Memo Draft Section 153.500 Administration and Procedures City of Scandia – Draft 153.500 Administration and Procedures 1 City of Scandia Zoning & Development Code Update 04.08.2021 TO: Mayor, City Council, and Planning Commission CC: Ken Cammilleri, City Administrator Evan Monson, Consulting City Planner Chris Nelson, City Attorney FROM: Jennifer Haskamp, AICP, SHC Julia Paulsen Mullin, SHC RE: Working Draft Section 153.500 Administration and Procedures Attached please find the working draft of new Section 153.500 Administration and Procedures of the UDC. As stated in the Annotated Outline we reviewed in February this Section is intended to: “…consolidate, synthesize and simplify the information contained in Chapter 1 of the current Scandia Development Code. The contents of the current Development Code are cumbersome and repetitive making it difficult to understand. This section is intentionally placed sequentially after the Zoning District, Use Standards and Development Standards sections to reduce repetition and confusion. The purpose of this section is to be accurate, clear and concise to improve the land use review process.” Once we began drafting, we determined that Sections from Chapter 2 and Chapter 3 of the current Development Code should also be incorporated into this new Section. As such, the attached draft incorporates the administrative and review procedures regarding subdivision, platting, and land disturbance sections. The intent, policy and language contained within the new draft Section remain fairly consistent with the language contained in your current Development Code but has been completely reorganized and restructured. Some policy related modifications were made, and we would like to discuss the areas of modification with you at the upcoming work session. To assist you in your review, we provide the following summary of the policy or process related recommended modifications for your reference: • Current code allows for Concept or Sketch Plan review of only Conditional Use Permits. We propose modification of this language to allow for any Land Use Application to request a concept plan review. • We have clarified/modified the Site Plan review process to indicate that a Separate Site Plan application is not required as part of the land use application process (i.e. CUP, IUP, Variance, etc.) Instead, it references the requirement of a Site Plan, but allows it to be incorporated as part of the land use application package. • We propose modification to the Final Plat submission requirements for consistency with State Statutes. Currently a set of “final” plans are required in addition to the Final Plat. We have modified the language to state that the Preliminary Plat plan set must be updated to match the City of Scandia – Draft 153.500 Administration and Procedures 2 recommendations and conditions of the Preliminary Plat approval and must be consistent with the Final Plat. This will avoid confusion about what is “final”. The construction drawings can then be prepared from the approved Preliminary Plat plan set. Please note that the attached Section is a working draft, and therefore will continue to be updated/modified/edited for accuracy throughout this process. Please note that once other sections of the code update are completed, we will cross reference with this Section and make adjustments, including revisions/deletions/additions as needed.
