Discussion on uses in the Agricultural Preserve zoning district Staff Report Date of Meeting: May 7, 2019 To: Planning Commission From: Neil Soltis, Administrator Re: Development Code uses in the Agricultural Preserve zoning district Background: A recent inquiry regarding a parcel that is for sale which currently has the Metropolitan Agricultural Preserve designation and is zoned Agricultural Preserve led to a review of the uses that are listed in the Development Code, Chapter 2, Section 2.5. In reviewing the Development Code there are a number of permitted and accessory uses that are listed but do not likely meet the criteria for the Metropolitan Agricultural Preserve designation. The uses that should be reviewed for consistency are the following: (2) Permitted Uses. The following are permitted uses in the AP District. (E) Essential Services (H) Residential Facility, State Licensed (Serving 1 to 6 Persons) (3) Accessory Uses. The following uses are permitted accessory uses in the AP District, subject to the applicable provisions of this Chapter. (B) Daycare Facility (Nursery, Day), State Licensed, located within a residential setting (Serving 14 or Fewer Persons) (F) Home Occupations (G) Horse Training Facility, Private (K) Recreation Facilities and Equipment (5) Uses with an Interim Use Permit. The following uses are permitted in the AG C District after the issuance of an Interim Use Permit. (A) Kennel, Private – Accessory to a Residential Use (6) Uses with an Administrative permit. The following uses are permitted in the AP District after the issuance of an Administrative permit. (C) Temporary Dwelling Unit, Care Facility – Accessory to a Residential Use Following this report are the current Development Code section, the restrictive covenants for Metropolitan Ag Preserve designation, MN statutes related to the Metropolitan Ag Preserve designation, and correspondence with the Met Council regarding the specific questions raised in the inquiry. The average maximum density of residential structures within an agricultural​ preserve shall not exceed one unit per 40 acres. The location of any new structure shall conform to locally​ applicable zoning regulations. Commercial and industrial uses shall not be permitted except as provided in​ subdivision 2 after the user is issued a permit by the authority. The authority shall be responsible for enforcing​ this section.​ Subd. 1a.Allowed commercial and industrial operations.(a) Commercial and industrial operations​ are not allowed on land within an agricultural preserve except:​ (1) small on-farm commercial or industrial operations normally associated with and important to farming​ in the agricultural preserve area;​ (2) storage use of existing farm buildings that does not disrupt the integrity of the agricultural preserve;​ (3) small commercial use of existing farm buildings for trades not disruptive to the integrity of the​ agricultural preserve such as a carpentry shop, small scale mechanics shop, and similar activities that a farm​ operator might conduct; and​ (4) wireless communication installments and related equipment and structure capable of providing​ technology potentially beneficial to farming activities. A property owner who installs wireless communication​ equipment does not violate a covenant made prior to January 1, 2018, under section 473H.05, subdivision​ 1.​ (b) For purposes of paragraph (a), clauses (2) and (3), "existing" means existing on August 1, 1987.​ Subd. 2.Density restriction after subdivision.When a separate parcel is created for a residential​ structure, commercial, or industrial use permitted under subdivision 1, the parcel shall cease to be an​ agricultural preserve unless the eligibility requirements of section 473H.03 are met.
