Mr. Nickelson stated that May Township should pay the fair price and that New Scandia Township does not have to subsidize May Township. Paul Rasmussen made a motion to approve the Exclusive Consignment and Sales Agreement with Fire Trucks Plus, Inc. for the sale of page 2 of the old fire truck. Kevin Nickelson seconded the motion and motion adopted unanimously. Park and Recreation/Mike White Mr. White stated that the cracks in the concrete on the skating rink must be repaired this summer. Mr. White agreed he would review this item. Mr. White reported on the acquisition of the land by the Hay Lake School from Washington County. The Park and Recreatoin would submit a plan for the property and hold a Public Hearing to inform the adjoining property owners. Township Engineer/Tom Peterson A disscussion was held regarding the stripping of township roads. Residents in the plat of Holiday Beach and Bliss Addition stated they would like to have the roads stripped in that area. It was the sew s of the board that stripping of roads shall only be the collector roads. Chad Carpenter/Outlot C/Bonneyview John Martineau Carpenter for Paul Rasmussen unanimously. made a motion to reconsider the request by Chad the filling of a basin on Outlot C, Bonneyview. seconded the motion and motion adopted Dennis Seefeldt made a motion to recommend approval to fill the wetland on the property owned by Chad Carpenter, Outlot C, Bonneyview with the following conditions: (1) The SCWD has found the wetland was created by "actions, the purpose of which was not to create wetlands." (2) The SCWD recommends that filling be permitted. (3) The minutes of the planning meeting in September 1988 indicate that the preliminary plat was presented with the representation that Outlots C and B would be sold with the last remaining property as they were not buildable. To differentiate buildable from nonbuildable lots, Outlot A was, renamed Lot 4 to permit possible future redevelopment. (4) The preliminary plat and final plat of Bonneyview disclose significant wetland area coverage on Outlots A, B, and C. (5) Soil tests and proposed building sites are shown only on numbered lots in the proposed plat. (6) The wetland areas on Outlot B and C are dedicated as drainage easements in the final plat. (7) At the preliminary plat of Bonneyview also discloses that Outlot C is the termination point of drainage easement Page 3 serving a significant area of Block 1,`Bonneyview. (8) The plat as finally approved by the Planning Commission and Town Board contemplated residential structures on the numerically designated lots only. (9) Section 9.2 of the Shoreland Management Ordinance prohibits grading or filling within the bluff impact zone or shore impact zone. Thus, filling should not be permitted within the wetland area. (10)The Outlots have been tied to other lots within Bonneyview to insure that the Outlots would not be forfeited for nonpayment of real estate taxes. (11)It appears that Outlots A, B and C were presented by the owners at the time of the submission of the plat of Bonneyview as wetland lots and considered by the Planning Commission and Town Board as wetlands serving Block 1, Bonneyview in granting approval of the plat. Paul Rasmussen seconded the motion with the addition that Mr. Carpenter would present his request to the Washington County Board of Adjustments and Appeals. Motion adopted unanimously. Vernon Henk/18630 Norrell Avenue Ms. Henk was questioning the removal of the cabin on 18630 Norell Avenue regarding the road project of Norell and 188th Street. This cabin was built on the road -right-of-way. Ms. Henk was directed to attend the TIF meeting on June 26, 2000 in the New Scandia Township Chambers. BMX Track/Certificate of Compliance Kevin Nickelson a motion to approve the Certificate of Compliance for the BMX Track and the township provide a container at the site. John Martineau seconded the motion and motion adopted unanimously. Crabtrees Kitchen/Certificate of Compliance Paul Rasmussen made a motion to approve the Certificate of Compliance for Terry and Beverly Bennett, 19713 Quinnell Avenue, Scandia, MN for Crabtrees County Store. Michael Hinz seconded the motion and motion adopted unanimously. Food Shelf Location Due to the remodel construction project for Elim Lutheran Church it is impossible for the Food Shelf to operate under these conditions. Members had contacted Mr. Seefeldt regarding the possibility of using space in the Community Center. page 4 Paul Rasmussen made a motion to allow the Food Shelf to use space in the Community Center for approximately five (5) months. Michael Hinz seconded the motion and motion adopted unanimously. Ekdahl Estates Tree Removal Mr. Seefeldt informed the board that Ms. Dietrich Developer of Ekdahl Estates agreed to some mitigation to reestablish the trees which were removed from the bluff impact zone. This would include the planting of trees on five (5) lots with a total of 10 inch diameter trees. Michael White Issuing of Building Permits Within the Watershed District Mr. White requested a standard process for the issuing Building Permits within the Carnelian Marine Watershed District with certain conditions. Mr. White requested the Building Inspector, Al Goodman be informed to notify Carnelian Marine Watershed District, before the permits are issued. American Engineering Paul Rasmussen made a motion to approve the payment of $1473.00 to American Engineer of cement testing. John Martineau seconded the motion and motion adopted unanimously. Landscaping Authority Paul Rasmusssen made a motion to authorize Mr. Dennis Seefeldt in amount of up to $3000.00 for Maintenance/Landscaping on township grounds. Kevin Nickelson seconded the motion and motion adopted unanimously. Gas Main Install Paul Rasmussen made a motion to approve the Gas Main installation for NSP Gas on Pomroy Avenue/Maple Hills Plat. John Martineau seconded the motion and motion adopted unanimously. GTE Phone Company Buried Cable Paul Rasmussen made a motion to install buried telephone cable for GTE Phone Company on Pilar, Quality Trail, and a temporary service drop on 195th and Lakamaga Trail.
