On the above date New Scandia Township Planning Commission held
their regular monthly meeting. The following Board Members were
also present: Dennis Seefeldt, Chairman, Paul Rasmussen, Vice
Chairman, Michael Hinz, John Martineau and Kevin Nickelson.
Michael W.Kennedy/Minor Subdivision
Planning Commission recommends to the Town Board to grant the
Minor Subdivision to Michael W. Kennedy, 4129 Thornhill Lane,
Vadnais Heights, MN 55127. That part of S 1/2 of the NE 1/4 of
the SE 1/4 of Section 7, Township 32, Range 20. The subdivision
be approved on the grounds that this is an applicable use of this
property. Conditions are: 1)the buildable area is shown on a
survey to include;a.house locations, b.setbacks required,
c.buildable areas delineated to assure minimum area requirements
are met prior to subdivision, d.the woodlands on the site will be
preserved;2)Driveway access points, as approved by Washington
County, are shown on a Minor Subdivision survey;3)Drainage
easements are added around the wetland areas and perimeter of the
lots as required by the Engineer;4)Any necessary grading is
submitted via a grading plan to the Town Engineer and must be
approved by the Engineer prior to any earthwork;5)Park dedication
is cash -in -lieu of land for three lots;6)Septic areasapproved by
Washington County;7)A development agreement is prepared, signed
and reviewed by the Township for approval;and 8)Sixty feetof
right-of-way is dedicated for County Road 15. Findings are this
is a reasonable use of this property.
Paul Rasmusen made a motion to accept the Planning Commission
recommendation for the Michael W. Kennedy Minor Subdivision.
Michael Hinz seconded the motion and motion adopted unanimously.
Lewis Berge/Road Frontage Question
Mr. and Ms. Lewis Berge have owned two adjacent parcels since
1972;a five -acre parcel with a home and a 20+ acre parcel. The
larger parcel has adequate road frontage on Manning Trail North.
The five -acre parcel has a 66 foot wide easement to the home and
that easement has been shared for 27 years with a neighbor. Mr.
Berge was questioning if he could sell the 20+ acre parcel
separate from the 5-acre parcel and have grandfathered access to
the 5 acre parcel. The Town Board, Planning Commission and
Township Attorney, David Hebert were in agreement that the 5 acre
parcel could be grandfathered with the easement and the large lot
could be sold separately. Findings are these are separate
parcels of record with permitted driveway access to the 5 acre
parcel, the driveway has been shared for almost 30 years and the
lots more than meet the density requirements. If Mr. Berge
wanted to divide the 20+ acre parcel and add to the 5 acre
parcel, Mr. Berge would be required to put in a town road for

access to the new parcel.
Conditional Use Permits to Certificate of Compliance
The Planning Commission recommends to the Town Board that they
change some Conditional Use Permits (CUP) to Certificate of
Compliance (CC) based on committee recommendations. Starting in
October 2000, all CUPS are to be reviewed every other year (even
years). The Planning Commission would conduct site visits in the
summer and have a public hearing in October to review the CUPs,
insure CUPs could have a shorter period initially, but would be
reviewed on the same schedule. After further discussion with the
Town Board, the Planning Commission also recommended businesses
that did not have CUPS be reviewed for ordinance violations or
negative impacts on the community. The following is a list of
