8.b2 Resolution No. 2021-22 Deny Amending Future Land Use Map_Rustic Roots Winery CITY OF SCANDIA, MINNESOTA CC RESOLUTION NO. 2021-22 DENYING AN AMENDMENT TO THE FUTURE LAND USE MAP IN THE 2040 SCANDIA COMPREHENSIVE PLAN FOR PARCELS 24.032.20.41.0001; 24.032.20.44.0002; AND 24.032.20.44.0001 LOCATED AT RUSTIC ROOTS WINERY, 20168 ST. CROIX TRAIL NORTH WHEREAS, Greg and Andrea Sandager made an application to amend the designation of parcels in the future land use map of the 2040 Scandia Comprehensive Plan property addressed as 20168 St. Croix Trail North, and WHEREAS, the property is legally described in Attachment A; and WHEREAS, the Planning Commission reviewed the request to amend the future land use map at a duly noticed Public Hearing on April 6th, 2021, and recommended that the City Council deny the request; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF SCANDIA, WASHINGTON COUNTY, MINNESOTA, that it denies a request for an amendment to the future land use map in the 2040 Scandia Comprehensive Plan for parcels 24.032.20.41.0001; 24.032.20.44.0002; and 24.032.20.44.0001, based on the following findings: 1. The proposed change in future land use designation could result in a negative impact to the rural character of the surrounding area. If the change in future land use designation is approved, and the parcels are rezoned to R COMM, the subject property would be permitted a number of land uses by right that are in conflict and not compatible with the rural character of the area. 2. The parcels in question do not fully meet the definition of the Rural Commercial future land use designation, which is currently limited to a limited number of specific areas. Since they do not conform to the definition of the Rural Commercial future land use designation, the proposed amendment would be out of step with the principles of the Comprehensive Plan.
