Deadline/Timeline: N/A Background: • At the December 18 meeting,the Council requested staff to research ordinances in response to complaints about snowmobiles on City sidewalks in the village area. Snowmobile use has made it almost impossible to remove compacted snow from sidewalks. • Current city ordinance(No. 68, adopted in December,2000) prohibits snowmobiles from using sidewalks. This ordinance has been provided to law enforcement,but unless snowmobilers are caught in the act it is difficult to enforce. • MN DNR regulates where you may and may not ride a snowmobile. The DNR regulations can be found at hriu://www.dnr.state.mn.us/re�ulations/snowmobile/index.ht�nl. A copy is attached. • Most neighboring Cities have ordinances that are based on the DNR regulations with minor modifications. The DNR regulations specifically state that azeas may be restricted to snowmobiles by local ordinance or municipalities. • If desired, Scandia's ordinance could be changed,restricting snowmobiles from the village center, which would be accomplished through signage and increased enforcement. • Washington County has a number of snowmobile clubs and a trail system, the Star Trail,which these clubs maintain. This trail includes a route along Highway 97 and identifies Meister's Bar and Grill as a destination. The city could encourage the clubs could create a route into the village center that is acceptable to the residents of the City of Scandia. These clubs contact landowners to achieve permission to allow the trail to cross specific properties quite often. The clubs could print on their Star Trail maps specific areas that are restricted from snowmobile use as well as signage that would be provided by the City. (A)All provisions of M.S. §§ 84.81 through 84.915,as they may be amended from rime to time,together with all rules and regulations adopted pursuant tliereto,are incorporated herein and made a part of this section by reference,and it shall be unlawful to own or operate a snowmobile within the city in violation thereof. (B)It shall be unlawful for any person to operate a snowmobile over and upon any sidewalk or upon any public park or playground which has been posted with signs prolubiting motorized vehicles in the city. (C)It shall be unlawful for any person to operate any snowmobile within the city unless the snowmobile has attached to it as installed by the manufacturer and in good operating condition a standard engine muffler and exhaust system. (D)It shall be unlawful to operate any snowmobile upon the public streets,alleys or public property within the city between the hours of 12:00 a.m and 7:00 a.m on Monday,Tuesday,Wednesday,Thursday and Friday of each week and between the hours of 1:30 a.m and 7:00 a.m on Saturday and Sunday of each week,except that operarion of a snowmobile shall be permitted until 1:30 a.m on Christmas Day and New Years Day. (E)No person shall operate any snowmobile within the city at a speed in excess of 25 miles per hour. (F)Any person violating any provision of this section shall be guilty of a misdemeanor and,upon conviction thereof,shall be punished according to law. ' 72.01 DEFINITIONS. For the purpose of this chapter,the following defmitions shall apply unless the context clearly indicates or requires a different meaning. ALL-TERRAIN VEHICLE or ATi! "Trail bikes,"mini bikes and amphibious vehicles and similar devices other than snowmobiles used at least partially for travel on natural terrain,but not"special mobile equipment,"defined in M.S. § 168.011(22),as it may be amended from time to time. DEADMAN THROTTLE or SAFETY THROTTLE. A device which,when pressure is removed from the engine accelerator or throttle,causes the motor to be disengaged&om the driving mechanism NATIIRAI TERRAIN. Areas other than roadways or driveways(private or public),pazking lots and other areas the surface of which has been intentionally modified for motor vehicle operation thereon. OWNER A person,other than a lien holder having the property in or title to snowmobile or ATV entifled to the use or possession thereof. OPERATE. To ride in or on and control the operarion of a snowmobile or ATV. OPERATOR Every person who operates or is in actual physical control of a snowmobile or ATV. SNOWMOBILE.A self-propelled vehicle designed for travel on snow or ice steered by skis or runners. ('87 Code, § 702.01) § 72.02 PERMITTED USES. Except as herein specifically permitted and authorized,it is unlawful for any person to operate a snowmobile or ATV not licensed as a motor vehicle within the limits of the city: (A)On the portion of any right-of-way of any public highway,street,road,trail or alley used for motor vehicle travel,except tbat a snowmobile may operate upon the most right-hand lane of a municipal street or alley and may in passing or making a left turn operate on other lanes which are used for vehicle traffic in the same direction,for purposes of going to or retuming from a non-highway azea of permissible operation, by the most direct route;(Snowmobiles may also be operated upon the ditch bottom or the outside bank of trunk,county state-aid and county lughways where the highways aze so configured within the corporate limits.) (B)On a public sidewalk provided for pedeshian travel; (C)On boulevards within any public right-of-way; (D)On private property of another without specific pernussion of the owner or person in control of the property; (E)On any other public place,except as may be specifically permitted by other provisions of the city;or (F)At a speed in excess of 20 miles per hour. ('87 Code, §702.02)(Am.Ord.06-02-01,passed 2-16-06)Penaltv,see� 10.99 § 72.03 CROSSING STREETS AND HIGHWAYS. A snowmobile or ATV not licensed as a motor vehicle may make a direct crossing of a street or highway, except an interstate lughway or freeway provided: (A)The crossing is made at an angle of approximately 90 degrees to the direction of the street or highway and at a place where no obstruction prevents a quick and safe crossing; (B)The snowmobile is brought to a complete stop before crossing the shoulder or main traveled way; (C)The driver yields the right-of-way to all on-coming traffic which constitutes an immediate hazard; (D)In crossing a divided street or highway,the crossing is made only at an intersection of the street or highway with another public sireet or highway;and (E)If the crossing is made between the hours of one-half hour before sunrise to one-half hour after sunset or,in conditions of reduced visibility,only if both front and rear lights aze on. ('87 Code, §702.03) § 72.04 APPLICABILITY. City traffic ordinances shall apply to tlie operation of snowmobiles or ATV not licensed as a motor vehicle upon streets and highways,except for those relating to required equipment,those which by their nature have no applicarion and those inconsistent with the provisions herein. ('87 Code, §702.04) § 72.05 YIELDING RIGHT-OF-WAY. No snowmobile shall enter any intersection without yielding the right-of-way to any vehicles or pedestrians at the intersecrion or so close to the intersection as to constitute an immediate hazard. ('87 Code, §702.05)Penalty,see S 10.99 § 72.06 OPERATION BY MINORS. No person under 14 years of age shall operate on streets or the roadway surface of l�ighways or make a direct crossing of a trunk,county state road,county highway or city street as the operator of a snowmobile. A person 14 years of age or older,but less than 18 years of age,may opeiate a snowmobile on streets and highways as permitted under this chapter and make a direct crossing of the streets and highways only if he or she has in his or her immediate possession a valid snowmobile safety certificate issued by the Commissioner,as provided by M.S. § 84.872,as it may be amended from time to time. ('87 Code,§702.06)Penalty,see� 10.99 § 72.07 PROHIBITED USES. (A)It is unlawful for any person to operate a snowmobile,ATV not licensed for highway use or ATV licensed for highway use when operating on natural terrain within the limits of the city: (1)At any place while under the influence of alcohol or drugs,as defined in M.S. § 169.121,as it may be amended from time to time,which is hereby incorporated herein by reference; (2)At a rate of speed greater than reasonable or proper under all surrounding circumstances; (3)At any place in a careless,reckless or negligent manner or heedlessly in disregard of the rights or safety of others,or in a manner so as to endanger or be likely to endanger or cause injury or damage to any person or property; (4)During the hours from 11:00 p.m.to 7:00 a.m of any day,except for leaving or returning to the residence of the operator upon the most direct route; (5)So as to tow any person or thing,except tbrough use of a rigid tow ba�attached to the rear of the snowmobile or ATV;and/or (6)Within 100 feet of any fisherman,pedestrian, skating rink or sliding area where the operation would conflict with use or endanger oflier persons or property or within 100 feet of any dwelling which is usually occupied by one or more persons. ('87 Code, §702.07) (B)It is unlawful to intentionally drive,chase,run over or kill any animal with a snowmobile or ATV. ('87 Code, §702.11)Penaltv,see § 10.99 § 72.08 EQUIPMENT REQUIRED; IGNITION LOCK. (A)It is unlawful for any person to operate a snowmobile or ATV any place within the limits of the city unless it is equipped with the following: (1)Standard mufflers which are properly attached and which reduce the noise of operarion of the motor to the minimum necessary for operation;(No person shall use a muffler cutout,by-pass straight pipe or similar device on a snowmobile or ATV motor.) (2)Brakes adequate to control the movement of and to stop and hold the snowmobile or ATV under any condirion of operation; (3)A safety or so-called"deadman"throttle in operating condition; (4)When operated between the hours of one-half hour after sunset and one-half hour before sunrise or at time of reduced visibility,at least one clear lamp attached to the front,with sufficient intensity to reveal persons and vehicles at a distance of at least 100 feet ahead during the hours of darl�ess and under normal atmospheric conditions;and(T'he headlamp shall be so aimed that glaring rays are not projected into the eyes of an oncoming snowmobile or ATV operator.It shall also be equipped with at least one red tail lamp having a r�mum candlepower of sufficient intensity to exhibit a red light plainly visible from a distance of 500 feet to the rear during hours of darkness under normal atmospheric conditions.) (5)Reflecrive material at least 16 inches square on each side,forward of the handlebars or steering device of a snowmobile or ATV,and at the highest pracrical point on any towed object,as to reflect light at a 90 degree angle. ('87 Code, §702.08) (B)Every person leaving a snowmobile or ATV on a public place or way shall lock the ignition,remove the key and take the same with him or her. ('87 Code, § 702.09)(Am.Ord.06-02-01,passed 2-16-06)Penaltv,see& 10.99 § 72.09 EMERGENCY OPERATION. Notwithstanding any prohibitions in this chapter,a snowmobile may be operated on a public thoroughfare in an emergency during the period of time and at locations where snow upon the roadway renders travel by automobile impractical. ('87 Code,§702.10) § 72.10 SIGNAL FROM OFFICER TO STOP. It is unlawful for a snowmobile operator,after having received a visual or audible signal from a law enforcement officer,to operate the vehicle in willful or wanton disregard of the signal to stop,interfere with or endanger the law enforcement officer or any other person or velucle or increase speed or attempt to flee or elude the officer. REGULATIONS TO THE USE OF SNOWMOBILES AND ALL TERRAIN VEHICLES Ordinance Chapter 302 City of Chisago City Chapter 302 Regulations to the Use of Snowmobiles and All Terrain Vehicles The Council of the City of Chisaga City hereby ordains: 302.01 Definitions. For the purpose of this Section, the following terms have the meanings stated: Subd. 1 Snowmobile. A self propelled vehicle designed for travel on snow or ice and steered by skis or runners. All Terrain Vehicle (AT�: Refers to "trail bikes", mini-bikes and amphibious vehicles and similar devices other than snowmobiles used at least partially for travel on natural terrain but not"special mobile equipment" defined in Minnesota Statute 168.011, Subd. 22. Owner. A person, other than a lien holder, having thE property in or title to snowmobile or ATV entitled to the use or possession thereof Operate. To ride or have control of the operation of a snowmobile or ATV. Operator. Every person who operates or is in actual physical control of a snowmobile or ATV. Deadman Throttle or Safety Throttle. A device which when pressure is removed from the engine accelerator or throttle, causes the motor to be disengaged from the driving mechanism. Natural Terrain. Areas other than roadways, driveways (private or public), parking lots and other areas the surface of which has been intentionally modified for motor vehicle operation thereon. 302.02 Permitted Uses of Snowmobiles and ATV's. Except as specifically permitted and authorized herein, it is unlawful for any person to operate a snowmobile or ATV not licensed as a motor vehicle under the following conditions within the City: REGULATIONS TO THE USE OF SNOWMOBILES AND ALL TERRAIN VEHICLES Ordinance Chpt 302 Page 2 of 5 A. On the portion of any right-of-way of any public highway, street, road, trail or alley used for motor vehicle travel, except that a snowmobile may operate upon the most right hand lane of a municipal street or alley and may in passing or making a left turn operate on other lanes which are used for vehicle traffic in the same direction, far purposes of going to or � returning from a non-highway area of permissible operation, by the most direct route. Snowmobiles may also be operat�d upon the ditch bottom or the outside bank of trunk county state-aid and county highways where such highways are so configured within the corporate limits. B. On a public sidewalk provided for pedestrian travel. C. On boulevards within any public right-of-way. D. On private property of another without specific permission of the owner or person in control of the property. E. On any other public place except as may be specifically permitted by other provisions of the City. F. At a speed in excess of 15 miles per hour. 302.03 Crossing of Streets or Highways, Snowmobiles. A snowmobile may make a direct crossing of a street or highway, other than an interstate highway or freeway, provided: A. The crossing is made at an angle of approximately 90 degrees to the direction of the street or highway and at a place were no obstruction prevents a quick and safe crossing. B. The snowmobile first comes to a complete stop at the edge of the shoulder of the main traveled way. C. The driver yields the right-of-way to all oncoming traffic which constitutes an immediate hazard. D. In crossing a divided street or highway, the crossing made only at the intersection of such street of highway with another public street or highway. REGULATIONS TO THE USE OF SNOWMOBILES AND ALL TERRAIN VEHICLES Ordinance Chpt 302 Page 3 of 5 E. If the crossing is made between the hours of 1/2 hour after sunset to 1/2 hour before sunrise or, in conditions of reduced visibility, only if both front and rear lights are on. 302.04 Traffic Ordinance Applicable: City and State traffic regulations shall apply to the operation of snowmobiles upon streets and highways, except for those relating to required equipment, those which by their nature have no application and those inconsistent with the provisions herein. 302.05 Yielding Right-of-Way. No snowmobile shall enter any intersection without yielding the right-of-way to any vehicles or pedestrians at the intersection, or so cross the intersection as to constitute an immediate hazard. 302.06 Operation. Persons under 18 years of age: No person under 14 years of age shall operate a snowmobile on streets or the roadway surface of highways or make a direct crossing of a trunk, county state aid, c�unty highway, or city streets. A person 14 years of age or older, but less than 18 years of age, may operate a snowmobile on streets and highways as permitted under this Section and make a direct crossing of the streets and highways only if he/she has in his/her immediate possession a valid snowmobile sa�ety certificate issued by the Commissioner, as provided by Minnesota Statute 84. 872. 302.07 Uses Specifically Prohibited. It is unlawful for any person to operate a snowmobile or AN under the following conditions: A. At any place while under the influence of alcohol or drugs as defined in Minnesota Statute 169.211 which is hereby in�orporated herein by reference. B. At a rate of speed greater than reasonable or proper under all surrounding circumstances. C. At any place in a careless, reckless, or negligent manner or heedlessly in disregard of the rights or safety of others, or in a manner so as to endanger or be likely to endanger or cause injury or damage to any person or property. D. No person shall operate a snowmobile on any street in the City befirveen the hours of 12:01 a.m. and 7:00 a.m., except going to or from their usual place of abode at a reduced speed and using the most direct route. So as to tow any person or thing except through use of a rigid tow bar attached to the rear of the snowmobile or ATV. F. Within 100 feet of any fisherman, pedestrian, skating rink or sliding area where the operation would conflict with use or endanger other persons or property, or within 100 feet of any dwelling which is usually occupied by one or more persons. 3 02.08 Equipment Required. It is unlawful for any person to operate a snowmobile or ATV any place within the limits of the City unless it is equipped with the following: A. Standard mufflers which are properly attached and which reduce the noise of operation of the motor to the minimum necessary for operation. No person shall use a muffler cut-out, bypass straight pipe or similar device on a snowmobile or AN motor. B. Brakes adequa#e to control the movement of and to stop and hold the snowmobile or AN under any conditions of operation. C. A safety or so-called °deadman" throttle in operating condition. D. When operated between the hours of 1/2 hour after sunset and 1/2 hour before sunrise or at a time of reduced visibility at least one clear lamp attached to the front, with sufficient intensity to reveal persons and vehicles at a distance of at least 100 feet ahead during the hours of darkness and under normal atmospheric conditions. The headlamp shall be so aimed that glaring rays are not projected into the eyes of an oncoming snowmobile or AN operator. It shall also be equipped with at least one red tail lamp having am minimum candlepower of sufficient intensity to exhibit a red light plainly visible from a distance of 500 feet to the rear during hours of darkness under normal atmospheric conditions. E. Reflective material at least 16 inches square on each side, forward of the handlebars or steering device of a snowmobile or ATV and at the highest practical point on any towed object, as to reflect light at a 90 degree angle. 302.09 Ignition Lock. Every person leaving a snowmobile or AN on a public place or way shall lock the ignition, and remove and take the keys with them. REGULATIONS TO THE USE OF SNOWMOBILES AND ALL TERRAIN VEHICLES Ordinance Chpt 302 Page 5 of 5 302.10 Emergencies. Operation Permitted: Notwithstanding any other provisions in this Section, a snowmobile may be operated on a public thoroughfare in an emergency during the period of time and at locations where snow upon the roadways renders travel by an automobile impractical. 302.11 Uses Prohibited. Animals. It is unlawful to intentionally drive, chase, run over or kill any animal with a snowmobile or ATV. 302.12 Signal from Officer to Stop. It is unlawful for a snowmobile operator, after having received a visual or audible signal from a law enforcement officer, to operate the vehicle in willful or wanton disregard of the signal to stop, intertere with or endanger the law enforcement officer or any other person or vehicle, or increase speed or attempt to flee or elude the officer. Any person attempting to flee an officer in or on any motorized vehicle is guilty of a gross misdemeanor and punishable thereto. 302.13 Penalty for Violation. Any person who violates the provisions of Chapter 302, excluding Subd. 302.12, of the City Code shall be guilty of a petty misdemeanor, punishable by a fine of up to $200.00. Any person who violates Subd. 302.12 shall be guilty of a gross misdemeanor and punishable according to Minnesota Statute 609.487.
