Re: Request to purchase Outlot B in Rockin R Ridge Subdivsion
Background - Andrew Knudson is seeking to purchase outlot B in Rockin R Ridge subdivision. The
development agreement for the subdivision was approved in 1989 and The development agreement
states that “Outlots A and B as shown on the Plat of Rockin R Ridge shall be dedicated to the public but
the Township shall have no obligation to maintain or improve Outlots A and B as public roads”. The
parcel is 0.6 acres in size.
Outlot B currently serves as a driveway to the Knudson parcel to the north and the Johnson property to
the west. The Johnson property is 33.6 acres of which roughly 7 acres is above the ordinary high water
mark of Goose Lake.
The City does not have a record of any agreement providing access to the Johnson property.
If the Council wishes to pursue the sale of the property either the Council can either refer the matter to
the Planning Commission or the Council may by resolution adopted by two-thirds vote dispense with
this requirement when in its judgment it finds that the proposed acquisition or disposal of real property
has no relationship to the comprehensive municipal plan. In submitting comments and review, the
Planning Commission serves in a strictly advisory role. The Council ultimately decides on the purchase or
disposal of real estate and is not bound by Planning Commission recommendations.
