The New Scandia Town Board held their regular monthly Planning Commission meeting on this
date. Chairman Dennis Seefeldt called the meeting to order. Also present were Vice Chairman
Paul Rasmussen, Mike Hinz, Kevin Nickelson and John Martineau. The minutes from the
August 1 meeting were approved with corrections.
EDWIN MARSH — MAJOR SUBDIVISION BELLE TERRE
Planning Commission recommends to the Town Board that they approve the major subdivision
request of Edwin & Florence Marsh, 15580 240th Street North, Scandia, to divide an 18.9-acre
parcel into Lot 1 (8.88-acres), Lot 2 (5.01-acres), and Lot 3 (5.01-acres) as presented on the
survey dated August 18, 2000. Legal: Part of the Northwest Quarter, Section 1, T32N, R20W.
On the grounds that the property is mostly in Chisago County and falls under their conditions
with road access in New Scandia Township. Conditions are: 1) the plat be recorded in both
counties and a development agreement be recorded to tie the lots together on deeds for each lot;
2) the property south of 2401h Street be conveyed to the Township for road purposes; 3) no
structures can be built on the County line; 4) coordinates on section corners must be submitted to
the Surveyor's Office; and S) there be one driveway for Lots 2 and 3. Findings are this is a
reasonable use of the property. Paul Rasmussen made a motion to accept the Planning
Commission recommendation. John Martineau seconded the motion and the motion
carried unanimously.
PATRICK CASSIDY — VARIANCE FOR ADDITION TO DWELLING
Planning Commission recommends to the Town Board that they approve the variances requested
by Applicant Patrick H. Cassidy, 13331 Cathy Lane, Plainfield, IL 60544, and property owner,
Jerome W. Cassidy, 12420 228th Street, Scandia, for Lake Setback from 100 feet to 64 feet
existing and Lot Size from 2.5 acres to 38,000 square feet to construct an addition to an existing
dwelling located at 12420 228th Street. Legal: Lot 8, Holstens Shores, Govt Lot 1, Section 9,
T32N, R20W. On the grounds that the new addition will not come closer to the lake than the
dwelling and the addition will not alter the character of the locality. Findings are this will not
impact the shoreline setback and is a reasonable request. John Martineau made a motion to
accept the Planning Commission recommendation. Mike Hinz seconded the motion and the
motion carried unanimously.
PAUL LENZ — VARIANCE TO CONSTRUCT A NEW HOME
The Planning Commission recommended to the Town Board that they deny the variance request
of Applicant Paul and Elizabeth Lenz, 13860 236th Street N, Scandia, and property owners Alvin
and Lois Lenz, 18939 Newgate Ave N, Marine on St. Croix, for a Lot Size variance from 2.5-
acres to 29,544 square feet and a Front Yard Setback variance from 40 feet to 36 feet to deck.
Legal: Lots 6 & 7, Block 2, Gerryvonn Marine Garden. On the grounds that the lots are in
common ownership with adjoining lots and are "married", therefore, they cannot be subdivided.
Kevin Nickelson made a motion to accept the Planning Commission recommendation citing
Chapter 1, Section 12.4, and Subdivision 4 of the Development Code. John Martineau
seconded the motion and the motion carried unanimously.

CONDITIONAL USE PERMITS REVIEWED
AM-TEC Designs, Hawkinson Business Park. All conditions met. No recommendations by the
Planning Commission.
Peterson Excavating, Hawkinson Business Park — The Planning Commission recommends a
letter be sent by the Town Board requesting compliance with their CUP by having the debris
cleaned up and blacktopping done within 60 days. Paul Rasmussen made a motion to accept
the Planning Commission recommendation. John Martineau seconded the motion and the
motion carried unanimously.
P.N. Products, Hawkinson Business Park. The Planning Commission recommended to the
Town Board that a letter be sent requiring amendment of current CUP in October 2000 for
temporary suspension of conditions until projected date of construction completion not to exceed
8 months. Follow-up site inspection for compliance is recommended about April 1, 2001. Kevin
Nickelson made a motion to have the town send a letter stating P.N. Products must comply
with conditions of their CUP or apply for expansion and building permit within 60 days, or
CUP would be revoked. P.N. Products would also have to meet with the Architectural and
Landscape committee as part of the expansion. Denny Seefeldt seconded the motion. The
motion carried with Kevin Nickelson, Denny Seefeldt, Paul Rasmussen and John
Martineau voted yes. Mike Hinz abstained.
LeRoux All Season, 21240 Olinda Trail. The Planning Commission recommended to the Town
Board that they give LeRoux one year to remove the trailer. Paul Rasmussen made a motion to
accept the Planning Commission recommendation. Kevin Nickelson seconded the motion
and the motion carried unanimously.
Tri-Star Trucking, 21239 Olinda. The Plamiing Commission recommended to the Town Board
that a letter be sent citing violations, requiring clean-up within 30 days and henceforth full
compliance with conditions of CUP and notification that otherwise the CUP will not be renewed
or extended. Paul Rasmussen made a motion request a`detailed plan be submitted for
screening of outside storage, including building materials. Denny Seefeldt seconded the
motion and the motion carried unanimously. John Martineau made a motion to send a
letter to Tri-Star Trucking citing violations of the CUP for public record. Denny Seefeldt
seconded the motion and the motion carried unanimously.
