Background:
In December both the Carnelian -Marine -St. Croix Watershed District Board and the City
Council took action to initiate a letter of agreement that provides for the cost sharing on the Log
House Landing ramp project. The agreement as provided was reviewed by the Council at the
January 6 work session and Section 9 — Cooperative Venture was subsequently modified by the
City Attorney to properly reflect Minnesota Statutes.
Issue:
Should the Letter of Agreement be approved?
Proposal Details:
The National Park Service has committed $15,000 towards the project
The DNR will donate the plans subject to an agreement with the City
The City and District will share the cost 50150 after all grants and donations are accounted
for.
The City and the District will meet jointly to discuss the initial project scope, design, and
costs and any subsequent changes.
The City will be responsible for bidding and construction of the project
The city will be responsible for future maintenance of the project
The preliminary cost estimate from the District is $33,587 without engineering
Capital Improvement plan includes $20,000 for the project in 2016.

preliminary plans and specifications for discussion at a joint meeting with the Watershed

AGREEMENT BETWEEN THE CARNELIAN-MARINE-ST. CROIX WATERSHED DISTRICT AND CITY
OF SCANDIA FOR THE LOG HOUSE LANDING PUBLIC ACCESS RAMP PROJECT
This Agreement Between the Carnelian -Marine -St. Croix Watershed District and the City of
Scandia for the Log House Landing Public Access Ramp Project (the "Agreement") shall be
effective on the day of , 2016, by and between the Carnelian -Marine -
St. Croix Watershed District, hereinafter referred to as "District", and the City of Scandia,
hereinafter referred to as "City", both political subdivisions of the State of Minnesota.
In consideration of the covenants and agreements hereinafter set forth, it is mutually agreed by
and between the parties hereto as follows:
1. Project. The project consists of the construction of a public access boat ramp at Log
House Landing, which is located at the east terminus of 205t" Street at the St. Croix River
within the City, as generally described in the 10/21/2015 memo from Emmons & Olivier
Resources, Inc. (Exhibit A) including concept plans (Exhibit B) and estimated costs
(Exhibit C) (hereinafter referred to as the "Project"). The construction of the ramp will
be in accordance with the letter agreement between the City and the State of
Minnesota, Department of Natural Resources, hereinafter referred to as "DNR" (Exhibit
D). The City Engineer will prepare the preliminary design for the Project which will be
submitted for a joint review by the City and the District. The City and the District will
meet jointly regarding any decisions as to any additional changes to the design, scope
and cost of the Project.
2. Project Budget and Cost Participation. The preliminary cost estimate of the Project
based on the concept plans is $33,587. The preliminary cost estimate does not include
the cost of the concrete planks which will be provided to the City by the DNR in
accordance with the letter agreement (Exhibit D). The National Park Service has
committed $15,000 to the project which will be subject to a future agreement between
the National Park Service and the City. All remaining Project costs after any additional
grants and donations are accounted for shall be divided equally between the City and
the District.
3. Design and Construction. The City Engineer shall prepare plans and specifications for
the Project and the City will be responsible for bidding, construction, and management
of the Project through completion.
4. Maintenance of Project. After final acceptance of the project the District shall have no
obligation for any future replacements, additional improvements, or short-term and
long-term maintenance of the Project.
5. Indemnity. The City agrees that it will defend, indemnify, and hold harmless the District
and NPS and their employees, officers, volunteers, and agents against any and all claims
arising out of the City's performance or failure to perform its obligations pursuant to
this Agreement. Nothing herein shall be construed to waive or limit any immunity from,
or limitation of liability available to either party, whether set forth in Minnesota Statutes
Chapter 466 or otherwise. Notwithstanding any other provision of this Agreement, the
City shall not be not be required to pay any amount in excess of the limits on liability
established by Minnesota Statutes, Chapter 466.
6. Insurance. The City agrees to maintain general liability insurance in the minimum
amount of $1,000,000. All contractors performing work on the Project shall provide the
City with a certificate of insurance verifying that a minimum of $1,000,000 of general
liability insurance is in place and the City is listed as an additional insured.
7. Recognition. All Project -related signage shall recognize the City, the District, and NPS as
partners on the Project.
8. Project Duration. The Project will be initiated as soon as possible in spring 2016 and
completed by December 31, 2016.
9. Cooperative Venture. To the fullest extent permitted by law, action by the parties to
this Agreement is intended to be and shall be construed as a "cooperative activity,"
and it is the intent of the parties that they shall be deemed to be a "single
governmental unit" for the purposes of liability, as set forth in Minnesota Statutes,
Section 471.59, Subdivision la (a), providing further that for purposes of that
statute, each party to this Agreement expressly declines responsibility for the acts or
omissions of the other party. The parties to this Agreement are not liable for the acts
or omissions of the other party to this Agreement except to the extent they have agreed
in writing to be responsible for the acts or omissions of the other parties. In addition,
pursuant to Minnesota Statutes, Section 471.59, Subdivision 1a(b), the parties to this
Agreement intend to be categorized as a single governmental unit and the total liability
for the parties hereto shall not exceed the limits on governmental liability as specified in
Minnesota Statutes, Section 466.04, Subdivision 1, as may be amended or
supplemented from time to time.
10. Notices. Any notice or demand which must be given or made by a party hereto under
the terms of this agreement shall be in writing and shall be provided to the parties by
U.S. Mail at the addresses listed below:

11. Amendment. This Agreement may be amended only in a written document signed by
both parties.
12. Entire Agreement. It is understood and agreed that this is the entire agreement

agreements between the parties relating to the subject matter.

Regarding 1 Concept Plan & Estimated Costs
Background
The intent of the Log House Landing boat ramp project is to provide a stabilized access point for
boat launching while also eliminating erosion and sediment transport to the St. Croix River from the
ramp and surrounding slopes. The current condition of the site is a highly erosive native soil/ rock/
gravel surface ramp that contributes sediment directly to the river. Frequent regrading and
resurfacing are required due to washouts from runoff from 2051h Street as well as vehicle rutting.
A variety of materials were explored as options for improving the access ramp. Bituminous, steel
matting, geotextile mats, and HDPE turf pavers were all considered. Ultimately it was determined
that due to the steep slope, concrete would be the most appropriate and durable material. No other
material could provide the amount of stable traction and strength required for vehicles to navigate
the 24% slope ramp. Concrete is also the most durable in terms of wave, wake, wind, ice, and
current exposure, and poses the least risk of being displaced due to high water.
Concept Design
Ramp & Access Drive - The attached concept plan proposes a combination of DNR supplied
concrete boat ramp planks and a reinforced concrete access ramp over geotextile fabric. 32
concrete planks are proposed at the base of the ramp where boats will be deposited and retrieved
from the water. The planks will extend approximately 15' beyond the OHW of 680' into the water,
but will not exceed a depth of 4', per DNR requirements. The planks will be set on a 13% slope,
which is within the preferred range of slopes for boat access. The proposed design affords
construction in accordance with State of Minnesota Specifications (State File SDG.00030, Sheet 14)
which is mandated by the (draft) Public Water Access letter agreement between the City and the
State. The access drive from the parking area to the boat ramp is proposed to be paved with a 6"
thick, reinforced concrete with a v-groove finish.
Additional Elements - The access drive is proposed to be bordered on either side by a clear
aggregate spillway over fabric in order to direct flows and prevent erosion. In addition, the steep
slopes on either side of the access drive are proposed to be stabilized and reinforced with 18-36"
boulders. Any disturbed area will be seeded with a native woodland mix. Currently an eroded foot
path exists approx. 40' to the north of the boat ramp access point. The concept plan proposes
formalizing and reinforcing the path with a rough cut stone stairway, fitted into the slope.
Other Considerations - Additional items not itemized in the preliminary cost estimate that could
provide added benefit include landscaping with shrubs and perennial plugs instead of seed; an
improved picnic area near the historic fireplace with decomposed granite surface, tables, and
educational signage; and a sediment basin in the far corner of the parking area to receive runoff
from 205th Street in order to direct sediment away from the reconstructed access drive, boat ramp,
and river.

RE: Log House Landing Public Water Access
This letter shall serve as an agreement between the State of Minnesota, Department of Natural
Resources, hereinafter referred to as the "State", and the City of Scandia, hereinafter referred to
as the "City" to allow the State to provide the City with approximately 50 small concrete plank
and connectors to be used in the construction of a boat launching ramp at the following location:
Log House Landing Public Water Access in Washington County
The State will participate in this project when this letter is signed and if the following items are
met:
1) The City has an easement for the described property and has the lawful right and authority to enter into the
Agreement as shown on the attached deed and map and incorporated into this agreement as Exhibit A.
2) The State will deliver the concrete planks to site for installation.
3) The ramp will be constructed according to the attached specifications (State File SDG.00030, Sheet 14).
4) All additional construction materials (rock) will be provided by the City according to the attached
specifications (State File SDG.00030, Sheet 14a) and at no cost to the State of Minnesota.
5) The City shall be responsible for applying for a U.S. Corps of Engineers permit (if required) to work in
protected Waters and for complying with any State and Federal laws, regulations, rules and ordinances
which may apply to them in connection with the development of the public access ramp. A State Public
Waters permit is not needed if the criteria in Minnesota Rules Chapter 6115.0210 are met (see attached).
No work shall proceed until the necessary permits are obtained.
6) The access must be open and free to the public for at least 16 hours a day between the hours of 4 a.m. and
midnight or from dawn to dusk, except in emergency situations or with the prior written consent of the
State.
7) The access shall have no launch restrictions placed upon boat size or engine horsepower except as adopted
through surface use zoning regulations.
8) The State shall erect a sign stating that the Public Access facilities are a cooperative undertaking by the
City and the Department of Natural Resources.
9) The State reserves the right to inspect the premises at all times to insure that the City is in compliance with
the terms of this Agreement.

10) The City shall undertake the maintenance and upkeep of the premises and will keep the same in a
reasonably sanitary, neat and safe condition.
11) The State reserves the right to reclaim the concrete planks if the ramp is not installed or maintained in a
manner consistent with State standards and practices. Before any such removal, the State shall provide the
City thirty (30) days written notice during which time the City may correct the situation.
12) Neither the State of Minnesota nor any of its officers, agents, or employees shall be liable on account of
any claim, demand or cause of action made or brought by reasons of any alleged act or omission of the
City. This policy shall be in force for the duration of the project and subsequent use of the facility.
13) No work shall proceed until this agreement has been signed by the appropriate City and Department of
Natural Resources personnel.
14) This agreement shall run with the land and bind any and all successors of the City.
If this meets with your approval, please sign both copies and return them to me. You will
receive a final copy after the State has signed indicating acceptance.

6115.0150 PURPOSE AND STATUTORY AUTHORITY.
The purpose of parts 6115.0150 to 6115.0280 is to provide
for the orderly and consistent review of permit applications in
order to conserve and utilize the water resources of the state
in the best interest of its people. In deciding whether to
issue permits, the department is guided by the policies and
requirements declared in Minnesota Statutes, sections 103A.201,
103A.208, 103F.101, 103F.105, 103F.205, 103F.351, 103G.297,
103G.305, and 116D.04.
The proposed development must also be consistent with the
goals and objectives of applicable federal, state, and local
environmental quality programs and policies, including but not
limited to shoreland management, floodplain management, water
surface use management, boat and water safety, wild and scenic
rivers management, water quality management, recreational or
wilderness management, critical areas management, scientific and
natural areas management, and protected species management.

6115.0210 STRUCTURES IN PUBLIC WATERS.
Subpart 1. Goals. It is the goal of the department to
limit the occupation of public waters by offshore
navigational facilities, retaining walls, and other structures
in order to:
A. preserve the natural character of public waters
and their shorelands;
B. provide a balance between the protection and
utilization of public waters; and
C. encourage the removal of existing structures which
do not serve the public interest from the beds of public
waters at the earliest practicable date.
Subp. 2. Scope. This part applies to the placement,
construction, reconstruction, repair, relocation, abandonment,
or removal of any structure placed on or in public waters.

Subp. 4. No permit required. No permit is required for
the following activities, unless prohibited under subpart 3:
B. to construct or reconstruct a boat launching ramp
if:
(1) privately owned ramps do not exceed 12 feet
in width and do not extend more than ten feet beyond the
shoreline or into water more than four feet in depth, whichever
is less. Excavations five cubic yards or less, and placement of
up to five cubic yards of crushed rock, gravel, clean sand, or
small stone are allowed to provide a stable base or maintain use
of the ramp;
(2) publicly owned ramps do not exceed 36 feet in
width and do not extend more than 30 feet waterward of the
shoreline or into water more than four feet in depth, whichever
is less. Excavations of 200 cubic yards or less, and placement
of up to 80 cubic yards of crushed rock, gravel, clean sand, or
small stone are allowed to provide a stable base or maintain use
of the ramp. The use of coffer dams constructed of metal sheet
piling or other portable materials is allowed to construct and
maintain public boat launching ramps if all materials are
completely removed from public waters within 30 days of
completion of the project;
(3) the ramp is constructed of gravel, natural
rock, concrete, steel matting, or other durable inorganic
material not exceeding seven inches in thickness; and
(4) the ramp is not located on a federall
desiqnated wild and scenic river; or
