5.e) LAYSB 2016 Contract RenewalCITY OF SCANDIA AND LAKES AREA YOUTH SERVICE BUREAU, INC PURCHASE OF SERVICE AGREEMENT The City of Scandia, hereinafter referred to as the "City," and Lakes Area Youth Service Bureau, Inc., 244 N. Lake St., Forest Lake, Minnesota 55025, hereinafter referred to as the "Contractor," enter into this agreement for the period from January 1, 2016, to December 31, 2016. WHEREAS, the intent of City of Scandia is to build safer communities by repairing the harm from, reducing the risk of, and involving the community in the resolution of juvenile crime; WHEREAS, City of Scandia is committed to using community-based approaches to strengthen individuals, families, and community; WHEREAS, City of Scandia approves of the following outcomes for juvenile diversion and early intervention: Juvenile offenders will be held accountable for their actions by engaging in activities that repair the harm done to the victim and community and will participate in programs that promote an increased understanding of the impact of their offense on victims, communities, and themselves; Crime victims will be notified of diversion proceedings; will have opportunities to provide input; and, if willing, will have the opportunity to participate in the process; Community members will have active and direct involvement in programming; WHEREAS, the City of Scandia, pursuant to its goals of providing accountability and the most appropriate diversion and early intervention available to juvenile offenders, wishes to purchase services for youth involved in at -risk behavior from the Contractor to support these outcomes; NOW, THEREFORE, the parties agree as follows: Contractor's Duties — The Contractor agrees to the provision of the following services: a. Recruit and support community work -service sites for youth residents of the City of Scandia who are ordered by the court and/or referred by law enforcement. b. Educational and prevention programs, including Chemical Awareness, Choice & Consequence, fire awareness, theft awareness, violence awareness, or another approved alternative. Eligible juveniles include those who are referred the City's law enforcement personnel. The reason for the referral must be behavior or actions that could result in a police report and a petition for delinquency. c. Evaluation and counseling. Counseling services include crisis intervention, youth, and family and group counseling. Referrals will be made for psychological/ psychiatric evaluation and long-term mental health treatment. d. The City law enforcement agrees to provide victims of crimes diverted by local law enforcement the opportunity for direct or indirect involvement into how the juvenile should be held accountable, including consideration of the impact of the crime on the victim and any specific needs for restitution. When necessary, due to the offense, restitution will be determined and collected by Contractor. e. As appropriate, facilitate restorative justice interventions, such as victim/offender mediation, family group conferencing, and/or community panels, so that juvenile offenders are held directly accountable to the victim and victimized community through some form of reparation. f. Provide support to parents of youth offenders, and provide opportunities for youth to access mentoring, enrichment, and leadership activities to keep youth from entering the juvenile justice system. 2. Attachments and References — The Contractor agrees to provide the enumerated services in Exhibit A, which is attached and incorporated herein by reference. 3. Cost and Delivery of Purchased Services — The total amount to be paid to the Contractor for services purchased under this agreement shall be $5,500. For these services, the City of Scandia agrees to make a single annual payment to the Contractor of $5,500 no later than May 15, 2016. 4. Eligibility for Services — A City of Scandia resident between the ages of five and eighteen (or older if still in high school), their family members, and the victims of juvenile crime who are assessed to be appropriate shall be eligible for the services provided under the terms of this agreement. 5. Evaluation, Reporting, and Information Requirements — The Contractor agrees to reasonable evaluations of its programs, employees, and volunteers and make them available for review by the City of Scandia if so requested. The Contractor agrees to comply with all reporting requirements as assigned by law, rule, or contract by the State of Minnesota and Washington County. The Contractor further agrees to abide by all laws and rules regarding confidentiality and data practices. The Contractor agrees to provide necessary information allowed by law and deemed necessary by the City of Scandia on referred cases. 6. Indemnification —The Contractor agrees to indemnify, defend, and hold harmless the City, its officers, employees, and agents for all claims arising out of the Contractor's activities related to the services provided under this agreement up to the liability limits set forth in Minn. Stat. 466.04. The City of Scandia will indemnify Lakes Area Youth Service Bureau, Inc. from and against all liability up to the liability limits set forth in Minn. Stat. 466.04. No other provision of this agreement shall serve to limit in any way the obligations of the Contractor to indemnify and defend the City of Scandia under this clause. 7. Insurance Requirements — The Contractor agrees that in order to protect it self, as well as the City of Scandia, from claims arising out of the Contractor's activities under this agreement, it will at all times during the term of this agreement keep in force policies of insurance providing the following liabilities: professional liability insurance policy in the minimum amount of Four Hundred Thousand Dollars ($400,000) bodily injury or death of one person; One Million Two Hundred Thousand Dollars ($1,200,000) for bodily injury per occurrence; comprehensive general liability insurance policy in the minimum amount of Four Hundred Thousand Dollars ($400,000) bodily injury or death of one person; One Million Two Hundred Thousand Dollars ($1,200,000) bodily injury per occurrence; One Million Dollars ($1,000,000) property damage; automobile insurance, including non - owned and hired autos, in the minimum of Four Hundred Thousand Dollars ($400,000) bodily injury or death of one person; One Million Two Hundred Thousand Dollars ($1,200,000) bodily injury per occurrence; and One Million Dollars ($1,000,000) property damage. The Contractor further agrees to maintain Workers' Compensation insurance in the statutory amounts. Certificates of Insurance showing the coverage listed herein and the City as an additional insured shall be provided to the City of Scandia prior to the effective date of this contract. 8. Data Privacy — All data collected, created, received, maintained, or disseminated for any purpose by the activities of the Contractor because of this agreement is governed by the Minnesota Government Data Practices Act, Minn. Stat. Chapter 13, as amended, the Minnesota Rule implementing such Act now in force or as adopted, as well as federal regulations on data privacy. 9. Record Disclosures/Monitoring — Pursuant to Minn. Stat. 16C.05, Subd. 5, the Contractor agrees that the City of Scandia, the State Auditor, or any of their duly authorized representatives at any time during normal business hours and as often as they may reasonably deem necessary, shall have access to and the right to examine, audit, excerpt, and transcribe any books, documents, papers, records, etc., which are pertinent to the accounting practices and procedures of the Contractor and involve transactions relating to this agreement. The Contractor agrees to maintain these records for a period of three years from the date of termination of this agreement. 10. Nondiscrimination — During the performance of this agreement, the Contractor agrees to the following: No person shall, on the grounds of race, color, religion, age, sex, disability, marital status, public assistance status, criminal record, creed, or national origin be excluded from full employment rights in, participation in, be denied the benefits of, or be otherwise subjected to discrimination under any and all applicable federal and state laws against discrimination. 11. Independent Contractor — Nothing contained in this agreement is intended or should be construed as creating the relationship of co-partners or joint ventures with the City of Scandia. No tenure or any rights or benefits, including Workers' Compensation, unemployment insurance, medical care, sick leave, vacation leave, severance pay, PERA, or other benefits available to City of Scandia employees shall accrue to the Contractor or employees of the Contractor performing services under this agreement. 12. Conditions of the Parties' Obligation — This agreement may be canceled by either party at any time, with or without cause, upon 30 days' notice, in writing, delivered by mail, or in person. Any alterations, variations, modifications, or waivers of the provisions of this agreement shall be valid only when they have been reduced to writing, duly signed by both parties, and attached to the original of this agreement. 13. Compliance With Law — The Contractor shall abide by all federal, state, or local laws, statutes, ordinances, rules, and regulations now in effect or hereinafter adopted insofar as they relate to the Contractor's performance of the provisions of this agreement. 14. Firearms — Unless specifically required by the terms of this contract, no provider of services pursuant to this contract, including, but not limited to, employees, agents, or subcontractors of the Contractor shall carry or possess a firearm on City premises. Violation of this provision shall be considered a substantial breach of the agreement. Violation of this provision is grounds for immediate suspension or termination of this contract, without notice, pursuant to Section 12. 15. Savings Clause — If any section of this agreement is found to be invalid or not enforceable, the remainder of the agreement will remain in force and binding. 16. Governing Law — The laws of Minnesota shall govern the interpretation and prosecution of this agreement. 17. The offender is expected to take responsibility for his/her actions, to understand the effect of the offense on the victim, to make amends for the offense, and be accepted back into the community. This program works in conjunction with schools, law enforcement, liaison officers, and counties. Young people referred to the Community Justice Program complete a contract with the Lakes Area Youth Service Bureau. Parents are required to be involved. Offenders are asked to participate in weekly peer groups, attend educational seminars, complete community service hours, and appear before a panel of community volunteers. The goal of the panel is to help the offender realize the impact his or her offense has had on the community. The victim is also involved throughout the process. A core group of fifty trained volunteers provide a minimum of three hours of services each month to the Community Justice Program. Educational classes and programs include: Choice & Consequence, Chemical Awareness, and Tobacco Awareness. Diversion Program/Community Work Service Lakes Area Youth Service Bureau oversees placement of youth needing to complete community work service hours. Placements are made throughout the community and some work crew opportunities are available. Emphasis is also placed on youth and families working together to complete community work service. Offenders Age 12 and Under Geared for younger participants, youth complete a counseling -based program that includes discussion on making choices, how their actions affected themselves and others, and learning skills to prevent further offenses. Suspension Program: LAYSB offers a safe, supervised setting for elementary and junior high school students who have been suspended from school. Teen Intervene (TI): TI is an in depth chemical program for youth with repeat chemical offenses or for youth who are identified as at risk for chemical abuse. The program includes five sessions with a counselor and parents also participate. The program involves goal setting for reducing and/or quitting chemical use. TI is a Hazelden created best practice program. Our Place" Teen Addiction Recovery Program: Responding to the growing need for youth recovery support services, LAYSB is providing a safe, secure, and confidential place just for teens. "OUR PLACE" provides an opportunity for teens to gain insight into the process of their own recovery and to practice their potential to live a life free of addiction. Using a 12 -step group approach, teens can share their experiences, strength, and hope in an atmosphere of acceptance and belonging. The group is overseen by caring volunteers who are familiar with group facilitation, the 12 steps process, and have a passion to assist our youth in gaining freedom from the devastating consequences of addiction. Who can attend? Teens ages 13-19 who have a desire to remain abstinent from drugs, alcohol, and other addictive behaviors. The group is also inclusive of teens who are struggling due to a loved one's addiction. The group is held at Lakes Area Youth Service Bureau, Tuesdays from 6:00 pm — 7:30pm. The group is free of charge. Anyone can refer youth to the group. YOUTH & FAMILY COUNSELING Youth & Family Counseling: provides immediate professional support to help families work through issues such as power struggles between kids and parents, youth acting out at home or at school, strengthening communication skill development, and building healthy relationships. Counseling is provided in various formats for both children and their parents including family sessions, individual sessions, group therapy, and telephone support. LAYSB now accepts many forms of health insurance. For those without coverage, we also offer a sliding scale fee based upon ability to pay. Crisis Services: provide help for youth and families in the midst of a crisis such as when youth experience suicidal thoughts or runaway from home. When appropriate, referral to additional services will be given. REACH Anger Management Group: is designed to help youth ages 13-15 look at and address their anger. It is an early intervention program that helps youth who desire to understand their anger, want to quit hurting people around them or whose anger is interfering with life goals. Six weekly sessions. Reasoning Skills Program (RSP): the goal of RSP is to provide youth an opportunity to gain moral self- awareness and to develop skills in decision making. Youth also process how these choices impact themselves and others and then learn how inappropriate choices may be replaced with appropriate ones which result in more positive outcomes. Five Sessions. Therapy & Skills Groups: Including grief groups, peer mediation. PARENTING EDUCATION Parenting Support and Education Programs: are designed to increase the capacity of struggling parents to parent effectively by empowering them with skills, knowledge, and resources - both professional and personal. Services include community-based parenting education programs designed to eliminate barriers between youth and family members. Resources are available through a variety of media including classes, videos, printed material, parenting telephone sessions, and parenting counseling sessions. A weekly Parent Support Meeting is offered every Thursday evening from 6:30-7:30pm. Free of charge, no registration required. MAKING CONNECTIONS MENTORING PROGRAM "I just wanted someone to talk to that doesn't live in my house!" —Mentee Making Connections Mentoring Program is goal -oriented & designed to provide youth ages 10-17 with an opportunity to build a positive and encouraging relationship with supportive adults in the community. Each youth participant has a case plan developed collaboratively by the youth, LAYSB staff, and the youth's family, which includes specific objectives related to his/her needs. Through mentoring, youth goals include: to improve school performance/attendance, improve self-esteem, gain positive reinforcement, improve relationships with family, and reduce recidivism of at -risk youth. Mentors meet with their mentee two times per month for a minimum of six months according to a schedule determined by the mentor/mentee. All mentors will receive general volunteer training and a detailed 2 hour training session related to mentoring and ongoing support and supervision. ADULT VOLUNTEER OPPORTUNITIES Communitv Justice Communitv Volunteer Panel: Trained adult volunteers represent victims and the community on the Community Justice Program's community panel. Offenders appear before the panel to review the harmful consequences that their actions have had on themselves, the victim, and the community. A commitment of one Monday per month for 3 hours is requested. LAYSB provides training, supervision and support to each panel member. Parent Panel Volunteer, Community J LIS -i ice Program: Parent Panel Volunteers facilitate a one-hour session aimed at helping parents share ideas and resources as well as supporting each other during a challenging time for both parents and adolescents. Volunteers will also talk to parents about asset building. By building assets in youth, they are much less likely to participate in high-risk behaviors such as chemical use, violence, and skipping school. Orientation and training provided. Peer Group Facilitator Volunteer: Meet with a small group (4-8) of youth who are participating in Peer Groups as part of the Community Justice Program. Lead them through activities and discussions on a variety of topics relevant to teens including: communication, nutrition, college preparation, financial planning, positive choices, relationships, and life skills. Flexible schedule in afternoons/evenings, one or two days per quarter. Follow -Up Specialist Volunteer: From the LAYSB office, make phone calls to youth and their parents to review their status in the Community Justice Program, get them signed up for classes, panels, or community work service. Volunteers will also contact past Community Justice participants to check in with them on how they are doing and offer any additional services as needed. Community Justice Program Assistant Volunteer: Assist the Community Justice Program Manager with reminder calls, paperwork, class co -facilitation and miscellaneous projects. Be a positive role model, connect with youth in the community, listen and have fun. Mentors meet with their mentee one to two times per month for a minimum of six months. Flexible schedule.
