RE: Update Vacation of Portion of 2nd Street in the Vasa Plot
Background
On December 20, 2020, the City received a petition from Mr. Charles Eginton and his
neighbors to vacate a portion of an unimproved right-of-way of Second Street in the Vasa
Plot located at the Copas neighborhood off of 197th Street North. (For those unfamiliar
with the area, the area in question is near where 197th Street makes a sharp turn north near
the St. Croix River.)
At the City Council’s meeting on January 19, 2021, a public hearing was held on this
request. At that time, the City Council requested that staff develop a vacation definition that
would allow for the preservation of right-of-way for the staging and menovering of
emergency vehicles due to the narrow width of existing roads that serve the
neighborhood. The Council also agreed that staff should develop a solution that could
address the legality of the location of Malinda Maher’s new septic service line. If the service
line could not be located within the area of vacation, staff was directed to prepare a road
right-of-way encroachment license to address the legality of this location.
Recommendation Update
Chief Hinz and I have reviewed the survey map that was presented to the City during the
right-of-way permitting process for the Mahar septic system. We are able to report that an
area can remain dedicated for staging and maneuvering vehicles, while vacating the
remaining extent of 2nd Street to the south. (Please see the map.) In addition this vacation
area will be able to include the service line location for Ms. Maher’s septic system.
The current recommended vacation area is 110 feet by 60 feet at the south end of the
existing right-of-way. The would reserve an area south of the intersection of approximately
2700 sq feet.
The Council is requested to review the current proposed map for any recommended
changes. This map will be used to develop corrected legal definitions to the draft vacation
resolution, which will require final consideration at the City Council’s regular business
meeting on February 16, 2021.
