Location: 11245 218th St. N, Scandia, MN. District Rule: 3 & 4 Recommendation: Conditional Approval pending receipt of the following items related to: Stormwater Management 1. For future home only – Stormwater management plan providing stormwater BMPs receiving runoff from the majority of impervious surfaces. Complete the District’s Small Residential Project Stormwater Worksheet for sizing of stormwater management feature(s). BMP construction details, installation instructions and protection notes may be incorporated directly or by reference from District guidance (see attached). Erosion & Sediment Control 2. Grading and erosion control plan identifying the placement and specifications of erosion control BMPs. This should include, but may not be limited to a rock construction entrance, silt fence downstream of disturbed areas, revegetation specifications, and a construction implementation schedule. Floodplain 3. For future home only – Specification of the proposed lowest floor elevation to be at least 2-feet above the 100-year elevation of German Lake (958.7) and 1-foot above the natural emergency overflow elevation. Relocation of the proposed driveway east to at least 32.5-feet from the delineated wetland boundary (this appears feasible with a new alignment along shallow slopes) per buffer width averaging afforded by District Rule 4.3.7. 5. Additional details for the proposed driveway culvert that will serve as the outlet of the Manage 2 wetland on the north boundary of the site. This should include the surveyed elevation of the existing overflow of the wetland, confirmation that the overflow elevation will not be altered, and culvert sizing details. Administrative 6. For future home only – Completion of a draft Buffer Declaration (template attached) in accordance with District Rule 4 (attached) providing a 100-foot buffer from the OHWL of German Lake (955.5) and 75-feet from the delineated wetland boundary of the Manage 2 wetland. 7. For future home only – Completion of a draft Declaration for Maintenance of Stormwater Facilities for access to and maintenance of proposed stormwater features (see attached District template). Stipulations: 1. Contact information for the responsible erosion control contractor/site manager must be provided to the District Administrator prior to initiating work. 2. Notify District Administrator after erosion control is installed but prior to start of construction. 3. All work shall be in accordance with the approved design, plans, computations and specifications on file with the Carnelian-Marine- St. Croix Watershed District and any stipulations identified in this permit. Any proposed revision to grading, drainage, landscaping and erosion control plans shall be submitted to the District for prior approval. 4. Applicant is responsible for obtaining all other required permits and approvals for construction of proposed project. 6. Install and maintain silt fence down-gradient from all proposed disturbed soil prior to start of any construction. 7. Upon approval by the District of the draft maintenance agreement and buffer declaration, the documents shall be executed and recorded at the County on the deed. Submit certified copies to the District within 60 days of notice of District approval of draft agreements. 8. Stabilization must be initiated immediately to limit soil erosion on any portion of the site when construction activity has permanently ceased or will not resume for a period exceeding fourteen (14) calendar days. Stabilization must be completed no later than fourteen (14) calendar days after the construction activity in that portion of the site has ceased. Stabilization must be completed no later than twenty-four (24) hours after the construction activity has ceased in that portion of the site within two hundred (200) lineal feet of and draining to a wetland, waterbody, a discernable surface drainage feature or a stormwater system inlet. 9. Permit Application No. 19-003 Jensen Driveway & Residence, German Lake Emmons & Olivier Resources, Inc. - 4 - 3/4/19 6. Notice of Decision under the MWCA, signed 10/16/18, received 2/28/19. 7. Wetland Delineation Report prepared by Kjolhaug Environmental Services, dated 9/19/18, received 2/28/19. Findings: 1. Description – The proposed project entails constructing a new driveway at 11245 218th St. N, for the purpose of reducing necessary grading and tree removal associated with current site access. This driveway will serve a future new home, details of which have yet to be provided. 2. Stormwater Management – Stormwater management will not be required for construction of the driveway. However, stormwater management will be required for the proposed residence in accordance with the District’s Small Residential Project Stormwater Worksheet. 3. Erosion & Sediment Control – A sediment and erosion control plan must be provided and must include a temporary rock construction entrance, silt fencing downstream of disturbed areas, revegetation specifications, and a construction implementation schedule. 4. Buffers – The location of the proposed driveway is within the required 75-feet buffer of the delineated wetland on the north edge of the parcel. Per District Rule 4.5.2, creation of impervious area is prohibited within this buffer. However, the overflow of the wetland is near the delineated boundary such that the driveway would not be tributary to the wetland. Given this, it is recommended that the proposed driveway be shifted to the east to a distance of ½ the buffer width (32.5-feet) while still remaining on the topographic saddle. This would balance the benefits of wetland and lake buffers (increasing the driveway distance from German Lake as compared to existing conditions) and be within the buffer width averaging standards of District Rule 4.3.7. 5. Floodplain – The 100-yr flood elevation of German Lake is 958.7 (FEMA). The proposed driveway is not within the 100-yr flood zone. The (future) proposed home lowest floor elevation will need to comply with District freeboard requirements. 6. Wetland Management – The proposed plan does not include fill within wetlands, however, a Manage 2 wetland drains east to German Lake over a topographic saddle on which the driveway is proposed. The proposed culvert must not be placed below the existing overflow elevation of the wetland. Additional culvert details are required to Permit Application No. 19-003 Jensen Driveway & Residence, German Lake Emmons & Olivier Resources, Inc. - 5 - 3/4/19 verify no indirect wetland impacts. Board Action: The CMSCWD Board conditionally approved this application on February 13th, 2019 pending receipt of the above items.
