7.b)2) Staff Report-Accessory Dwelling Unit Ord Staff Report Date of Meeting: May 19, 2014 To: City Council From: Kristina Handt, City Administrator Re: Ordinance No 161 Accessory Dwelling Units Background: At the May work session the Council reviewed a draft of the accessory dwelling unit ordinance the Planning Commission had been working on for a few months. Please refer to that meeting packet for a summary. The only addition after the work session is in Sec. 3, subd 4.2 (3) to require the structure meet building code regulations for a residential structure. Issue: Should the Council adopt Ordinance No 161? Proposal Details: A copy of the revised ordinance is included in your packet. Staff has contacted Washington County to ask about addressing the accessory dwelling unit differently from the principal structure. This concern was voiced by the Fire Chief at the work session. We have not heard back yet. However, the address issue does not need to be included in the ordinance and can be added as a condition of approval on each application. Options: 1) Approve Ordinance No 161 2) Amend and then Approve Ordinance No 161 3) Do not adopt Ordinance No 161 Recommendation: Option 1.
