the southerly line of Reserve No. 3 of Otisville, said monument being set 104 feet east of the center line of said section, running thence southwesterly at an angle of 81° 6' turned from that
part of said quarter section line that lies west of said point of beginning 23 feet, thence at a deflection angle of 18° 20' to the right 96 feet, thence by a deflection angle of 25° 40' to the right
67 feet, thence by a deflection angle of 21° 49' to the left 66 feet more or less to the easterly line of Washington Street, also running northwesterly from the said point of beginning at an angle
of 79° 39' turned from that part of the said quarter section line that lies west of the said point of beginning 85 feet, thence by a deflection angle of 29° 28' to the right 31 feet, thence by a

No. 3 lying west of the right of way of the Minneapolis, St. Paul and Sault Ste. Marie Railway Company and subject to the rights of the Town of New Scandia, for the purpose of a public park,
but not for a tourist camp or camping ground, in and upon that portion of Reserve No. 3 described in deed recorded in Book 128 of Deeds, page 345.
A perpetual right of way and easement to the parties of the second part as tenants in common, their heirs and assigns, their tenants, servants, visitors and licensees, incident to the use of the
herein conveyed property for dwelling purposes only, for the purpose of ingress and egress with or without vehicles between the property herein conveyed and the public highway known as
Washington Street on the plat of Otisville through, over and upon Sec. 19, Tp. 32, Rge. 19, said right of way and easement being 20 feet wide and the center line of which runs as follows:
Beginning at an iron pipe monument which is set in the east and west quarter section line of said Section 104 feet east of the center of said section and running southwesterly at an angle of

All those parts of Lots 1 and 2 Block 11 of Otisville and of Water Street vacated, including riparian rights, described as follows, to wit: Commencing at an iron pipe monument on the north line
of Lot 2 Block 11 of Otisville which is located 4 feet west of the point of intersection of the center line of the 8 foot right of way and easement hereinabove described with said north line of Lot
2 Block 11 of Otisville; thence southerly 24 feet on a line parallel to the center line of said 8 foot right of way and easement aforedescribed and said center line extended beyond the north
boundary of Lot 2 Block 11 of Otisville; thence westerly by a deflection angle of 94° 50' to the right on a straight line 84.7 feet; thence by a deflection angle of 85° 10' to the right on a straight
line to the north line of said Lot 1 Block 11 of Otisville, which is the east and west quarter section line of Sec. 19, Tp. 32, Rge. 19; thence east along said north line of Lot 1 and the same
extended to the westerly shore or low water line of the St. Croix River; thence south along the westerly shore or low water line of the St. Croix River to a point where the north line of Lot 2
Block 11 of Otisville extended intersects said shore and low water line of the St. Croix River; thence west along the extension of the north line of Lot 2 Block 11 of Otisville and along the north
line of Lot 2 Block 11 of Otisville to the point of beginning. All descriptions referring to Otisville are according to the plat thereof on file and of record in the office of the Register of Deeds of
Washington County, Minnesota.
Said right of way and easement is further indicated upon surveys, one of which, marked Exhibit A, is attached to a certain deed dated August 8, 1941 from Robert F. Leach, unmarried, to
Harriet Ingersoll Washburn conveying Lot 4 and the south 76 feet of Lot 3 Block 11 of Otisville and the portion of Water Street which accrued to the foregoing property upon the vacation
thereof, including riparian rights, and other being Exhibit A attached to that certain deed, dated August 13, 1935, recorded in Book 128 of Deeds, page 264.
This deed is subject to the right of way and easement granted to said George W. Morgan under indenture dated August 13, 1935, last above described and also subject to right of way and
easement granted in that certain deed dated August 8, 1941 from Robert F. Leach, unmarried, to Georgeana Ingersoll Lewis conveying parts of Lots 1, 2 and 3 and of Water Street vacated and
Park Avenue vacated in Block 11 of Otisville and subject also to the right of way and easement granted in that certain deed dated August 8, 1941 from Robert F. Leach, unmarried, to Harriet
Ingersoll Washburn aforementioned conveying Lot 4 and the south 76 feet of Lot 3 Block 11 of Otisville and that portion of Water Street which accrued to the aforedescribed property upon
the vacation thereof.
Being the same premises conveyed to the grantors above named by Robert F. Leach, unmarried, by deed dated August 8, 1941 and recorded October 3, 1941 in Book 136 of Deeds at page
571.
Also subject to the easement granted the United States of America in that certain indenture dated June 30, 1977, and filed for record in the Office of the County Recorder of Washington
County, Minnesota, on August 12, 1977, as Document No. 362477.

The plat of OTISVILLE was surveyed by J.M. Oldham, County Surveyor of Washington County, and recorded in December
of 1902. Subsequent re -surveys of OTISVILLE, on which we based the boundary of QUIT CLAIM DEED, Document No.
3799640, have been done by many surveyors including Jens Pederson (1915) Lewis W. Clarke, County Surveyor of
Washington County (1923-1924), L. Norton Clarke, County Surveyor of Washington County (1935-1941) and Arthur M.
Holm (1972).
Based on found and re-established monuments, there is approximately 11 feet of error along the N -S 1/4 section line
between the center of section and the 1/16th corner to the north. Found monuments and occupation north of Ekdahl
Avenue and south of the E -W 1/4 section line generally fit plat dimensions. Based on our findings, approximately 10
feet of error has been placed in Reserve No. 3. This area is a series of steep ravines. At the time of platting (1902), this
was difficult terrain to accurately measure distance and we believe this error to be a blunder on the plat. The found
monuments surrounding Block 10, believed to be set by Arthur M. Holm, do not coincide with the mathematics of his
survey.
A recent title opinion was not provided and this parcel is subject to multiple easements and agreements of record.
Many of them are relative to ingress, egress and water distribution. The validity of many of the easements is
questionable because of the lack of use and undefined location. The entire parcel, lying south of the Public Park and
Highway easements, is subject to a Scenic Easement per Document No. 362477.
Thence by a deflection angle of 31° 2' to the left on a straight line 68.7 feet to an iron pipe monument; thence by a deflection angle of 43° 40' to the right on a straight line to the point of
intersection with the northerly line of Lot 2 Block 11 of Otisville. Legend
