Items included are: Added "nonprofits" to the definitions of both Agritourism Enterprise and Rural Event Facility. Developed a new section for the Code that includes requirements and standards for the Agritourism Enterprise use. The Rural Event Facility standards have been modified as a starting point for discussion: o The section states that Agritourism Enterprises (AE's) are permitted in the AG C, GR and VN districts (same as current Code). o The permit requirements set a threshold for the type of permit required. AE's that hold up to 4 events each year with a maximum of 100 attendees at each event need Special Event permits for each event. AE's that hold more than four events annually with an average of more than 100 people need an IUP or CUP. o The AOP requirement for Rural Event Facilities was not included, since the focus for AE's is on educational or recreational activities rather than large events—the Commission should discuss whether an AOP should be required for all AE's. The City could require annual reviews as a condition of the CUP or IUP for individual AE's if warranted. o The current Code requires a CUP for AE's, and an IUP for Rural Event Facilities. The IUP was established for Rural Event Facilities because the City wanted to require a new permit if the property changed ownership. The Commission recommended that the Planner provide suggested definitions and parking standards for the Hotel use for discussion at the January meeting. Some options for the Commission to discuss include: Hotel Definition Scandia's current definition: "Any building or portion thereof occupied as the more or less temporary abiding place of individuals and containing 3 or more guest rooms, used, designated, or intended to be used, let or hired out to be occupied or which are occupied by 3 or more individuals for compensation, where the compensation be paid directly or indirectly." Minnesota Statutes include the following definitions: o Hotels or motel: "Hotel or motel" means a building, structure, enclosure, or any part thereof used as, maintained as, advertised as, or held out to be a place where sleeping accommodations are furnished to the public and furnishing accommodations of less than one week. o Lodging establishment: "Lodging establishment" means: a building, structure, enclosure or any part thereof used as, maintained as, advertised as, or held out to be a place where sleeping accommodations are furnished to the public as regular roomers, for periods of one week or more, and having five or more beds to let to the public." Many city codes do not include the "one week" limit in the State Statute definition for hotel. Some examples include: o City of Stillwater: "Hotel means a building containing rooms intended or designed to be used, or which are used, rented or hired out to be occupied, or which are occupied for sleeping purposes by guests, and where a general kitchen and dining room are provided within the building or in an accessory building." o City of Osceola: "Hotel: a building in which lodging, with or without meals, is offered to transient guests for compensation." o Forest Lake: "A building having provision for 10 or more guests in which lodging is provided with or without meals, for compensation, and which is open to transient or permanent guests or both, and which ingress and egress to and from all rooms is made through an inside lobby or office supervised by a person in charge." (Motels have direct access to rooms from outside, and adjacent parking.) 01 Ordinance Discussions Page 3 January 5, 2016 Scandia Planning Commission Parking Standards The City of Stillwater has typical parking requirements for hotels or motels: One space for each unit, plus one for the resident owner/manager. Additional spaces are required for related activities such as restaurants, lounges or retail shops—the number is based on the number required for those uses in the Zoning Ordinance. The Commission will continue the discussion of uses that require CUP's in the Village Districts at the January meeting. Commissioners may reference the staff memo for the December 1 meeting for this discussion. MI
