Addition to Agenda _8-7-19 Interim Zoning Administrator Date: August 7, 2019 To: Scandia City Council From: Mayor Christine Maefsky Re: Limited Interim Zoning Administrator Under the Development Code, enforcement is the role of the Zoning Administrator, who is appointed by the City Council. City Administrator Neil Soltis was the Zoning Administrator. If the City should issue a citation (or similar), the recipient does not comply, and the City resorts to court action to pursue further enforcement, one potential “defense” would be that the citation (or similar) was not signed by a duly- authorized representative of the City. A formal appointment would go a long way to addressing “duly authorized.” In the absence of a City Administrator, the City Council can appoint a limited interim Zoning Administrator. Given that the City’s period of time without an administrator is prolonged, and given that issues are arising where the duties of a Zoning Administrator might be needed, I recommend that the Council, under Development Code Chapter 1,Section 3.1, appoint Brenda Eklund as the Limited Interim Zoning Administrator, with the power and duty to enforce the Development Code pursuant to its Chapter 1, Section 2.1 and Section 3.2 (7-9). Unless sooner terminated by the City Council, the term of the Limited Interim Zoning Administrator shall terminate automatically, without further action by the City Council, on the earlier of the date that a new City Administrator begins work for the City or December 31, 2019.
