WASHINGTON COUNTY, MINNESOTA
RESOLUTION NO. 02-17-15-05
A RESOLUTION OF THE CITY OF SCANDIA, WASHINGTON COUNTY,
MINNESOTA, REQUESTING A VARINACE FROM STANDARD FOR STATE AID
OPERATION FOR PROJECT NO: S.A.P. 082-600-015.
WHEREAS, the City of Scandia is preparing plans for Log House Landing (205'h Street N.)
Road Improvement Project; and
WHEREAS, Minnesota Rules for State Aid Operation for Minimum Geometric Design
Standards for New/ Reconstruction Park Road Account Project requires two (2) lanes of eleven
(11) foot width and two (2) foot shoulders on each side for roads with speeds of 30 mph and
average daily traffic less than 100; and
WHEREAS, the reasons for this variance requests is to reduce the construction foot print,
minimize the amount of tree clearing and to protect the rural character of the road and
surrounding area.
NOW, THEREFORE BE IT RESOLVED, that the City Council does hereby request a
variance from the Minnesota Department of Transportation State Aid Operations Rules for
Minimum Geometric Design Standards for New/Reconstruction Park Road Account Project to
allow a thirteen (13) foot wide one -lane two-way road with ten (10) foot wide fifty (50) foot long
pullouts in lieu of twenty-two (22) foot wide two lane road with two (2) foot shoulders;
BE IT FURTHER RESOLVED, that the City of Scandia City Council hereby indemnifies,
saves and hold harmless the State of Minnesota and its agents and employees of and from claims,
demands, actions, or causes of action arising out of or by reason of constructing a thirteen (13)
foot wide one -lane, two-way road with ten (10) foot wide fifty (50) foot long pullouts; which is
not in accordance with Minnesota Rules for State Aid Operation for Minimum Geometric Design
Standards for New/ Reconstruction Park Road Account Project and further agrees to defend at
their sole cost and expense any action or proceeding commenced for the purpose of asserting any
claim arising as a result of the granting this variance.
