9.j) Staff Report-Rodjso Height Variance Staff Report Date of Meeting: December 16, 2014 To: City Council From: Kristina Handt, City Administrator Re: Rodjso Height Variance Background: Paul and Susan Rodjso applied for a variance on September 13, 2014 to move the Hilltop Water Barn to their property on Pomroy Ave. Last month the Council approved the variance to allow the structure closer to the road than the house. The variance from the 35 foot height restriction has not been acted on yet. The 120 day review period ends January 14, 2015. Given that time frame and the extensive discussion and issues surrounding the proposed ordinance changes to allow historic structures, staff is placing the variance issue on the agenda again. Issue: What action should the Council take on the Rodjso application for a variance from the height restrictions? Proposal Details: Staff assumes this agenda item would only be brought up if Ordinance No. 157 is not adopted. Consistent with the City Planner’s report last month to the Council, staff does not believe the application meets the statutory variance criteria. Therefore, a resolution to deny the variance is included in your packet. Options: (Assuming Ord. No 157 is not adopted) 1)Approve Resolution 12-16-14-06 2)Amend and then approve Resolution 12-16-14-06. This could include findings different from those provided in the report that may support the approval of the variance. 3)Table the resolution. Without an extension from the applicants, the variance would be approved as an operation of law at the end of the 120 day period. Recommendation: Option 1.
