Deadline/ Timeline: N/A Background: . Section 9.1 of the S1loreland Management Regulations requires a Certificate of Compliance be obtained prior to tlie reinoval of any trees. • Mr. Lee cut down 13 trees larger than 6" in diameter that were all dead or diseased. (See enclosed pictures). • Section 9.5 of Chapter 2 of the Zoiiing Regulations requires a Certificate of Coinpliance prior to the constniction of any fence in the Shoreland Overlay District. • Mr. Lee is proposing a 4.5' hig11 white PVC 3 plank ranch style fence along Olinda Trail. (See enclosed pictures). • The proposed fence is in their front yard beyond the 200' required building setbacks, which allows it to be 6' in height. See enclosed pictures. • The property is classified as agriculture and the fence will be used to coilstrain livestock. Per Sectioi19.5(C 1), a fence inay be Ltp to 6' in height on agriculturalland, provided the fence is a wire strand or wood rail fence. Recommendation: The area along the lake appeais to have been a field oi-mowed area for some tiine so the h-ees were not part of a woody area. I have spoke with Jason Hlisveth of Critical Com7ections. Jason l�ad been on the site in the past and reassured me that most of the trees were invasive in nature besides being dead or diseased. Mr. Lee was not aware of the City's requirement for the Certificate before he cut down the trees. The fence meets the requirements of tlle Zoning code except that it is consh-iicted out of wllite vinyl �iot wo��d. Vinyl fences are increasing in popularity and are cun-ently seen witllin the city however, most fences do uot require a Certificate of Compliance. This fence requires a Certificate of Compliance only because it is in the Shoreland District. If the Council feels that viny? planlc is an appropriate Page 1 of 2 O1/31/08 substitute for wood plank, a�1 ordinance ainendment could be done for fi�ture instances. N �I�� r! 7 7���� Marine St. Croix, Mn 55047 CIlY OF SCANDIA We have removed 13 dead or dieing trees in a buffer zone along the 340 feet of the Middle West side of Hay Lake. A Buffer zone is an area we have reserved for shoreline, bank and upland vegetation and under story grasses, sledges and woody plants. Unlike other individuals this is an unmowed strip of native vegetation that extends both lake ward and landward from the water's edge. We have removed l 3 dead or dieing trees (see pictures attached). We will not be planting more trees. The shoreline has many deciduous trees such as Red maple (Acer rubrum), Bass wood (Tilia americana) and Iron wood (Ostrya virginiana). Also a varieties of evergreen conifers including Balsam fir (Abies balsamea), Jack pine (P. banksiana) and Cedar (Thuja occdentalis) which create a natural canopy of shade promoting more varieties of understory vegetation. In addition to removal of the trees we have benefited a "wildlife corridor" in that 20 to 30 foot wide strip of land (buffer zone) starting at the open water natural shore line inwards. This is a complex ecosystem that sustains fish and wildlife and protects the entire lake. Native vegetation along the shore acts as a buffer zone, intercepting nutrients and reducing runoff, erosion, and sedimentation. Aquatic plants provide food and shelter for ducks, song-birds, and other animals while reducing problems caused by Canada geese and burrowing muskrats. Plants growing in and near the water are critical for wildlife and fish habitat and a healthy lakeshore. Tall plants like bulrush (Sciipus), lake sedge, water lilies and cattail reduce the energy of wave action to minimize erosion and help maintain water quality. Creation of a buffer zone is the essence of the lakescaping concept. The indigenous grasses in our buffer zone are contained in the lake bank (which help keep the water clean by holding sediments in place against the eroding forces of water run off and by absorbing excess nutrients) include Switch grass (Panicum virgatum), Prairie cord grass (Spartina pectinata) and many other varieties of sedges and grasses, woodier species likeChoke Cherry (prunus virginiana) Sumac (Rhus copallinum) and unfortunately buck thorn (Rhamnus cathartica) and some of our weedier and invasive invaders promote wildlife and create a natural wildlife thoroughfare, it will look ungroomed but nature is messy.Our shoreline is part of a larger community and ecosystem. Individual choices by many such as mowing, fertilizing, and weed killing have cumulative impacts on a lake and its ecosystem with the removal of some dead or dieing trees We have removed an imminent danger of dead fall endangering canoeist and fishermen, not to mention (but I will) propagation of diseases.
