RE: WCA TEP Follow-Up – Reinhardt Unpermitted Wetland Fill Violation
Dear Neil,
I am writing to follow-up regarding the unpermitted wetland fill located on the Reinhardt property off of
Langly Avenue near Big Marine Lake. The DNR, BWSR, and WCD met the landowners onsite on 4-19-19
to discuss fill removal as the Wetland Conservation Act (WCA) Restoration Order (RO) deadline has
passed. The Technical Evaluation Panel (TEP)and DNR agreed to submit a request to extend the RO
deadline to May 15, 2019.
During the site visit the applicant indicated he felt the City denied the driveway permit because of the
TEP’s recommended denial of the WCA application. As noted in the TEP Findings of Fact for both
iterations of the Reinhardt’s WCA Wetland Replacement Plan application, the TEP recommended denial
of the Wetland Replacement Plan application because the WCA permit must be “consistent with other
plans such as land use and zoning” per MN rule 8420.0515 Subp 10 and the applicant had not met the
conditions for obtaining a driveway permit.
The TEP would like to clarify that if a driveway permit is obtained and sequencing requirements met, the
TEP would not recommend denial of the WCA application. Please contact me at 651-587-6622 to
